The devastated family of Levi Davis are facing more frustrating delays in finding out what has happened to the X Factor star as red tape holds up Spanish cops' search for the missing Brit.

Spanish officials said there will be no port or sea searches for Levi, 24, in the near future because a judge investigating his disappearance is still waiting for a report from coastguards.

It comes after his mother Julie Davis revealed police told her they now believe a man spotted in difficulties in the sea by crew on a cruise liner docking in Barcelona was likely to be her son who vanished in October.

Julie criticised the delay in her receiving information about the cruise ship sighting and branded Spanish police as 'slow'.

Today she was facing more frustration after it was confirmed there is still no news on when and whether an exhaustive search for her missing son will take place to see if a body or other evidence pointing to his whereabouts can be found.

A Spanish judge would have to authorise the search of the waters and other areas around Barcelona port.

Overnight sources at the High Court of Justice of Catalonia confirmed: 'The investigating judge is waiting for a coastguard report informing on everything that's been done.

'There's no request by the judge for any type of search at present. Once this report is received, the following steps will be considered.'

Another well-placed source, explaining the investigating judge's role in the case, added: 'When cases have been judicialized as this one has, the judge decides on things as and when they're requested.

'Once the judge receives the report and sees what work the local coastguards have done, he'll be able to decide whether he can approve new procedures or not.'

Police in Spain are searching the waters of Barcelona's port - near to where a British rugby player went missing.

Levi Davis, a former Bath player, was seen leaving a pub in the city on 29 October.

The 25-year-old - who was once a contestant on Celebrity X Factor - has not been seen since and last month fears were raised that he may have drowned.

His family said that an investigation by police had suggested that his phone had last been detected at the far end of Barcelona's commercial port.

Catalonia's police force, Mossos, released footage on Thursday showing officers in a boat searching the area.

 
They're searching in the water? It's not like it's a pond, that's the Balearic Sea. It's literal sea water that moves around. He has been missing since October. Unless he somehow got stuck under the Port structures it's going to be almost impossible to find him there.
 
The strange case of the British rugby player who disappeared without a trace

He was a rising rugby talent and Celebrity X Factor star. Then last year, during a holiday to Spain, he disappeared and was never seen again

At 10.05pm on the night of 29 October last year, a CCTV camera in The Old Irish Pub on Barcelona’s La Rambla caught a fleeting glimpse of a figure walking out of the pub at a measured clip and on to the crowded pavement of the city’s nightlife thoroughfare.

Dressed in a white T-shirt, black trousers and trainers, and carrying a small black rucksack, Levi Davis, then 24, a professional rugby player and sometime reality TV contestant, had arrived in the city that day, having taken the ferry from Ibiza. He had spent the evening at the Irish pub, watching a football match on television and drinking a pint of Heineken lager.

Stopping outside, Davis was seen tapping into his phone before striding off. Some 10 minutes later he was glimpsed outside the Hard Rock Cafe, at the other end of La Rambla.

And then he vanished.

In a statement to The Telegraph, West Midlands Police said they were ‘not carrying out any criminal investigations in relation to the disappearance of Levi Davis. We remain in touch with the Spanish authorities and Levi’s family’ – but they added that files concerning Davis had been passed to The Met.

In statement to The Telegraph, the Met said: ‘On 19 January 2022 the Met Police received a report from a third party of an alleged rape of a man in his 20s. It was reported the rape happened in Ealing on an unknown date. An investigation was carried out and detectives spoke to the victim. The investigation could not be progressed further and was closed on 29 January 2022.’

Was Davis being blackmailed – as he would later claim? He often had money problems, and according to his mother, before leaving Ealing he had asked to borrow £1,600 ‘to pay the rent. I couldn’t understand what was going on.’ Could it have been for drugs? ‘If it was,’ she says, ‘Levi kept it very quiet’.

It was only later that Davis told her that following the rape he had developed a drug problem. He sought professional help and was prescribed antidepressants. But Julie says he had trouble keeping his medical appointments.

In November 2022, Davis was reported missing after his former rugby club issued an appeal for information on his whereabouts, with him last being seen at a pub in Barcelona, Spain on 29 October.[10] His passport was located at a Barcelona port in November 2022.[11] He is suspected to have drowned in the sea near the city's commercial port, as a person matching his description was found drowning around the time of his disappearance. The attempt to rescue the person failed and the body was not recovered.[12]
