trial day 38: the defense continues its case in chief #110

Greetings all. I don't get to visit here too much but I sure appreciate all the information and opinions from the expert WS'ers.

I'm wondering two things.

How long as the legal process been in effect in Arizona that allows jurors to ask questions of the witnesses? It seems like a great idea in theory, but many of the questions seems to repeat what the attorneys have asked, or seem to be a way for some jurors to get it little digs to the witness (i.e., the "what is a *advertiser censored*" and "PTSD/bad haircut" questions).

Is it too late for Jodi to cop a plea for 1st degree, if the State takes the DP off the table? Do you think JM would accept that if it were offered?

Awww man, I just realized my comment above was worded badly. When I referred to "expert WS'ers" I meant all the great posters here (and I'm very grateful for the replies I've already received from the attorney experts).

If JA can sleep in a car comfortably she can sleep in a holding cell before trial! But she wouldn't want to ruin her side ponytail, of course..

Sent from my HTCEVOV4G using Tapatalk 2

There ya go ... That would work.
She can nap in her courthouse holding cell until trial time begins.
She'd get few more hours of sleep that way ... Bet that's what many prisoners do.

Also ... It's HER defense team that has stalled with years of trial delays.
Now that JA finally has to face the music ... every fudging day in court HER lawyers d-r-a-g out their questioning of every witness.
Wilmott & Nurmi always ask every witness or expert the same questions over & over again.
They re-phrase same questions, may we approach every other question,
"ummm" and "errrr" proceeding every question they ask a witness.
When they do approach the judges bench - Willmott stands there and reads over her copy of whatever piece of evidence that she's arguing against - as if it's the first tine she's ever seen this "mystery document". Pffft!!
The defense team has had that evidence for years.

Juan comes to court prepared ... Every day!

NO.. I believe DT tried to plea & my understanding is JM said No Can Do Buck-A-Roo!

I didn't mean a plea. There are a lot of lawyers that think the jury will be given instructions on manslaughter, possibly 2nd degree, etc. If they find her guilty of one of them... then the sentence goes to the judge. If they find her guilty of 1st degree murder than they enter a penalty phase to determine life or death.

I don't think anyone would cut her a break just because they don't want to go through a penalty phase... BUT I've heard it mentioned when talking about jury fatigue and was wondering if anyone else has thought about it.

Agree! It wasn't very smart, either. If JA was so afraid of Travis, why would she allow him to tie her up? And then there's the problem with the sleigh bed, lol.....

That plus Big Gus said that her hands and FEET were both tied up on that sleigh bed

The testimony of an admitted liar, without corroboration, IS admissible evidence in court. Judge Stephens had absolutely no authority to prevent Jodi Arias from getting on that stand and lying her heart out. If she had done so, the court of appeals would have smacked her down immediately and the taxpayers would have wasted even more time and money.

Judges ARE NOT ALLOWED TO EXCLUDE EVIDENCE just because they want to. There has to be some legal basis for doing that.

Judges are SUPPOSED to leave it up to the jurors to detangle the good evidence from the bad evidence. That is not the job of the judge. That is the job of the jurors.
Thanks for all the free expert advice you have given us. I appreciate your comments very much as they help me to understand the state of the law in this crazy state.
:tyou:

Was that same apt where gal was missing? Vanessa something? Found blood in apt but not her?

Or is this a whole new murder?

Btw.. We sure are turning into a lil LA huh? (No Offense CA folks)

Just happened today. Not an apartment, single family home. Nice "family" community with like ZERO violent crime -- until now anyway

Thank you, commspecialist! I guess I didn't listen so close to what Dr. Samuel's said, did I? :blushing:

No problem! and It's okay, I didn't really either, but somehow I caught that part, haha. as for me, I completely zoned out after about half an hour of the latest witness :blushing:

so jodi is claiming she doesn't like getting up early for court?

well you know what the simple answer to that is? DONT FREAKING MURDER ANYONE!

she is there by her own doing,no one to blame but herself.

as for the food, she gets 2600 calories per day, which is more than the RDA for a woman, but i'm sure she chooses not to eat.

yes its not great having to eat the same stuff for 5 years but again she put herself there and its more than some people get at all! she is able to purchase items from the jail shop to snack on so i don't see a problem here.

yes she hasn't been convicted yet blah blah she ADMITTED killing travis so shes getting what she deserves in my book

And Nurmi is trying to get them to ADD 500 cal to that?
JA needs 3100 cal a day?

riiiiiiiiiiight

They can give her lobster and garlic bread....if she wont eat it- she wont eat it.

