MISTRIAL TX - Nine dead, 20 injured in shootout at Waco bikers' meeting, 17 May 2015

WACO, Texas (KWTX)A Nevada lawyer has posted a series of videos on YouTube that show the deadly May 17, 2015 shootout at Waco’s Twin Peaks restaurant.

________ ________, a tax attorney in Henderson, Nev., says he does not represent any of the bikers charged in the shootout.

He told KWTX Tuesday he posted the videos, which he said were obtained from a variety of media sources he refused to identify, in hopes that the truth about the shootout will be reported.

In the year since the shootout, attorneys for bikers have demanded examining hearings to challenge probable cause, filed motions alleging their rights to speedy trials have been violated, challenged a gag order entered into the case involving one Hewitt biker only, appealed bond amounts, negotiated lower bonds, and have filed at least one aborted claim to move one biker’s case from McLennan County.

Police and prosecutors have declined public comment since
the gag order was issued, but attorneys for bikers have railed against law enforcement and prosecutorsin McLennan Countyand the criminal justice system overall.

While indictments are pending, prosecutors have said in hearings that they will not be ready to go to trial for possibly many months down the road because state and federal agencies still are reviewing DNA, cellphone evidence, ballistics and other forensic evidence gathered at the massive crime scene.

is set to file a motion Tuesday seeking to disqualify Reyna and his office from prosecuting the cases, saying his role the day of the shootout potentially could make him a witness in the case.

Two attorneys defending bikers charged in last year’s shooting outside a Waco restaurant that left nine dead say the local district attorney should be removed from the case.

(...) the attorneys allege McLennan County District Attorney Abel Reyna has a financial incentive to pursue cases against the bikers. They argue Reyna is pressing a flawed prosecution because he’s personally named in a civil lawsuit filed by the bikers.

Mistrial declared in 1st Twin Peaks shootout trial

A mistrial was declared Friday in the trial of Jacob Carrizal, the first biker from the May 2015 Twin Peaks shootout to stand trial.

Jurors told 54th State District Judge Matt Johnson they were hopelessly deadlocked after more than 14 hours of deliberation, forcing the judge to declare a mistrial at about 2:50 p.m.

While the jury was whisked away by court officials and not made available to the media, a courthouse source who spoke to the jury after the mistrial was declared said there were never more than six jurors in favor of finding Carrizal guilty on any of the three counts.

A second biker, Dallas trucker George "Scooter" Bergman, is set for trial; rejecting a plea deal. Bergman and more than 150 other bikers were indicted on charges of engaging in organized criminal activity resulting in deaths and injuries. Nine bikers were killed and 20 injured in the shooting.

Bergman told the AP he was offered one year probation for pleading guilty to organized criminal activity and aggravated assault and that murder charges would be dropped before his January 22 trial.

Attorney who represented biker in 1st Twin Peaks trial to withdraw

Fiery Houston defense attorney Casie Gotro, who represented Dallas Bandidos president Jake Carrizal in the first Twin Peaks trial is expected to file a motion to withdraw from the case.

Gotro represented Carrizal during the five-week trial in November.

State District Court Judge Matt Johnson declared a mistrial after the jury failed to reach verdicts on three counts against Carrizal.

“It’s my understanding Gotro is going to file a motion to withdraw from Carrizal's second trial scheduled for April,” McLennan County District Attorney Abel Reyna told KWTX on Tuesday.

A hearing on the anticipated motion has been set for 1 p.m. Thursday.

A week after Twin Peaks defendant George Bergman rejected a plea offer for misdemeanor deferred probation and demanded his day in court, his attorney and the McLennan County District Attorney’s Office agreed to postpone the trial.

In a joint motion filed late Thursday afternoon, prosecutor Michael Jarrett and Dallas attorney Clint Broden asked 54th State District Judge Matt Johnson to postpone Bergman’s trial at least 180 days. The judge granted the motion.

The motion states only that the postponement is not sought for purposes of delay but so that “justice is done.”

Jury selection in Bergman’s case had been set for Jan. 23. His trial has now been postponed until July 23.

Carrizal has a new attorney, and the judge said if he is not ready to try the case on Sept. 10, Wesley McAlister will take that trial slot. A jury panel has been summoned to report to court Aug. 24 to fill out questionnaires in the case.

Johnson also set trial dates for early November for Jacob Reese and Timothy Shayne Satterwhite.

Dallas attorney Clint Broden, who represents Richard Luther, asked the court to set a trial date, but said he will file a motion to recuse Reyna that would require a hearing because he thinks Reyna is a material witness in the case.

The judge agreed to set Luther’s trial date after the first of the year, when Reyna will be out of office and the potential conflict will be resolved.

This is very surprising.
I wonder why the former DA dropped the ball on these charges?
And how can the statute of limitations run out on a murder case?
 
They werent charged with murder. They were charged with engaging in organized criminal activity resulting in the death of nine.

From the get go, the news media spun this in a false direction. Then it pretty much disappeared unless u went looking for info on it. So much wasn't ever told or ever told right. What happened tht day and for the yrs to follow, is not suppose to happen. Not here in America.

There is good reason those charges got dropped on all bikers. There is a reason tht almost every single one of the bikers have filed civil suits on the police and waco.
 
No trials in Texas biker fight until new prosecutor starts

The decision to postpone the Nov. 5 trial of Timothy Shayne Satterwhite on riot and weapons charges means the year will end without anyone standing trial over the deadliest biker shooting in U.S. history.

Its amazing he was ever charged with the original charge.. or with the lesser riot and weapons charges. He didn't fight anyone, had no gun, tried calling for help with his phone. Then did cpr on his Sargeant at arms until the police forced him to stop. It's all clear on video.
