Back to ground zero

In interview this morning to the SIC, the McCanns admitted that the case is back to the "ground zero" but also said they understand the actions of the Portuguese police.

The interviews that the couple McCann granted to the three stations of Portuguese television (10 minutes for each) began about the 11:00. The SIC was the first of the three to interview them in a home in Lagos, away from their villa at the Beach of the Light.

Gerry guaranteed they do not believe for a second that any of the friends of the couple are involved in the disappearance of their daughter, and after more of three months in Praia da Luz the still don't believe this. Both affirmed that they have absolute confidence in the friends that accompanied them in that night, but said also understand that the police need to do their work thoroughly.

The interview carried out privately, arose after the Portuguese press insisted on a meeting with Kate and Gerry McCann, as request after three British televisions obtained interviews in exclusive.

The couple, though calm, answered all the questions briefly and admitted that the inquiries are hurtful but put the investigation back to the beginning.

The Speculation

From the first hour on, the theory of Madeleine’s kidnapping only fits for those who react to these things in an emotional way.

The british press has started a new campaign about Madeleine’s case. Now, the front line is the attack against the portuguese press. And don’t say it’s the tabloids. All, including BBC, Sky News, are distorting and manipulating news with one objective: to save their faces. They bet the whole World that Madeleine was abducted. Now, there is no way back. Their issue is very simple: all news that point to an abduction are good. As long as the abductor is not english. All news that point to other solutions are bad. They’re speculation. They seek to attack the pitiful family.

The truth, which no image assessor , no journalist can hide, is that this family has received the best that Portugal can offer in times of distress. We cried with them, we prayed, we wanted to believe the whole image operation was about their distress in the search for their daughter. Even Justice was tolerant. If portuguese parents had abandoned three children to their fate in order to have a good time with their friends, and one of the children disappeared, the press, the police, the social services would be all over them. With the McCanns, we closed our eyes to their negligence. They’re english and so on, they like to get drunk in the Algarve and so on, and of course! they’re culturally different from us. They, the owners of progress, who give their children complete freedom, we, the peasants, who don’t take our eyes off our children. But there is another truth. From the first hour on, the theory of a kidnapping only fits those who react to these things in an emotional way. The portuguese and english police who are investigating this case could not commit that mistake. Mysteries, to be solved, need the exercise of reason and not of tears. And reason, sometimes, pushes us into places of horror. The McCanns’ interviews say what the affectuous masses want to hear. They are carefully prepared by assessors, they integrate the british campaign against other possibilities to solve the mystery, they induce their listeners to believe there is no truth except the abduction. A truth they cannot explain themselves.

There is still another truth. Only those who ignore what a criminal investigation is about, can talk about new investigation lines. Because they’re all the same age. It’s just that some possibilities show they were not sustainable, and others had legs to walk. The arrival of dogs that are specialized in blood and cadaver odours is no speculation. It’s an evidence. They underline the suspicion that the child may have been killed inside that house. Was it the kidnapper? What for? Did he want to abduct a corpse? So who was it? The answer scares british press, and hence the xenophobe attacks against the portuguese journalists and police. It had to be someone who visited the house and knew it. Someone who knew it well enough to know where the cleaning products were kept, in order to clean blood stains. And, if this police research is confirmed, one cannot even talk about accidental death. Anyone who, alone or accompanied, hides clues, is trying to conceal a crime. There is no simpler deduction exercise available. The instrument of detetctives. Other paths are in faith’s territory. The priests celebrate masses, detectives discover crimes.

PJ forced to investigate kidnapping lead

Alípio Ribeiro, national director of PJ, received a call from John Buck, the british ambassador in Portugal, on the night Madeleine disapeared from the Ocean Club, on May 3.

Around 11 p.m., approximately two hours after the child's disppearance had been communicated to the police, Alípio Ribeiro had to interrupt a private dinner in order to listen to the diplomat. That phone call was the first sign that the british were very keen on accompanying the PJ’s actions very closely, and in forcing the investigations to follow the abduction theory.

“The PJ lost too much time investigating the abduction”, a source connected to the investigation told CM. The pressure of the british diplomacy apparently only slowed down after the arrival in Portugal of british police agents who gave support to the redirectioning of the investigation to the possibility of murder. The biological evidence found in the apartment were decisive in the changing the inquiry's direction, or, at least, for the PJ to admit that change publicly.

The decision to further investigate the possibility of the child's death in the Ocean Club – and in consequence the re-evaluation of the depositions made by the parents and their friends – was also taken taking the opinions of the british police agents into consideration. The interview that Olegário Sousa gave yesterday to BBC and ITN was done in accordance with those agents.

The choice of these two television channels was motivated by the indignation that the british agents themselves felt regarding the accusations that have been made by the british press to the PJ. The BBC and ITN have been treating this case with more distance and impartiality, and that was the reason for which they were privileged tothe interview.

