Wednesday, April 17th:
*Sandoval Hearing (@ 9:30am ET) – NY - *Donald John Trump (76/now 77) was indicted (3/30/23), formally arrested, charged & arraigned (4/4/23) with 34 felony counts of falsifying business records in the 1st degree & conspiracy in connection with hush money payments to two women [Stephanie Clifford aka adult actor Stormy Daniels & former Playboy model Karen McDougal] before the 2016 presidential election. Plead not guilty. Warrant vacated, released on own recognizance. New York County
New York: Submitting false invoices or checks. All 34 counts against Trump are felony charges (class E) instead of misdemeanors.
Trial began on 4/15/24 with jury selection. Trial expected to run 4 days a week. 12 jurors & 6 alternates to be selected.
Jury selection will run from 9.30am to around 4.30pm EST on Monday, Tuesday, Thursday & Friday (Judge has a separate commitment on Wednesdays).

Trump is required to attend each day in person — although the judge could grant permission for special absences. Trump has vowed to attend court during the day & travel to campaign events at night— a schedule he also kept up during the defamation trial ahead of the New Hampshire primary, though his current campaign schedule is about one or two events a week.

4/16/24 Docket update: In the motion filed on Tuesday, prosecutors argue that Trump “wilfully violated this court’s [gag] order by publishing several social media posts attacking two known witnesses – Michael Cohen and Stormy Daniels.” Prosecutor Al Bragg (by Christopher Conroy) filed "People's Memorandum of Law in Support of the Motion for Contempt".

Upon a finding of criminal contempt, the Judiciary Law authorizes a court to impose a fine not exceeding $1,000 or to sentence the contemnor to no more than 30 days' jail "or both, in the discretion of the court." Judiciary Law § 751. Here, this Court should impose the maximum $1,000 fine for each of defendant's three violations of the April 1 order. As this Court has already found, defendant's inflammatory attacks "undoubtedly interfere with the fair administration of justice & constitute[] a direct attack on the Rule of Law itself' (Conroy Aff., Ex. B, at 3). Such grave harm warrants imposition of the maximum fine permitted under the law.
In addition, this Court should again admonish defendant to comply with his obligations under the order. And finally, this Court should warn defendant that future violations of the Court's restrictions on his extrajudicial statements can be punished not only with additional fines, but also with a term of incarceration of up to thirty days. 4/16/24 Tuesday, Jury Selection Day 2: Jury selection continues. Out of the original pool of 96 potential jurors whittled down, more than half had been excused on Monday. Out of that pool 6 jurors were chosen. Judge Merchan swore them in this afternoon & told them to expect to return for the trial's opening statements as soon as Monday morning. After a few hours of questioning he swore in a seventh. Each side gets 10 peremptory strikes. Trump's defense has used 6 of his 10 preemptive challenges. The DA's office has used 4 of its 10 challenges.

Note: Trump’s lawyers told the court before an early afternoon break that Trump no longer wished to exercise his right to be present for all one-on-one sidebar questioning of prospective jurors. Judge Merchan noted Trump had signed a form waiving his right to do so, saying: Mr. Trump, yesterday we discussed whether you wanted to be present at sidebars. You indicated you did. Your attorney indicated to me that you have changed your mind.
*Judge Merchan has outlined the next steps for prosecutors’ request to have Trump held in contempt over several social media posts about witnesses in the trial. The judge said he would have a hearing on the issue on Tuesday, 4/23/24 @ 9:30am. Trump’s attorneys have a 19 April deadline to submit a written response. Trump was served with this Order in court.

You know what gets me--- some of the jurors who were dismissed were asked some questions about what they think about Trump- a good number of them said they like that he "tells it like it is" "he speaks his mind"- I have heard his supporters say that a lot: my answer to that is: little kids tell it like it is- for example they will say " that dress is ugly"- or something similar. I guess he really does compare with toddlers! Besides that, he does not tell it like it is- he lies - all the time.

Whenever someone is described as ‘telling it like it is’ or ‘speaks their mind’ I usually assume they’re just an *advertiser censored**hole with little to no respect for other people.

