I've been following this for quite a while. I'll post Brandon's case here, too; as well as following them through the court system.

LEBANON, Indiana — The parents of a man with disabilities were charged with neglect after he was rushed to the hospital and found covered with sores and his own waste.

Lloyd Maxwell and Bridget Toney were caring for their 23-year-old son, Brandon, who has spina bifida.

Officers found Brandon had numerous open sores on his lower body and was covered in feces. Police noted some of the sores were deep enough they could see the bone. They also noted bugs and maggots on his body.
One of the doctors caring for Brandon noted that there were mouse droppings found in some of Brandon's wounds.

At first, doctors considered a radical amputation from Brandon's belly button down. Medical staff said Brandon had the social skills of a 10- to 12-year-old and did not have the capacity to make complex medical decisions.

Brandon S. Maxwell, 24, formerly of Lebanon, was charged last week with two counts of child exploitation after it was reported that he downloaded and shared pornographic files depicting children in 2020.

Court documents say the detective obtained a search warrant for Maxwell's cellphone, which contained 633 images — approximately 600 of which met the Indiana and federal statutory definitions of child *advertiser censored*.

According to court documents, the images found on Maxwell's cellphone contained sexually explicit content involving young girls, toddlers and infants.

I'm so confused! So doctors were providing end of life care in Dec of '21, but Brandon defied the odds and survived, only to be arrested for child exploitation in July of '22??
I didn't find a follow-up for his health issue; he looked pretty healthy in his mug shot. Yes, he has 2 cases pending in 2 different courts. I'll post those later today or tomorrow.

According to court documents, officers responded to a home on S. Meridian Street in Lebanon on April 2 in response to an unresponsive male. Inside, officers found the couple’s 23-year-old son breathing but not alert.

Police said the couple’s son is diagnosed with Spina Bifida and had been unable to move on his own without assistance for several months. Police learned later during their investigation that he had been confined to a bed since January 2021.

When officers arrived at the home, they reported an extremely foul odor of feces and urine. Police reported that the disabled man was found in a soiled bed, his lower body covered in feces. Bugs and maggots also covered the man’s bed and body, police reported, along with mice droppings.

In addition to the unsanitary living conditions, the 23-year-old had numerous open sores with protruding bone visible in some of the wounds.

Doctors told officers they believed the wounds developed due to the victim being confined to his bed without moving for an extended period of time.

Transported to a hospital, the 23-year-old’s wounds were so severe that doctors told police they were “non-healable” and that they were life-threatening.

Family of the 23-year-old tell FOX59 that part of one leg has now been amputated, just below the knee. They also said, “Back in April, the surgery was to be everything below the bellybutton. He wasn’t strong enough to survive that. When he got COVID, the virus settled in one of his legs. They took that leg in a much shorter manageable surgery.”

Brandon Maxwell is in a rehab hospital. Doctors have removed one leg. Over the past couple of months, he has gained 25 pounds. He’s expected to leave rehab in a few months.

That's just horrid. From the link I posted, he seemed to be protective of his parents.

"According to court documents, police found Brandon Maxwell covered from the waist down in his own urine and feces. Bugs and maggots had infested his body and bed linens. The smell of rotting flesh and feces permeated the entire house.

“The bugs ate almost 40% of his lower body,” Cheryl Toney said.
“Part of his rear end is gone. We have had to have his right leg amputated,” Danny Toney added. "

Here is BT's case. Her charge is the same as LM's and there's been very little action in her case other than continuances. The only date for her, at this point, is the jury trial date.

Probably an exceedingly stupid question, but I assume prosecutors charge first and determine competency later? That is to say, even if he was living in an adult care facility and staff there said he had the mentality of a 10 year old and couldn't understand right and wrong, the prosecutor would still charge him and let competency be sorted out in the court system?

I'm kind of hung up on that "social skills of a 10- to 12-year-old." Does that mean that he functions on that level or just communicates on that level. OR are they the same?

I'm guessing you're right about the competency being sorted out later. I haven't seen the Probable Cause Affidavit for his arrest but that usually just lays the grounds for his arrest.

It was after his recovery while he was in a care facility far from his parents care, per the articles.

Adding, if their goal was to get rid of their 'burden', that would be one method by which to do so.

I hope he has someone good representing him.

I wondered about that, too.

He was still at his parents when the first case was filed. I'll put his case info here tomorrow

Maybe this will be helpful; notice the difference in the time the case was filed and when the crime actually happened.

I see. Thank you. And they, the parents, were in jail at the time, awaiting their court cases?
His parents were arrested on Dec. 17, 2021. Their crimes are dated 04/02/2021. From the article posted earlier:
Maxwell was born with spina bifida and requires a great deal of attention. His grandparents, Danny and Cheryl Toney, took control of his care in April. They say he had been living in a house on the southside of Lebanon with his parents, Bridget Toney and Lloyd Maxwell, until police showed up.
