Kimberly Dyer, 31, is believed to have died on October 21 or 22 in a home on the east side of Elkhart. Police believe she was held captive by three men. She was then tortured and mutilated while she was still alive.

The Elkhart County Prosecutor says three men are under arrest for the "egregious" crime. Those men are Donald Owen, Mario Angulo and Matthew Murzynski. While Owen and Angulo are charged with murder, Murzynski is not. He is charged with criminal confinement.

Angulo and Murzinski make their first court appearances on Thursday. Owen was found and arrested in Waco, Texas. He is awaiting extradition to Indiana.

Kimberly was held captive by three men. She was then tortured and mutilated while she was still alive. The probable cause affidavit - which describes the nature of the crime in detail - is sealed to protect the identity of witnesses. Police say all three men were involved in gang activity.

12/26/19 Update: Initial appearance hearings for Angulo & Murzynski. Owen was found & arrested in Waco, Texas. He is awaiting extradition to Indiana. No date yet for Owen.

The Elkhart County Prosecutor is seeking sentences of life without parole for Mario Angulo Jr., 19, and Donald Owen Jr., 20, while they face murder, robbery and criminal confinement charges. The third man, Matthew Murzynski, 24, of Elkhart, is charged with counts of robbery and criminal confinement.

Officials say three Elkhart men tortured and murdered a woman

Those men are 20-year-old Donald Ray Owen Jr., 19-year-old Mario Angulo Jr. and 24-year-old Matthew Murzinski.

Mario Angulo and Matthew Murzynski appeared in the Elkhart Circuit Court on Thursday morning for their initial hearings where they were advised of the charges, their rights, and deadlines for filing certain motions in their cases. Judge Michael A. Christofeno also set a preliminary trial date of May 4, 2020, for both defendants. Attorney Status conferences are scheduled for next Thursday in Circuit Court, and a Pre-Trial Conference is scheduled for January 23, 2020, for both defendants. Donald Owen, Jr., was arrested in Waco, Texas on Thursday of last week and remains in the custody of the Sheriff of McLennan County, Texas, awaiting extradition.

All three are also charged with Level 2 felony robbery resulting in serious bodily injury and Level 3 confinement resulting in serious bodily injury for their alleged actions against a 32-year-old Sturgis man. The robbery and confinement of the Sturgis man allegedly happened at the same time of Dyer's alleged torture and murder.

The prosecutor's office release does not specify how Dyer died but announces that "due to the egregious nature of the offenses, [the prosecuting attorney] is also seeking a sentencing enhancement of Life Without Parole against Owen and Angulo, including allegations that Ms. Dyer was intentionally murdered, and was burned, mutilated, or tortured while she was still alive; and, that the murder occurred while Owen and Angulo were committing criminal organization activity."

The prosecutor also will seek a criminal gang enhancement against Murzynski for his alleged criminal organization activity. Criminal gang enhancements allow the sentence on the most serious offense for which a defendant is convicted to be doubled, making the maximum sentence for the charges against Murzynski 92 years in prison.

A preliminary trial date was set for May 4.

ELKHART – Prosecutors are demanding life sentences without parole for two men accused of torturing and murdering a woman in Columbia City, Indiana.

In a press release, Elkhart County Attorney Vicki Becker announced that Donald Owen and Mario Angulo have been charged with murder and two counts of forcible confinement, a level 3 crime, for their alleged roles in the death by Kimberly Dyer, 31 years old. Owen, 20, Angulo, 19, and a third man, Matthew Murzynski, 24, are also charged with serious theft causing serious bodily harm – a Level 2 crime – in the trio’s actions against a Michigan man in during the same period as the murder. would have occurred.

I'm so glad to find this. Elkhart is my hometown and have been following this case closely.

The earliest I saw anything posted was the missing notification the sheriff put out on Nov 8. I haven't found any info at all until the arrest of those 3 men late in Dec. The prosecutor has this shut up tight as a drum, with good reason. Here's the press release she issued:

Three Elkhart men have been arrested for their respective roles in the torture and murder of Kimberly Dyer, age 31 of Columbia City, Indiana, alleged to have occurred on or about October 21 and 22, 2019, at a residence on Old Orchard Lane on the east side of Elkhart, Indiana. Donald Ray Owen, Jr., age 20, and Mario M. Angulo, Jr., age 19, are both charged with Murder and Confinement Resulting in Serious Bodily Injury, a Level 3 felony, for their actions against Ms. Dyer. In addition, Owen, Angulo, and a third Defendant, Matthew Murzynski, age 24, are all charged with Robbery Resulting in Serious Bodily Injury, a Level 2 felony, and Confinement Resulting in Serious Bodily Injury, for their actions against one Robert Porter, age 32 of Sturgis, Michigan, alleged to have occurred over the same time period as Ms. Dyer’s torture and murder. Murzynski is also charged as a Co-Defendant of Owen and Angulo for Confinement Resulting in Serious Bodily Injury, a Level 3 felony, for his actions against Ms. Dyer.