IDK maybe I'm bias cuz I live here but I like to feel Arizonians are kinda the last of the Wild Wild West (we carry guns on our hips here) so I'd like to think this jury invested all this time they'd say... Oh we can wait another week to give her DP than 25 with parole LOL!:twocents:

Hi beeshie....regarding your question "Why did Jodi drag Travis into the shower? It would have been easier to put him in the tub and she still could have washed off any DNA/trace evidence. "

I think it would have been too difficult to put him in the tub because she would have to have lifted him up and over the side and that's higher than the shower...

Thank you! Somedays I swear I'm in that Groundhog Day movie....we've bent over this sooooooo much.....

ETA: no....nevermind....I'm gonna leave that typo. Its funny. :)

:floorlaugh::floorlaugh::floorlaugh:

So is JA supposed to receive SPECIAL TREATMENT from the jail and court ??
(I certainly do not mean to jump on you about this ... I'm just sitting here with my jaw dropped because JA and/or her family thinks she should be treated any differently than any other prisoner housed at the jail and being transported to court daily)

I think not.
Maricopa County has been housing, feeding, transporting their inmates to court for years & years.
The courthouse runs the same basic way ... day and day out.

Thousands & thousands of inmates are handled and processed thru their system - from jail to court and back to jail at the end of the day.

I'm sure none of the prisoners like getting up early, or enjoy the food the are served.
This ain't the Ritz Carlton.

So true, just wondering how far the jail is that she is housed in to the courthouse. I just can't believe this today. Here they are in a hearing about the cost that the state is paying for this trial and then this happens. After all the court staff, juror's, family and witness are at the courthouse.:banghead::moo:

Is there any medical proof that JA has migraines, or is that just something she's lied about..........um claimed?

NO.. I believe DT tried to plea & my understanding is JM said No Can Do Buck-A-Roo!

IIRC, the offer was 2nd degree with max pokey time set at 20 years w/ time served.

JM's response:

They're not rope, it's braided trim from the decorative pillow on the chair beside Travis' bed, referred to by JM as tassels; a tassel is visible in at least one of the above photos. I believe they also found a small piece on the stairs. They appear no more than 4" long.

StephanieHartPI: WOW, what gorgeous doggie photos!! You are an excellent photographer with a great artistic eye. :star2:

Thanks to the person who posted the latest shower photo montage. To those who didn't believe Travis was aware he was being photographed until he looked over to the camera almost 3 minutes into the 8-minute shower, that montage clearly shows him looking toward the camera earlier than that, at 5:24:45. The picture is dark so most haven't studied it closely, but here's a link:

Not to mention the first two photos were shot with flash, which would have bounced off the glass shower door if it had been closed. That would be my third question to JA, how did she coax him into the shower. :what:

Ok.. Here's :twocents: on the "rope talk"...

I've always thought "the rope" was an excuse to put the knife upstairs as an 'available weapon' I also *think* JA has used info/pic of "the rope pieces" for the whole S&M'esq sex, knife placement etc..

However.. I *believe* these "pieces of rope" may actually be 'fancy' trim on a throw pillow from either downstairs or maybe the arm chair from bedroom... the THROW PILLOW SHE USED TO SILENCE THE GUNSHOT..

IDK the houses are kind of close in TAs neighborhood from pics I've seen and at 5:30 to 5:45pm I would think people would be coming home from work/store out & about a bit that a gun shot may been heard thus need to try to muffle it???

Ok that's my theory on "the rope" again jmo

Agree with you re throw pillow usage