Olegário Sousa admitted for the first time in public the possibility of Madeleine being dead. A position that leaves the McCanns at the center of the investigations, a situation that is being managed "with soft gloves" by the portuguese police.

The couple has benefitted from the help of powerful friends. The first spokesperson for the McCanns, Clarence Mitchell, who organized the several trips Maddie's parents did into various countries, is now an aide of Gordon Brown.

Brown supported the Maddie cause from the begining, because Jill Renwick, a long time friend of the couple, is a neighbour of John Brown, brother of the british prime-minister.

THE INVESTIGATION ON THE CRIME SCENE

Madeleine´s case has been targeted by conspiracy comments, inducing that the British Government asked ours (and our police) to exclusively follow the abduction hypothesis. Yet, don't confuse between Sky News and other media and the British police. It is actually the British police and the scent dogs, put at the Pj´s disposal and trained to trace non-fresh blood and the scent of a dead body, which led to the discovery, three months after the little girl´s disappearance, of blood traces on a wall and a curtain in the McCanns´apartment. This not only contradicts the abduction conspiracy theory but also presents a delicate task to our PJ as well as to those, like myself and a lot of others, who have always maintained our ability and hard work and have no reason to change our minds.

In any case, even more than underlining possible failures and especially considering that the analysis of the discovered traces of blood is still being done in Birmingham, Britain without knowing to whom they belong (and if they are relevant to the case), the interesting point lies on thinking about a present-day vogue (through a television series), which is the scene of the crime.

The fundamental point of a criminal investigation is based on the protection and examination of the crime scene and the consequent gathering of material evidence. If we have excellent Criminal Investigators (as we do have), excellent analysts at the Scientific Police Laboratory (as we do have), but without specialists exclusively trained for the Scene of the Crime, it will be difficult to achieve a good job. The CSI TV series has implied some confusion in the public minds, since criminalists ("forensics") there not only perform the examination of the crime scene but also the criminal investigation and the contacts with the forensic laboratory for analysis. This is not valid nowadays, at least in the countries with a modern police team. Thus it is necessary to have specialised tecnicians in protecting, in registering (drawing, picture, video, etc.) and in examining the scene of the crime (research of various items and traces), who should be neither laboratory analysts nor Criminal Investigators; obviously there are already fingerprints specialists, photographs, artists and laboratory criminalists, but we are talking about another kind of professional. They are called, in the English-speaking countries, as "crime-scene officers", police officers whose skill is in the investigation of a crime and are notified with the shortest delay to immediately come to the scene, the "first responders" who arrive early and are first informed of the facts (in Portugal, normally the GNR and PSP) and who expert isolate the scene of the crime.

This is a situation that requests the greatest coordination between the police and the security forces in Portugal, and deserves the highest integrity of all, starting from the governmental authorities supervising those bodies. But it is also a concern of the justice, since if the scene of the crime has not been duly protected, everything that has been collected can be questioned (putting forward possible contamination, for example), and in the same way, if a material evidence has escaped from the examiners, the investigation of the crime can dramatically be jeopardized. All these precautionary measures (and other ones) are fundamental to ensure the necessary preservation of the material evidence which a good justice is based on. It is therefore necessary for us to provide good technicians for the scene of the crime exclusively dedicated to that task to be performed with professionalism and according to the worldwide stated examination procedures of the crime scene (either on closed spaces or in the open air).

The parents of Madeleine McCann have denied giving their other two children drugs to stop them waking up on the night of her alleged abduction. Police in Portugal are baffled why Madeleine’s twin brother and sister never stirred the night she disappeared from her holiday apartment.

Detectives had hoped that the two-year-olds Sean and Amelie could be key witnesses in the case and provide vital clues about their sister’s fate. But reports in Portugal claimed detectives had abandoned plans to try to coax information gently out of the toddlers – because they slept through the whole ordeal.

There has been growing speculation in the Portuguese media that Madeleine and the twins may have been administered drugs by their parents, who are both doctors, to help them sleep. But yesterday the McCanns categorically denied that they had sedated their children. A source close to the family said: “They did not give the children sedatives that night. They have never given their children sedatives.’’

It is understood that the couple have never given their children anything stronger than the over-the-counter painkiller Calpol, the infant form of paracetamol. Reports in Portugal claim that the twins did not even wake when part-time GP Kate, 39, found Madeleine missing – and repeatedly screamed out her name in desperation. And they slept on after the McCanns raised the alarm and a frantic search began involving their friends and other holidaymakers. The twins were eventually carried out of the apartment still sleeping by two police inspectors, it was reported.

Officers were so stunned that they even asked the McCanns if they had given the children sedatives to help them sleep, it is claimed. The couple insisted that the children had been tired & exhausted after a long day in the sun.