Pursuant to Indiana law, and due to the egregious nature of the offenses, Prosecuting Attorney Vicki Elaine Becker is also seeking a sentencing enhancement of Life Without Parole against Owen and Angulo, including allegations that Ms. Dyer was intentionally murdered, and was burned, mutilated, or tortured while she was still alive; and, that the murder occurred while Owen and Angulo were committing criminal organization activity. Becker is seeking an enhanced sentence against Murzynski as well, alleging the Criminal Gang Enhancement applies due to his criminal organization activity with Owen and Angulo during the commission of the crimes.

If successful, the sentence enhancement of Life Without Parole would exclude both Owen and Angulo from ever being released from prison. The Criminal Gang Enhancement allows for the sentence on the most serious offense for which a defendant is convicted to be doubled. The normal term of imprisonment for the crime of Murder is 45-65 years in prison. The normal term of imprisonment for a Level 2 felony is 10-30 years in prison, and for a Level 3 felony, the normal term of imprisonment is 3-16 years in prison. Credit time could be granted by the Indiana Department of Correction in the maximum amount of one day of credit for every three days of time actually served if a defendant is sentenced to a specific term of years. Accordingly, if convicted, Owen and Angulo could be sentenced from a minimum period of 45 years in prison, to a maximum of Life Without Parole. If convicted of all allegations, Murzynski could be sentenced from a minimum of twenty years, to a maximum of 92 years in prison.
Becker originally requested that the filing of all charging documents be sealed by the Court in an attempt to apprehend each of the defendants timely and without harm, and to protect witnesses and investigative information while the defendants were still at large. Upon notification that each of the defendants were in custody on Friday last week, Ms. Becker requested the charging documents be released from the seal, except for the Affidavit of Probable Cause, which was granted by the Court.

Mario Angulo and Matthew Murzynski appeared in the Elkhart Circuit Court on Thursday morning for their initial hearings where they were advised of the charges, their rights, and deadlines for filing certain motions in their cases. Judge Michael A. Christofeno also set a preliminary trial date of May 4, 2020, for both defendants. Attorney Status conferences are scheduled for next Thursday in Circuit Court, and a Pre-Trial Conference is scheduled for January 23, 2020, for both defendants. Donald Owen, Jr., was arrested in Waco, Texas on Thursday of last week and remains in the custody of the Sheriff of McLennan County, Texas, awaiting extradition.

Here's a shot of Owens; IMO the tats are associated with the Latin Kings. Looking at his record, he really needs to be taken off the streets for good. He had criminal actions in Waco, while he was with his female relative. She has warrants and was brought back, too.

Prior to a high-speed chase,
Police had been searching for Owen in connection to an armed robbery of a pizza delivery driver earlier this week in Waco, Bynum said.

This is an interview with some of the neighbors. It would have been quite a shock to the neighbors to learn someone was murdered there. They show the home in the video at the link.

The home has seen a lot of activity in the past few months from police and some strangers to the area.

Learning more about Kimberly Dyer and scene of alleged murder

"We just used to see police cars, you know, watching the houses,” Sally Powell said.

"I'll find you" is spray-painted on the garage of the home on Old Orchard Lane in Elkhart where the prosecutor's office says 31-year-old Kimberly Dyer was tortured and killed.

Neighbors say police had been watching the home leading up to what they say was a raid in late November or early December.

"Well, both of us suspected something was going on so it had to be drugs," said Powell, who along with her husband had suspected drug use and/or dealing at the home.

A neighbor who did not want to appear on camera said that while police were at the home, they were looking at a burn pile in the backyard until 4 a.m. while processing the scene.

Court records show no movement on Owen since Dec 24. The person named with him in Waco, TX was back in court in Elkhart on Dec 31; so I don't know what's happening with him. Maybe Waco is filing charges against him out there but I can't find anything on him there. Maybe extradition is the holdup.

If anyone wants to do some digging, this is a good case to do it on. Just don't post most of it here but feel free to start a private convo. Searching by names will get their criminal history; I've included the case # for the 3 accused if you're only interested in this one case. Both of the JR.s have people with the same name; it's confusing.
