Judge: Sievers girls to stay with father, DCF petition denied

Schreiber underscored that when she denied the request: "The possibility that the father would abscond, that he would place the children in harm's way, (that) he would intentionally harm the children as he is alleged to have harmed their mother, is just that – it's a possibility. The grounds to remove children from parents is more probable than not, probably this happened. I can't speculate about what's going to happen in the future. There is a reason why it's a probable cause standard and not 'I think this happened, we think this might happen, we're suspicious this might happen, we have concerns that this may happen, there's a possibility this may happen' – that's not the standard for removing children, so I deny the shelter petition."

Claim by Curtis Wayne Wright, accused in Teresa Sievers killing, that he killed roommate likely untrue
Dec. 08, 2015
http://www.naplesnews.com/news/loca...untrue-that-he-killed-former-2-361075051.html

Documents released last week in the Sievers case included three paragraphs summarizing a statement Curtis Wayne Wright Jr. made to his brother-in-law, Robert Wideman, in late May about strangling a former roommate. Wideman told detectives that Wright said he killed a former female roommate in retaliation for ratting him out during a 2010 arrest for manufacturing methamphetamine at his Missouri home.
...
Reached by phone Tuesday, Wideman declined to comment.
...
Maj. Jason Schott of the Sainte Genevieve County Sheriff's Office said the agency has no unidentified bodies or missing persons who fit the general description provided by Wright. Wright also is not being investigated in any of the area's unsolved homicides.

"We do not have any open case or any case at all that I can find that he is a suspect in," Schott said.

NBC2 is in possession of newly-released documents about the investigation of the murder of Bonita Springs doctor Teresa Sievers.

NBC2 is in possession of two boxes of newly-released documents from the state attorney's office -- some 3,302 pages -- about the investigation of the murder.

The documents indicate Rodgers' girlfriend -- Taylor Shomaker -- told detectives that she believed Rodgers owed Wright a favor, which is why he accompanied him to Florida to help in the late June murder.

Investigators took DNA off two dogs and a cat in the Sievers home, hoping to match it with DNA from hairs found in a rental car they believe was the one in which Wright and Rodgers made the trip.

-Taylor Shomaker, the girlfriend of Jimmy Rodgers, told detectives that Rodgers first met Mark Sievers at the Wrights’ wedding in May. She said her boyfriend didn’t like Sievers because they had an argument over a parking spot before the ceremony.

“Mark’s a d---,” Shomaker remarked. “Excuse my language.”
...
-When asked if she had ever had sex with Mark Sievers, Wright's wife Angela Wright said "not that I know of."

She described how she got "pretty drunk the night before my wedding and don’t remember bits and pieces of it. ... But seriously, Mark and my husband looked an awful lot alike, too.”

Angela Wright, Wayne Wright's bride, knew Mark Sievers growing up. He was the best man at their wedding. Mark Sievers dated Angela Wright’s mother, who is nearly 12 years his senior, and her aunt when he lived in Missouri.

She never dated Sievers but categorized him as a flirt.

Jerry Lubinski, a friend of Wright's who met Mark Sievers at the wedding, called him charismatic. "He was the life of the party."

He and Wright looked alike, he said. "He could pass … actually could pass as his brother," Lubinski said of Sievers.

Investigators spent a good deal of their interview with Lubinksi and his live-in girlfriend, SH, nailing down when they saw Wayne Wright and his wife and when Wright called him.

Additionally, seven cell phones were taken from Wright's trailer, along with two other broken phones, computers, hard drives and computer storage units. Also removed were two hammers. In other documents, a hammer has been suggested as the murder weapon.

In recorded interviews with detectives, Shomaker said Rodgers met Teresa Sievers' husband, Mark, at Wright's wedding, and that Rodgers and Sievers fought that night over a parking spot.

She went on to claim that Wright hired Rodgers to help with the murder, something she said Mark Sievers did not know. The Lee County Sheriff's Office, in documents released weeks ago, suggested that Mark Sievers had planned the murder along with Wright.

Mark Sievers, however, has not been arrested.

FORT MYERS, Fla. – Investigators believe memes from the Facebook account of one of the men accused of killing a Bonita Springs doctor are telling:

“One free murder: This voucher entitles you to commit murder without legal, social or financial consequence.”
“Never rat on your friends and always keep your mouth shut.”
“Two things every American should know how to use, neither of which are taught in schools.” The meme shows pictures of a handgun and a bible.
“They aren’t bullets, they are freedom seeds.” The meme shows a picture of a bullet.
“I came into this world kicking and screaming while covered in someone else’s blood. I have no problem with going out the same way.”

