A Houston man fatally shot a 9-year-old girl shortly after he was robbed at an ATM on Monday night, according to police.

Tony Earls, 41, took aim at a pickup truck that he thought the robber was driving, police said. But the truck was actually carrying a family of five, and his shots killed Arlene Alvarez, the Houston Chronicle reported.

HOUSTON — Houston police have released surveillance video of the robbery suspect wanted for the chain of events that led to the death of 9-year-old Arlene Alvarez.

The surveillance video shows the alleged suspect climbing over a fence. You can't get a good look at his face but police said he was described as having a thick build with full eyelashes.

This suspect allegedly robbed 41-year-old Tony Earls Monday while he and his wife were at a drive-thru ATM at a Chase Bank in the 2900 block of Woodridge Drive.

Houston Police have released surveillance footage.
 
KPRC 2′s T.J. Parker said that the District Attorney’s Office didn’t go into too much detail other than saying that they’ve found new evidence and that a special prosecutor has been appointed to the case.

According to police, the alleged gunman, Tony Earls, was with his wife at the ATM on Woodridge when a man came up to them and robbed Earls and his wife. When that man took off, Earls reportedly started shooting at him and also shooting at a truck he thought he had gotten into.

However, it was not the correct vehicle.

Instead, five members of the Alvarez family were in it including 9-year-old Arlene who was in the backseat.

She was shot and later died.
 
Arlene, who was in fourth grade, took care of her younger siblings – who were also in the vehicle at the time of the shooting, her parents’ attorney said – and “got along with everyone.”

Earls previously said he began shooting because he heard gunshots when the robber started to run away, and believed he was being shot at, according to prosecutors. He allegedly was unaware someone had been hit by his gunfire and he left the scene to call police and report the robbery, according to KHOU.

He was arrested and charged but was released after the grand jury declined to indict him.

Special prosecutor Warren Diepraam, who took on the case, said an FBI firearms expert was brought in to examine the evidence.

“The expert’s opinion is that Mr. Earls saw the robber run past the vehicle with Arlene Alvarez inside — the vehicle did not do anything to give Mr. Earls a justification to shoot into the passing vehicle,” Diepraam said in a Wednesday statement.
