This might be very bad for Zach-------his girlfriend may have just proved he was lying that day when he told TBI his alibi, and claimed he had never been to his home that day

In regards to Ms. Earl's testimony:
These situations are so difficult, I imagine, for the jury. On one hand, this woman has cleaned herself up and is working two jobs to support her family. On the other hand ,she's a former addict who may or may not remember things correctly. Even given this, I feel her testimony is the best circumstantial evidence thus far,

Before the trial is over with every juror there is going to realize many people were deathly afraid of ZA and his buds. I find her credible and I wish her further statement had come in but I understand the Judge's ruling.

Every time I think of a drug addict testifying for the state I will always think of the Mel Ignato murder case. His mistress who had a drug problem testified that she was there when he raped, tortured, and murdered another girlfriend, and she said he even had her video tape the entire thing.

None of the jury believed her even though she told the 100% truth about it all and the jury found the murdering ... NG. Years later after he sold his large home a carpet contractor was laying new carpet and had to take the floor vents up and there he found the video of the entire thing from beginning to end.

It shows even though someone may have a drug addiction problem it never means they are lying in court about something so serious as a murder.

Its a wonder he didn't have her killed too to keep her silent. ZA is evil to the core and only cares about himself and himself only.

Defense lady coming at witness hard for 'remaining friends' with Zach after they broke up.

Defense screaming at her and being super snarky--not sure it is effective. This is a sweet, sincere girl and the defense lady is being condesending and rude.

There's a time to be aggressive on cross, and a time not to be aggressive on cross. It can work for you or against you.

This girl is holding her own against the defense lady.

I totally agree. My father was a great defense attorney. He was rarely rude, just aggressive with facts and details. He stayed 'likable' because he felt the jury had to be on his side as much as possible.

Judge asked the attorneys to "focus" and "try to avoid redundancy."

I have not been impressed with his spacey ........jumping here to there and at times very unorganized, defense attorney. She had years to prepare for the biggest trial of her life and at times seems unprepared bringing out things that actually hurts her client and helps the state.

Is she a high priced lawyer if you know? If she is do you know which big cases she has been on where the defendant was found NG? tia Katy.

I think before its over with she is going to open the barn door again and the Judge may not rule in her favor the next time.

IMO

Katydid23, that's so true. I am a litigator but not in criminal law, and I can't tell you how many times I got better information from witnesses, things they probably didn't mean to admit, just by being respectful and calm. Being aggressive really only works with someone who is being aggressive and very evasive, and that's not most witnesses.

*I learned the hard way once as a baby lawyer when I tried to impeach the credibility of an 80-year old lady because she had one bounced check charge!

NC5 stream keeps freezing up on me. I give up. What is another alternative?

TIA

A special thanks to Emi, Niner and epiphany for updates, tweets and summaries.

Judge asked the attorneys to "focus" and "try to avoid redundancy."

What was that outburst at the very end---about her not being charged? My phone rang and I could barely hear what the court was angry about because I was listening to someone on the phone.

There's a time to be aggressive on cross, and a time not to be aggressive on cross. It can work for you or against you.

I have been a juror on several cases and I have never really cared for a lawyer that came across rude and aggressive when it was unnecessary. It is even worse if the witness/es come across as sympathetic and are just trying to answer the questions asked.

I have seen some great defense attorneys and they got more on the record from the witnesses that they wanted in by being respectful and low key than acting like an aggressive bully.

She needs to save all of her energy for when JA testifies. Then she can be as aggressive as she wants to be. :D

I didn't follow this case closely when Holly was missing. I remember hearing some remains had been found, but not really any details. So it's interesting to me to see how much comes out in the court that the jury is hearing, and knowing I only know what the jury is hearing as well.

I don't know anything about the defendant. Only what I'm hearing in court.

I know in the Casey Anthony trial, I had followed that case closely, knew lots of stuff that wasn't in the trial. I think that's why it was so upsetting when she was acquitted, because stuff 'we' had heard wasn't in the trial, and thus the jury didn't know the same as we did. I remember telling a friend that the state hadn't proved the case....jury agreed.

I hope and pray that if this guy is guilty, the evidence supports it and the jury can see and hear that.

Thus far, only the ground work is being laid. Later I'm sure some of this will make sense to me. At this point, I'm hearing evidence, but not sure the significance of any of it yet. Time will tell if the state can connect the dots.
