Judge to rule Oct. 2 on moving Drew Peterson case

Peterson attorney Reem Odeh said much of the intense publicity surrounding the case has been negative and inflammatory, making it impossible for Peterson to get a fair trial in Will County. She said there also was a chance Peterson arrested or ticketed potential jurors or their family members during his three decades as a police officer.

Prosecutors said there is no reason to move the case, especially since Peterson and his attorneys courted much of the publicity on television and radio shows. But Will County State's Attorney James Glasgow says he'd agree to a venue change if it became clear during jury selection that a fair trial was impossible.

Kathleen Savio's sister disagrees.

"I think he just loves that media attention... but this is not a laughing matter. This is very serious, it affects our family, and it's for the mother of the two boys. This is Kathleen," said Sue Doman, Savio's sister.

Doman says she's confident that Peterson will be convicted of her sister no matter where the trial is heard. She says she'll be there to represent her sister's interests no matter how far she has to travel.

She also says she wants Peterson to spend the rest of his life in prison. She believes that would be a worse punishment than being sentenced to death.

JOLIET, Ill. - A Will County judge says he'll decide Oct. 2 if Drew Peterson's murder trial should be moved because of pretrial publicity.

Judge Stephen White listened Friday to arguments from both sides. Peterson has pleaded not guilty to first-degree murder in the death of his third wife, Kathleen Savio.

Will County Judge Stephen White heard arguments from both sides Friday. At the end of a brief afternoon hearing, he decided to take the matter under advisement.

Although he was willing to announce his decision early next week, Peterson's lawyers instead asked for the October court date.

White will rule on the change-of-venue request Oct. 2 but, in the meantime, he brought in the large pool of potential panelists early to try to limit further media exposure. Potential jurors also filled out a lengthy questionnaire that included the names of 493 potential witnesses to ensure all are unknown to them.

Lawyers won't start questioning members of the pool, though, until the trial starts. A date hasn't been set, but the defense team said it may begin later this year. They said Peterson, who has been held since May 7 in the Will County jail on a $20 million bond, is eager to try to win his freedom.

I confess that I have very little knowledge of Illinois. Those stations seem to be giving updates so maybe the media might be leaning that way.:waitasec:

Frankly, by Oct 2nd, I'll bet the place for trial will be chosen and discarded several times (at least mentally) by the court. LOL! Mr Peterson's personality seems to be far reaching, so the trial may have to go international or maybe even farther than that. :beamup:

Prosecutors in Illinois potentially get two whacks at him.


A lengthy grand jury investigation into the deaths of both Mrs. Petersons resulted in only one murder indictment, for the death of wife number three, Kathleen Savio.


Savio's death was initially ruled an accident, but after the exhumation of her remains in 2007, two new autopsies--one by renowned forensic pathologist Dr. Michael Baden--reclassified her death as a homicide.


"I don't think there's any possibility this was an accident, and I don't think there's any indication this was suicide," Dr. Baden told Fox News's Greta Van Susteren. "It's my opinion, to a reasonable degree of medical certainty, that it's a homicide."

Prosecutors could go after Drew Peterson again for the disappearance and presumed death of Stacy Peterson. Depending on what happens at his upcoming trial, Peterson may find himself in the dock facing a second murder charge.

To help get a handle on about 40,000 pages of discovery documents in the Drew Peterson murder trial, the former Bolingbrook police sergeant's attorneys have brought on a team of recent law-school graduates and third-year law students.

A court order allowing daily face-to-face visits with Peterson's legal team was recently expanded to include Michael Raff, Anthony Nehme and Kendall Hartsfield. Joel Brodsky, one of Peterson's attorneys, said third-year student Melissa Anderson also is assisting.

"It's the crème de la crème," said Brodsky, declining to say whether they are getting paid.

Now that the judge has denied moving the trial out of Will County, has there been a date set for trial? For some reason, I seem to remember early next year being mentioned some time ago.