Juror No. 1 is a middle-aged salesman who immigrated to the United States from Ireland. He lives in West Harlem and said he normally gets his news from the New York Times, Daily Mail, Fox News and MSNBC. In his spare time, he said he enjoys doing "anything outdoorsy."

Juror No. 2 works as an oncology nurse at Memorial Sloan Kettering. She lives with her fiancé and enjoys taking her dog for walks in the park. She said she gets her news from The New York Times, CNN, Google, and Facebook.

Juror 3 is a corporate attorney who moved to New York from Oregon five years ago. He has worked at two major white-shoe law firms in New York. He said he normally gets his news from The New York Times, Wall Street Journal, and Google. In his spare time, he said he enjoys hiking and running.

Juror No. 4 said he finds the former president to be "fascinating and mysterious." Originally from Puerto Rico, he has lived in the Lower East Side for the last 40 years. He is a self-employed IT consultant who attended one year of college and has been "married for a long time." He normally gets his news from the Daily News, The New York Times, Google.

Juror No. 5 was the only potential juror who raised her hand when lawyers asked if they had ever heard of Trump's other criminal cases. A life-long New Yorker, she currently works as an ELA teacher in a charter school and lives in Harlem. She normally gets her news from Google and TikTok but said that she "doesn't really care for the news."

Juror No. 6 is a software engineer who works for the Walt Disney Company, which is the parent company of ABC News. She grew up in New York City and lives in Chelsea with three roommates. She said she gets her news from The New York Times and TikTok. In her spare time, she said she enjoys plays, restaurants, dancing, and watching TV.

I read yesterday that the Sandoval hearing will likely be on Friday morning. I can't find the exact link now ... but there is this link about it.


"We are prepared to do a Sandoval hearing now, later or whenever the court desires," Assistant District Attorney Joshua Steinglass said on Monday.
The judge has not set a date for the hearing but suggested it could be Friday.

Prosecutors made the disclosure ahead of a type of hearing called a Sandoval hearing, which is tentatively scheduled to take place on Friday. The judge announces:Juror #2, the nurse who announced "no one is above the law," expressed concerns about her ability to be fair, after being sworn in on Tuesday.

She's brought into the courtroom:Juror #2: "I definitely have concerns now." [...] "Yesterday alone, I had friends, colleagues and family push things to my phone, questioning my identity as a juror."She is excused.

Merchan: "I’m directing that the press simply apply common sense and refrain from simply writing about anything that involves physical descriptions" about jurors.

 
NOW: the prosecution is handing up to Judge Merchan a NEW order to show cause as to why Trump should not be held in contempt of court for his latest social media posts.

ADA Conroy to Merchan: “Since you signed the last order that we handed up on Monday, the defendant has violated the order seven more times.”ADA Conroy: “It’s ridiculous, it has to stop.”
 
At one point, Merchan admonished Trump after he observed him audibly mouthing something in the direction of one of the jurors, who had been asked about a social media post she made the day Joe Biden was declared the winner of the 2020 election.

“I won’t tolerate that,” Merchan said. “I will not have any jurors intimidated in this courtroom.” Trump’s lawyers ultimately eliminated the woman from the jury pool.
 
After discussion about the gag order, Merchan said he had concerns about one of the jurors and how truthfully they answered questions.

One of the questions on the juror questionnaire asks if the juror or any of their family members were accused of a crime.

Steinglass told Merchan that they discovered an article featuring a person with the same name that was arrested in Westchester in the 1990’s for tearing down political advertisements.

Prosecutor Chris Conroy handed up a new order in response to Trump's social media posts. The DA alleges that Trump has violated the judge's gag order seven more times and they want the posts included in the hearing scheduled for Tuesday.

On Wednesday, the former president complained about the jury selection process and Conroy said "most disturbingly," Trump quoted a Fox News host suggesting that "undercover" liberal activists are lying to get onto the jury.

Conroy said the DA's office is still considering options in terms of sanctions prosecutors are seeking.
