"JOHNSTOWN — Evidence and photographs collected throughout the investigation into the disappearance of Michaela MacVilla continued to be presented to the jury on Friday during the Fulton County Court trial of Daniel Nellis who has been accused of shooting her to death.

What began as a missing person’s case on Sept. 28 quickly turned into a homicide investigation for several investigators involved in the case, including state police Investigator Kevin Noto who worked the lead desk, along with Investigator Donald Klingbeil. Both followed leads, conducted interviews and assigned leads to investigation teams.

Noto testified on Friday that on Sept. 28 he walked from the St. Johnsville Stewart’s Shop where MacVilla was last seen to her residence at 31 W. Main St., to determine how long it would have taken her to walk home from work....

During Noto’s testimony, he said he issued a search warrant for a Fitbit that MacVilla had been wearing with other items of jewelry when she was reported missing, which was found on her wrist when her body was discovered on Oct. 2....

...during the testimony of Erinn Manns, who was at the scene of Kringsbush Road where MacVilla was found, the gold cross necklace and multi-colored bag were not found with MacVilla.

Manns testified that she photographed the area of the powerline road and photographed MacVilla’s body as it was found. Those photographs were presented to the jury. The pictures showed MacVilla on her left side, face down with her legs bent at her knees and pants pulled down to her ankles."

Well - it looks like the State rested yesterday 6/17. And the defense began their case.

"JOHNSTOWN — Daniel Nellis, the man who is on trial in the death of Michaela MacVilla, took the stand on Monday in Fulton County Court testifying that he was not the person who killed her.

While on stand, Nellis’ testimony went through the course of events leading up to the last time he saw MacVilla on Sept. 25, including his connection to Robert Bowe and properties that were owned by Bowe where the guns were found.

Nellis also testified that he is fully disabled due to a muscle disease that he was diagnosed with when he was 13-years-old causing him to have 13 corrective surgeries. He testified that due to his disease, he is unable to run....

When asked by his attorney, Brian Toal, if he killed MacVilla, he said, “No, I would never hurt her.”"

Prosecutor grills suspect in killing of Stewart's clerk

"JOHNSTOWN — Daniel Nellis flatly denied killing Michaela MacVilla during cross-examination at his murder trial on Tuesday.

Fulton County District Attorney Chad Brown repeatedly pushed Nellis to admit he assaulted MacVilla on Sep. 25, 2018, before shooting her in the back of the head with a .38 caliber handgun on a deserted access road.

"You keep making up stories and they're not true," Nellis said at the end of Brown's questioning.

Nellis, 46, of Oppenheim, testified Monday that he and MacVilla, 21, had a consensual relationship....

Nellis finished his testimony Tuesday morning and his attorney Brian Toal called two other witnesses before resting his defense....

Prosecutors are expected to call rebuttal witnesses Tuesday afternoon and the jury should begin deliberations on Wednesday...."

Noto testified that he was able to use the records from the Fitbit that monitored her heart rate to determine her approximate time of death. A chart of her heart rate was shown to the jury during his testimony. The chart showed the heart rate from 11:56 a.m. to 12:49 p.m. Her heart rate peaked at 12:24 p.m. and decreased at 12:32 p.m. where it stayed at a steady rate, indicating MacVilla’s likely time of death.

"...The jury got the case on Wednesday, and Thursday that verdict was handed down.

MacVilla's family spoke with NewsChannel 13 after the verdict was read. Her parents say this isn't justice, it's vindication for their daughter. They've remained silent throughout this whole process. They told reporters it was difficult to see all of the coverage and social media posts while the investigation was going on.

They say they put their trust into the justice system, and they're happy they did....

Nellis faces 15 years to life in jail when he's sentenced on August 22."
