@lawofruby

NEW: We’re done with day 1 of Trump’s first criminal trial, and while we’ve got a ways to go, the prospective jurors include a “bookseller,” an oncology nurse, an assistant Bronx County DA, and a woman from Fanduel, the sports betting site.

Judge Merchan says Trump is "required to be here" in New York and not in Washington for the immunity arguments before the Supreme Court.

NYers are tough. I would hope that trump's histrionics wouldn't affect them too much. They see a lot of weird stuff on the NYC streets every day. They seem able to ignore much of it. imo
You are right about New Yorkers being tough: I lived in Manhattan many years ago and they don't take no crap-- they say what is on their mind!!!!

I shall try & take less notes today! LOL!

Tuesday, April 16th:
*Trial continues with Jury Selection (Day 2) (@ 9:30am ET) – NY - *Donald John Trump (76/now 77) was indicted (3/30/23), formally arrested, charged & arraigned (4/4/23) with 34 felony counts of falsifying business records in the 1st degree & conspiracy in connection with hush money payments to two women [Stephanie Clifford aka adult actor Stormy Daniels & former Playboy model Karen McDougal] before the 2016 presidential election. Plead not guilty. Warrant vacated, released on own recognizance. New York County
New York: Submitting false invoices or checks. All 34 counts against Trump are felony charges (class E) instead of misdemeanors.
*Gag Order (2/26/24). The limited gag order would bar Trump from attacking potential trial witnesses, jurors & Bragg & Merchan’s staffs while excluding the prosecutor & the judge themselves from the order.
*Gag Order (3/26/24). Merchan issued a gag order on Tuesday that bars Trump from making public statements about jurors, potential witnesses in the case, employees of the DA’s office & the court or their family members (he exempted himself & Bragg from those prohibitions).
Trial began on 4/15/24 with jury selection. Trial expected to run 4 days a week. 12 jurors & 6 alternates to be selected. 4/15/24: No potential jurors selected.
Jury selection will run from 9.30am to around 4.30pm EST on Monday, Tuesday, Thursday & Friday (Judge has a separate commitment on Wednesdays).
New York Supreme Court Judge Juan Marchan presiding. Manhattan Attorney General Alvin Bragg. Prosecutors are Susan Hoffinger, Joshua Steinglass & Matthew Colangelo. Defense attorneys Todd Blanche, Emil Bove, Susan Necheles & Gedalia Stern.
NEW: Trump is required to attend each day in person — although the judge could grant permission for special absences. Trump has vowed to attend court during the day & travel to campaign events at night— a schedule he also kept up during the defamation trial ahead of the New Hampshire primary, though his current campaign schedule is about one or two events a week.

4/15/24 Monday, Jury Selection Day 1: Judge Juan Merchan will be going thru a list of 42 questions with prospective jurors. Trial expected to take about 6 weeks once the jury is picked. 12 jurors & 6 alternates will be selected. 500 potential jurors are scheduled for voir dire.
*The trial is expected to begin this morning with jury selection & will run from 9.30am to around 4.30pm EST on Monday, Tuesday, Thursday & Friday (Judge Merchan has a separate commitment on Wednesdays).
*Before we get into jury selection proper, Trump does not get off to a good start. Judge Merchan starts with dealing with a couple “loose ends” including Trump’s pending motion that the judge recuse himself. Merchan goes through some of the “offensive” statements from Trump’s motion, saying he has no agenda against Trump. Judge Juan Merchan denied the defense motion to recuse himself from the case.
*Judge Merchan said he was not prepared to rule on a request from Trump’s lawyers that the trial not be held on 5/17/24 so that he can attend his son Barron’s high school graduation. A Trump lawyer also requested the trial not be held on 6/3/24 so that he could attend his own son’s graduation. Merchan said that if the trial proceeds as planned, he would be willing to adjourn for one or both days, adding: 'It really depends on how we’re doing on time & where we are in the trial".
*Manhattan DA prosecutor Josh Steinglass asks Judge Merchan to clarify whether they can use evidence of Trump’s “catch & kill” scheme with National Enquirer to prevent negative stories from coming out before 2016 election – which is what the case is all about. Judge Merchan has previously ruled on what evidence is allowed in & what’s not. And Merchan tells prosecutors he won’t allow them to use evidence Trump was having an affair when Melania was pregnant. Joshua Steinglass wants to introduce about the Trump 2016 campaign’s collusion with AMI, publisher of The National Enquirer.
*Judge Merchan ruled that the Access Hollywood tape itself could not come in, nor should the Carroll deposition tape. Merchan said he wants to avoid a trial within a trial. Judge allows prosecutors to use the transcript.
*Judge Merchan, speaking to Trump, tells him that if he disrupts the proceeding, he could be jailed, with jury selection continuing in his absence. It’s a routine “Parker warning” that Merchan issues to all defendants. Trump was read his Parker Warning. Trump has to be in the courtroom every day for the duration of his criminal trial. "If you do not show up there will be an arrest," Judge Merchan said. "If you disrupt the proceedings, you can be excluded from the courtroom & committed to jail based on your conduct & the trial will continue on in your absence". Trump answered "I do".
*Manhattan DA’s office just asks court to impose a $1k sanction for each of 3 prior posts & a new one from 9:12am this morning, to force him to take them down & to warn him that further violations will result in jail time.
*Judge discusses how jury questioning will go & time limits (30 minutes for round 1 & 20 minutes for round 2).
*Judge Merchan has outlined the next steps for prosecutors’ request to have Trump held in contempt over several social media posts about witnesses in the trial. The judge said he would have a hearing on the issue on Tuesday, 4/23/24 @ 9:30am. Trump’s attorneys have a 19 April deadline to submit a written response. Trump was served with this Order in court.
*96 prospective jurors in the first panel. The first batch of potential jurors has been sworn in by Judge Merchan. Jury selection did not start until about 2.30pm ET. Merchan swore in the first batch of 96 potential panelists. More than half were excused after saying they could not be fair and impartial. The day ended without any jurors being seated.

Jury selection continues on Tuesday, 4/16/24.

For some reason I hope Trump defies this Order:
*Judge Merchan, speaking to Trump, tells him that if he disrupts the proceeding, he could be jailed, with jury selection continuing in his absence. It’s a routine “Parker warning” that Merchan issues to all defendants. Trump was read his Parker Warning. Trump has to be in the courtroom every day for the duration of his criminal trial. "If you do not show up there will be an arrest," Judge Merchan said. "If you disrupt the proceedings, you can be excluded from the courtroom & committed to jail based on your conduct & the trial will continue on in your absence". Trump answered "I do".

and "see" what the Judge does... throw him in jail??
