ALBUQUERQUE, N.M. (KRQE) – The man accused of killing a child and severely injuring his father at River of Lights in 2021 will go to trial in late August. Sergio Almanza is accused of driving drunk on an ATV, hitting and killing 7-year-old Pronoy Bhattacharya, and injuring his father while they were leaving the River of Lights.

Almanza wasn’t arrested until a month and a half later when he crossed back into the U.S. from Mexico. His trial is set to begin on August 21.

Day 2 - Aug. 22, 2023

Opening statements

State starts off with graphic video of the accident.
Video shows Pronoy, his father, mother and younger brother attempting to walk through the crosswalk at a red light, once signaled to cross.
Seconds later, a utility terrain vehicle plows through the intersection, striking Pronoy. Prosecutors claim Almanza was behind the wheel.
According to state, Pronoy flew over 50 ft. into the air.
Prosecutors are referring to the 'off-road vehicle' as a utility terrain vehicle.
State shows video of suspect at a local restaurant with a group of friends, prior to accident. Prosecutors claim suspect had multiple beers and shots. Prosecutors claim they have receipts to prove it.
According to prosecutors, suspect’s wife and baby was in attendance at the restaurant. Wife did not drink.
State also shows brief video of suspect drinking with friends, hanging out in the afternoon, prior to the accident.
State shows video from an ART bus that shows suspect speeding through bus lanes before the accident.
State claims suspect tried to hide his utility terrain vehicle at friend’s home, while destroying parts of the vehicle, removing roof.
State shows piece of UTV left at the scene and blood stains from Pronoy on the utility terrain vehicle after being hit.
Defense states they agree with the state on most parts of the case.

8/21/23 Monday, Trial Day 1: Jury selection began. 16 jurors (12 jurors & 4 alternates). Trial begins on Tuesday, 8/22/23.
8/22/23 Tuesday, Trial Day 2: Opening statements by (either) Greer Staley or John Duran & by defense attorney Ahmad Assed.
State witnesses: APD officer Arianne Morrow, details the aftermath of the crash, when she arrived on scene. Lapel video from APD was shown in court. Pronoy's parents detail the aftermath of the hit-and-run, the loss of their son & multiple injuries the father sustained from the accident. Prosecutors grilled Almanza's friend on allegedly drinking, with him, hours before the crash.

ALBUQUERQUE, N.M. (KRQE) – Prosecutors are now digging into what they say Sergio Almanza did after hitting and killing a 7-year-old outisde of the River of Lights. In witness testimony on Wednesday, prosecutors highlighted what they say was a coordinated effort to cover up the crime.

Prosecutors bourght one of Almanza’s freinds, Edgar Casas, back to the stand. The prosecution said after the crash, Casas helped Almanza hide the damaged Can Am ATV at Casas’s Albuquerque home.

Casas’s testimony was paused Wendesday morning out of concern that he could be unintentionally incriminating himself. He’s since asked for a public defender and may retake the witness stand soon.

In the meantime, Casas’s mother, Elizabeth Escobar, was then called to testify. Prosecutors questioned her about what she heard the night that the ATV was stashed at her home. Speaking through a translator, Escobar got emotional when asked about what happened.

...... Prosecutors also called a former waitress to the stand Wednesday who used to work at the restaurant Almanza and his friends were drinking at on the day of the crash.
