Christian B. case: Does ex-BKA employee blow up the process?

Braunschweig. With her knowledge of the inner workings of the elite police department, she has already caused a scandal. Defense attorneys want her as a witness.

The olive story which is basically from last week, the relevant bit.

The trial continues today with the Judge from the Diana Menkes case being cross-examined, before other child victims of Brueckner’s in Portugal are expected to give evidence.

Google translate.

Now the Maddie case officially plays a role in the trial against Christian Brückner (47)!

The punished child molester is currently standing for three rapes and two cases of child sexual abuse before the Braunschweig Regional Court. The public prosecutor also believes that Brückner was the small one in Portugal in 2007 Maddie McCann (then 3) kidnapped and murdered. He is not (yet) accused of this.
So far, the court has avoided making too many references to the Maddie case. Finally, the disappearance of the British girl from his parents' holiday apartment on 3. May 2007 not part of the procedure.

But now a man is supposed to testify as a witness who knows the Maddie case like no one else: Mark Draycott, Detective Constable at Scotland Yard.

The Crazy One: Brückner's defenders have asked to hear the British policeman as a witness. To relieve the accused, who is the only suspect in the Maddie case!

In 2011, Scotland Yard took over the missing person investigation. Draycott was the central investigator of the „ Operation Grange “. In 2017, witness Helge B. ( 52 ) reported to Scotland Yard: He had important information about the Maddie case. Draycott is said to have been one of the officials who traveled to Athens to interview Helge B.

Scotland Yard passed the information on to the BKA, which, together with the Polícia Judiciária in Portugal, was looking for unresolved rape cases in which the perpetrator operated similarly. They found what happened in 2004 when the American Diana M. (then 72) was raped in her house in Praia da Luz. Brückner's hair was found on the archived asses. In 2019 he was sentenced to seven years in prison for this act.

But the testimony of witness Helge B. drew further circles.

The witness stated that Brückner had confessed to the murder of Maddie. At a music festival in Spain, the men talked about the case, Brückner claimed that the girl did not scream „ when he was kidnapped. “

And the witness put something else on record: in 2006 he stolen video cassettes from Brückner's house in Portugal, which showed how Brückner raped masked women. A statement that triggered a series of investigations and now the second process.
Because the defense around Dr. Friedrich Fülscher (39) believes that Helge B. has changed his version of the video remaining in various statements and interviews, The Maddie-Cop from England should now be interviewed: What exactly did Helge B. tell him in 2017 during the survey in Athens?
The exciting question that hovers over everything: Will DC Mark Draycott also have to testify about what the investigators have in hand with Christian Brückner in the Maddie case?

The policeman is said to. May testify.

The Sun are running with it.

Not sure on that.

I got the feeling that he already had a little girl in the house!” she exclaimed to the court on Day Ten of his trial over five sex offences, including three rapes and two child abuse offences, last Friday.

Never mind - I see it is Day 10...
:)

The judge at the 2019 trial testified?
We seem to be missing a great deal of information from the on going trial making it exceedingly difficult to assess exactly what is taking place.

Snip
In the rape trial against C B., who has a criminal record, the judge who sentenced the defendant to seven years in prison in 2019 was heard as a witness. At the time, she perceived the men who were considered as witnesses for the prosecution in the current proceedings as authentic, said the 64-year-old on Wednesday in the Braunschweig Regional Court. It was only through the testimony of a now 53-year-old man about videos on which he recognized Christian B. that investigators became aware of the then 72-year-old victim from the USA.
...
Their criminal chamber in Braunschweig at the time convicted the 47-year-old German because a hair of his had been found in the victim's bed.

According to the judge, the statements about videos with rape scenes were only significant because of the similarities in the crime. In the current trial, the video scenes described are accused of rape, although the women involved could not be identified and the videos have disappeared.

The defendant is accused of an attack on a 20-year-old woman from Ireland, also in Portugal, as the third rape. The Irishwoman is expected to testify in May. She is also said to have recognized similarities to the assault on herself in the reporting of alleged acts.
Her testimony in Braunschweig is expected in mid-May.
...
However, the MM case is not the subject of the current trial.
Overall, the presumption of innocence applies.
B. remains silent during the trial.
His defense attorneys had announced at the beginning that, in their view, their client would ultimately be acquitted of all the accused acts. They also expressed doubts about the final verdict of the now retired judge.

I still think CB will be convicted on the rapes from the video tapes, and the reason is that given by the Judge. (Which he also stated in the 2019 trial).

There is no way the two men could have invented assaults with such similarities before they could have learned about the DM rape. I think the judge is correct that they must have seen rapes.

The only question in my mind is legal. Can you convict CB with unknown victims? Is this definitive enough?

yes he did saying that in the original trial HB did not say that the tapes were date stamped with 2005 so...possibly its beyond the boundaries they can prosecute

I think in the 2019 trial, there is also a different burden of proof.

The viewing of the tapes was just an evidential, corroborating factor. Each piece of evidence does not have to be proven beyond reasonable doubt - the judge merely had to accept the evidence of the two men, together with the forensic evidence.

In this 2024 case, the rape of each of the victims must be proven to the higher criminal standard. Can that tough standard be met when its not clear they even saw the same things and there is no other corroborating evidence?

Makes sense what you are saying , the hair found at the scene corroborated HeB and MS statements but the video evidence remained unpunished . We now have independent witnesses who have seen a video camera and tapes . Also we have a written letter from CB asking his then girlfriend to remove above items and more before the Police find them. We are yet to hear from HB who alleges CB filmed the assault and despite wearing a mask would recognise his voice if she heard it , maybe that has been tested by the BKA .

Without the actual videos themselves I don’t think the prosecution can call it and hence the wide time frame. HeB may indeed be right but it’s not conclusive without the videos or victims.

Agree re the unknown elderly woman but struggling to see how a conviction is possible in the 14yr old assault case, in that, unlike the former, her assault/rape doesn't come with the same 'back-up'.
