Family and friends concerned about missing Cape Coral Man

This man needs our help! Didn't see a thread for him yet but if I overlooked it, please forgive me. His friends seem very concerned.

This article has more information about his disappearance that is more concerning in my opinion, than what was reported in the initial article.
"According to a missing persons report, Schmalbach's friend got a voicemail on July 19. He didn't check it until the next day, but Barry said he needed help getting his boyfriend out of his apartment." 'Really concerned': Cape Coral man missing for five days without a trace

Another snip, 2 pieces of info that are concerning in different ways:
Another reason for suspicion: the report says Barry left his car at the apartment. His friend told police he believes Barry's boyfriend drove it a couple of times since Schmalbach disappeared.

On July 22, just a few hours before his friend called the police, Barry's boyfriend did report Schmalbach missing. When police talked to him, he said Schmalbach had not made any suicidal statements or had any concerns that he was in danger. Police did not take a missing persons report at the time.

Obviously, leaving his car behind is very worrisome. I'm also disturbed that LE didn't take a report when Barry's bf reported him missing. I wonder why not?

Investigators also said Schmalbach’s boyfriend gave them a false birthdate for himself and has active arrest warrants in Georgia and South Carolina, but they said neither appear to be extraditable. […]

Friends tell WINK News Davis lived in the apartment with Barry, but the note on the door said Davis is not on the lease and he must leave.

Miguel Blanco, one of Schmalbach’s best friends, told detectives after Schmalbach’s disappearance, his jeep disappeared then reappeared in the condo parking lot.

Christopher Davis has been arrested for an active warrant out of Columbia, South Carolina.

Cape Coral Police arrested Davis at a Gym on Del Prado Boulevard, Tuesday. The warrant is for a Cape Coral probation violation dated July 11, 2018.

Schmalbach’s family gathered in Jaycee Park Saturday, passing out flyers. ...

... The police now have a person of interest in Schmalbach’s disappearance, but they have not identified who it is.

Schmalbach’s live-in boyfriend, Christopher Davis, was just arrested for unrelated charges. Cape Coral Police learned he had two out-of-state warrants for parole violations.

WINK News spoke with ES, Schmalbach’s half-sister, “Truthfully, we we have no idea. We haven’t known him too long. We don’t want to speculate anything. We are aware that he has been arrested on other charges, but nothing that has been related to Barry.”

There was a heavy police presence searching sewer drains in Cape Coral as part of an ongoing investigation, according to authorities.

The Cape Coral Police Department did not say if it’s connected to missing person Barry Schmalbach, but the investigation is four blocks away from his condo on Beach Parkway. Schmalbach disappeared three weeks ago.

The officers were seen opening up three different grates, checking each one.

“This case, I think they probably just fell on it by accident. They happen to be looking into someone, and they find out he has got a warrant. That’s probably what happened.,” said Raheb.

“They might have discovered that just by trying to speak to him, and then a background check and realized.”

Raheb said if Cape Coral Police wanted to keep him in Lee County, they’d have to find out the probable cause and get their own warrant. In the meantime, unless Davis posts bond, detectives know where he is.

“Whether it’s strategy or lack of evidence, law enforcement here had to honor the warrants, and they had to let him go,” said Raheb. “They could always then serve them with their own warrants. And if and when he’s done in that state, they’ll bring this individual back to the state of Florida.”

Schmalbach's half-sister, ES, came to Cape Coral one week ago from Chicago. ...

[...]

Scaletta is now back home, waiting for answers.

[...]

Since she left, Scaletta said police have called her and said they're still working on leads.

Also since her return home, Barry Schmalbach's boyfriend, Christopher Davis, has been arrested. He was arrested on a 2018 South Carolina warrant for probation violation. The violation, according to the arrest warrant obtained by Fox 4, says he did not report to his probation officer after moving from Florida to South Carolina. The original charge in the case is for grand larceny, records show.

Davis was arrested by Cape Coral Police on August 1 for the warrant and was extradited to Lexington County in South Carolina. He faced a judge on Friday and his bond was set at $50,000.

... The missing persons report shows Davis was the last person to see him on July 19. He told police that Barry got into someone's car or an Uber outside the Cruisers bar and left; however, police say Barry was last seen at his apartment.

... According to court documents, the landlord is seeking between $8,000-$30,0000. The complaint says Schmalbach paid his rent until October but is in breach of his lease.

[...]

“A Landlord in Florida, once there’s a lease, you know he has to proceed through the courts. And so he really has no choice. That’s why they’re saying it’s a legal formality. Yes, because you’re not allowed to simply walk in and throw people out,” said [attorney] Raheb.

Emily said family and friends cleaned out Schmalbach’s apartment a couple of weeks ago. Inside, they found a bunch of pictures of Schmalbach with his little sister, whom he loves so much.

“There are so many photos, and just then I knew he had photos and everything, but just the fact that he had so many is kind of like— I don’t want to say it’s sad, but it’s I don’t know, you know?” said Emily.

Despite Cape police remaining tight-lipped due to the ongoing investigation, Mercedes Phillips, CCPD spokeswoman, confirmed that officers are actively investigating and assembling different pieces of information.

“In the Barry Schmalbach case, officers are still actively investigating. We’re kind of putting different pieces together, but there’s still not anything we’re ready to go on a release yet,” said Phillips.

When asked about the family’s cooperation, Phillips stated, “Yeah, we’re still in touch with them. They’re still up-to-date with where our investigation is at and what’s going on, and they’re very understanding with everything.”

"This is still an active and ongoing investigation," Officer Mercedes Phillips wrote in a statement sent to The News-Press this week. "We are still collecting details about the case that we are unable to discuss at this time."

Phillips said further updates are to come.

Chief Anthony Sizemore said Aug. 4 the Schmalbach's disappearance was "suspicious in nature."