Police have also asked local pharmacies to check their records for anyone buying sedatives in the days before Madeleine vanished. Chemists were asked if they had sold insect sprays containing the knock-out drug in the days leading up to Madeleine’s disappearance. Frustrated detectives are now resigned to the fact that two “witnesses” who were in the same room as Madeleine at the time when they believe she died saw or heard nothing. A police source said: “It is a remarkable aspect of the investigation. Madeleine was asleep in a bed between the twins’ cots – one on either side.

“They were just a few feet away, yet they never woke up. “We had hoped officers could have discovered information from the young ones in a gentle way. “It might have been possible that they could have unearthed things children may even have tried to bury in their subconscious – things they never even thought they’d witnessed. “But in this case there was nothing. The twins simply carried on sleeping, even through all the noise and the con­fusion during the desperate search that followed.

The two children were asleep when police arrived and were removed from the apartment by two inspectors. Because of this they were unable to be of any use in our investigations. Kate and her consultant cardiologist husband Gerry, also 39, believe that Madeleine was abducted from the apartment while they dined in a tapas bar and is still alive. They think the twins simply slept through the abduction.

A family friend said: “They didn’t give the children anything to help them sleep. The youngsters must have just been exhausted after a long and exciting day on holiday. “In some ways it may be a blessing they didn’t wake.’’

If Madeleine McCann’s parents return to England, as they have already announced, Policia Judiciaria (PJ) may have difficulties in making the couple return to the country for a new interrogation, if they come to be considered suspects according to new clues.

This is the opinion that was yesterday expressed to DN by a lawyer, who believes that the strong media impact and the pressure that has been made by English media on the Portuguese authorities will make it more difficult for PJ to guarantee the presence of Gerald and Kate McCann in future inquiries.

On the other hand, he adds, if the couple is constituted arguidos in Portugal, their situation would depend on the coercion measure that is imposed by a judge. Yet, it would be assured that “they could not return to England anymore” in order to try to lead a normal life, even defending the stability of their twin children.

“PJ has been preparing, for two weeks, the public opinion and Maddie’s parents and friends for clues that point to the death of the child and the possibility of advancing with new arguidos”. For that, “security in the investigations is necessary, as the credibility of Portugal is questioned, at a time when we preside the EU”.

Police and the Guardia Civil have no indications that the girl that went missing in Portugal was in Spanish territory, as Madeleine’s parents have pointed out in several media.

The Police and the Guardia Civil have, at the moment, no investigation line at all about the possible presence of British girl Madeleine McCann in Spain, or that she might have passed through this country at any moment after she was abducted, according to sources from both authorities that are in charge of missing persons and abductions.

In several interviews that were published today by Spanish media, Madeleine’s parents point to the possibility that their daughter is in Spain, and they say that Spanish Security Forces are “involved” in the investigation. There is no doubt that neither the Police investigators nor the Guardia Civil have an open line on that issue.

The consulted sources have explained that since the first moment, they have studied every single lead, coming from abroad or from any point in Spain, about people who believed they had seen Madeleine, and that those researches have lead to no trustworthy trail.

Furthermore, police forces have stated that the explanation that the child could be in Spain because there are no controls on the border with Portugal could equally be applied to any other country within the European Union.

The McCanns’ neighbour in the Ocean Club apartment was heard on Monday by Policia Judiciaria and confirmed she heard Maddie crying for her father the day before she disappeared. Pamela Fenn, 70, had been inquired at the beginning of the investigation, but the day before yesterday she made a more precise deposition about the details of what she heard and the conversation she held with the girl’s mother on the night that she vanished.

In the deposition that was made at PJ in Portimao, which has been functioning as the headquarters of the investigation, Pamela Fenn confirmed she had made herself available to contact police authorities, although Kate McCann dismissed that offer saying the alert had been made. The crossing of the time at which this conversation took place with the record of the alert to GNR is one of the important elements for the reconstitution of what happened during those moments.

The date for the deposition was scheduled with the witness in order to avoid pressure from the media. The interrogation was scheduled for yesterday, but was then anticipated on the last few days and kept secret. Even yesterday, Olegario Sousa, the PJ’s spokesman, assured he could not confirm the diligence, while a few days earlier he had denied it completely.

At this stage, the investigation continues to be centered on the results from biological samples that were collected in the apartment and in the cars that were used by the English family’s friends.

The deadline that was given by forensic specialists in Birmingham to Policia Judiciaria, to conclude the tests, was of 6 to 14 days, but yesterday the fifteenth day passed and no communication was made from London to Lisbon. These results are decisive to determine the course of an investigation in which all scenarios are still open, but the line that is being followed more intensely is the possibility that the girl was killed on the evening of May 3, inside the apartment that she shared with her parents and her two-year-old twin siblings, as the English dogs have indicated.
