State's Rebuttal, Deliberations Remain In Casey Trial

Prosecutors will get the final word with jurors on Monday July 4TH before they begin deliberating Casey Anthony's fate and the role she played in the death of her 2-yr-old daughter Cayle Marie Anthony.

Attorneys for the state are expected to use two hours to present their rebuttal to the defense's closing statements. After the rebuttal, Judge Belvin Perry will instruct jurors on the charges Casey faces, including first-degree murder.

Judge Belvin Perry scolded a defense attorney and a prosecutor in Casey Anthony's murder trial Sunday afternoon for an in-court spat.

During defense attorney Jose Baez's closing statement, prosecutor Jeff Ashton could been seen covering a smile with his hand.

ORLANDO, Fla. -- Jurors began deliberating Monday in Casey Anthony's first-degree murder case after lengthy instructions from Judge Belvin Perry.

Casey Anthony's actions, particularly those in the 31 days after her 2-yr-old daughter Caylee Marie Anthony went missing and before police were notified, speak volumes about her guilt, prosecutor Linda Burdick told jurors at the conclusion of closing arguments.

Burdick reminded the jury that she went through each one of those days in her opening argument as the trial began, asking "Where is Caylee?"
"The question is no longer 'Where is Caylee?' We know where Caylee Marie Anthony is," Burdick said. "The question is no longer 'What happened to Caylee Marie Anthony?' We know what happened to Caylee."

Casey Anthony's actions and responses "answer for you the only real question left at this stage of the proceedings, and that is who killed Caylee Anthony," Burdick said.

Casey Anthony is charged with seven counts, including aggravated child abuse and misleading police. If convicted of first-degree murder, she could receive the death penalty.

Prosecutors allege Casey Anthony used chloroform to render her daughter Caylee Marie unconscious before putting duct tape over her nose and mouth to suffocate her. Then Casey left Caylee's body in the trunk of her car for a few days before disposing of it, they allege. Caylee's skeletal remains were found in December 2008 near the Anthony home.

The jury has begun its deliberations in Casey Anthony's murder trial on Monday, following Judge Belvin Perry's final instructions.

The state ended its closing arguments on Monday. During their closing arguments, prosecutors told jurors they kept their promises, alluding to defense claims that never materialized.

Prosecutors also said it is "absurd" to think her 2-year-old daughter drowned or that Casey's father, George Anthony, covered up Caylee Marie Anthony's death to make it look like murder

Casey Anthony: How did Jeff Ashton do this morning?

WFTV-Channel 9 legal analyst Bill Sheaffer called Ashton’s performance outstanding and gave it an A plus. Ashton had to make jurors understand they can find Casey guilty of first-degree murder under two theories, Sheaffer noted.

WOFL’s Shannon Butler said Ashton was impressive yesterday but he bogged down the jury with too many facts this morning.

Legal analyst Judge Eaton Jr., noted how the state benefited from Chief Judge Belvin Perry’s calling a break last night. That allowed the state to start the rebuttal this morning.

12 member jury will be taken into a deliberation room, where they will stay until a verdict is reached.

All 17 jurors were escorted from the courtroom, but the alternates were separated from the 12 members who will decide Casey Anthony's fate.


The five alternates will continue to be sequestered until the jury reaches a verdict.

Chief Judge Perry will address the five alternates after they are taken to another location inside the courthouse. A court reporter and one member of the state and defense will join Perry.

The jurors will be served lunch inside the deliberation room, then will choose a jury foreman who will act as a spokesperson and keep the discussion on topic and cordial.

Once a verdict is reached, the judge will give a 30 minute warning to allow the state, defense, defendant and all others gather inside the courtroom.

Impassioned rebuttal
Assistant state Attorney Linda Drane Burdick gave a devastating closing argument that detailed Casey's history of lies and questioned who had most to gain by the child's death.

Argument for first-degree murder
Earlier, Ashton also made the argument for first-degree murder, telling jurors they can reach that verdict through premeditated murder or felony murder through aggravated child abuse.

Ashton reminded jurors they do not need to be unanimous in deciding premeditated or felony murder. They can be divided and still reach a first-degree murder verdict.

"Regardless of how you put these facts together...any way you slice it…Casey Anthony is guilty of first-degree murder in this case," Ashton said.

Lead prosecutor Linda Drane Burdick followed Ashton, telling the jurors that prosecutors presented every piece of evidence they promised during opening statements back in May. Without saying it, she was pointing out that defense attorneys never presented direct evidence backing up their contentions that the child drowned and the death was made to look like a murder.

She then hammered on the lies Casey Anthony, then 22, told during the 31 days between when her daughter was last seen on June 16, 2008, and before sheriff's investigators were notified a month later. Those include the single mother telling her parents that she couldn't produce Caylee because the girl was with a nanny named Zanny, a woman who doesn't exist.

Burdick concluded the state's case by showing the jury two final, side-by-side images of Casey Anthony. One was of her smiling and partying in a nightclub during the month Caylee was missing. The other was of the "beautiful life" tattoo she got a day before her family and law enforcement first learned of the child's disappearance.

"At the end of this case all you have to ask yourself is whose life was better without Caylee?" Burdick asked. "This is your answer."

Anthony sat stone faced during much of the prosecutors' arguments, but occasionally shook her head in disagreement and spoke under her breath.

Why we're obsessed with the Anthony trial

The jurors are beginning deliberations in this first great media trial of the 21st century, a trial that is both a psychologist's dream and nightmare. The lack of definitive, incontrovertible evidence in the death of toddler Caylee Anthony means jurors will likely rely on their feelings and subjective judgments about human behavior. These kinds of observations will probably dominate discussions. This is the old movie "12 Angry Men" remade, but with less concrete evidence and a better gender balance.

In the Casey Anthony trial, circumstantial evidence is all over the map -- and with the apparent lying, significant contradictions and flip-flops of testimony, and questionable or bizarre theories of human behavior, it is little wonder that this nation has been glued to the tube. This is O.J. all over again, but with less forensic and more psychological features. The glove didn't fit, but in the Anthony trial, few things fit.