Investigators say inside Wright’s home and in his storage unit, they found a metal claw hammer, lots of electronics, and driver’s licenses with other people’s names on them.

LEE COUNTY, Fla.- Curtis Wayne Wright, one of the men accused of brutally murdering Bonita Springs Dr. Teresa Sievers, appeared in a Lee County courtroom Wednesday afternoon.

During the appearance, Wright stood beside his attorney but stayed silent as he waived his right to a speedy trial.

Wright's family members were also in the courtroom but neither they or his attorney wanted to comment.

Wright's sister hides her face in the video.
From the video, March 8th is CWW's next court date.

Assistant State Attorney Hamid Hunter said more than 29,870 pages of investigative documents have been provided to the defense so far during the evidence-sharing process known as discovery. Parker said Wednesday that she was still obtaining and reading through the documents.
....
Wright’s sister and mother sat through the court appearance but did not speak to reporters as they exited the courthouse. The two were scheduled to visit Wright in jail after court, according to the Lee County Sheriff’s Office.

Wright’s next case management conference is scheduled for March 9.

Standing stone-faced and shackled, Wright, through attorney Elizabeth Parker, agreed to waive his right to a speedy trial during the five-minute hearing -- a decision that provides more time to review more than 29,000 pages of investigation-related information.

Parker said she expected to interview at least 50 witnesses.

And both the prosecution and defense told Judge Bruce Kyle they needed more time to complete depositions.

"We're still in the process of obtaining discovery from the state," Parker said.

There are more than 2,300 pages in the new batch of records. Newly released crime photos show items of clothing and jewelry Sievers was wearing when she was killed, including her wedding ring, which appears to be covered in blood.

Several photos also were taken of Dr. Mark Petrites, a friend who found Sievers' body, and his Cadillac.

A set of photos taken July 6, the day of Sievers' funeral, depict items from her medical office thrown away in a Dumpster outside. Someone reported to investigators that the doctor's husband, Mark Sievers, was spotted throwing away the computers on the day of the funeral, according to earlier released records.

New materials provide timeline of Sievers' final days

Among the photographs released are shots of five receipts that provide a timeline of her travel back to Southwest Florida in late June, when she arrived ahead of her husband, Mark, and their two daughters.
- Sievers crime scene photos
A parking receipt indicates Teresa Sievers was at Southwest Florida International Airport just before 7 a.m. on June 26 before she bought a coffee and some water and headed north. Another receipt from LaGuardia Airport in New York shows she bought water before boarding an early evening flight back to Fort Myers on June 28.
Surveillance photos show her walking through the airport wearing a dress later photographed covered in blood. She paid $48 for parking at 10:55 p.m. and headed back to the home where her body was found.
The latest release of investigation-related material also includes, for the first time, images of a bloody hammer recovered from the crime scene. The family's garage door and a door entering the home were damaged in what detectives believe was an effort to stage the scene as a break-in.

Sheriff Mike Scott BBM:

“You’re talking about the burglary, the pried door and that the scene was staged,” Scott said while attending a crime task force meeting with Fort Myers city officials on Friday. “I would be careful in just assuming that the hammer was this, or this is this, or this is that. The case is far more complicated than folks realize and I think some walk a slippery slope trying to solve it before it’s all out.”

Despite thousands of pages outlining the evidence against Rodgers and Wright and investigators’ suspicions of Mark Sievers’ involvement, Scott said the case is far from over.
“What I would say is you see continued focus, tenacity, forward progress,” he said of the documents. “There’s a lot going on that we can’t talk about, a lot. They’ll continue to release documents and the picture will continue to become a little more clear.”

Rumors, doubt swirl around Sievers case
February 8, 2016

http://www.winknews.com/2016/02/08/rumors-doubt-swirl-around-sievers-case/
Jerry Lubinski doesn’t believe his close friend, Wayne Wright, killed Dr. Teresa Sievers – despite evidence to the contrary.

Evidence that includes Lubinski telling investigators information that placed Wright in Florida when Sievers was killed.

But Lubinski said what he told detectives, and what was documented in his official witness statement, are two different things.

“They were putting down what they wanted to put down,” he said from his St. Louis home. “That’s the best way I can say it. As a friend, I’d go to bat for him right now. I still believe somewhere in there, there are a lot of things that are wrong.”

Lubinski said the Lee County Sheriff’s Office investigators were nice until they started asking about a GPS system Wright and Rodgers allegedly used.

The GPS, which was in a vehicle Rodgers rented, showed routes from Wright’s residence to Rodgers’ home, then to the Sievers residence. The route placed the pair at the Jarvis Road home hours before she was killed, investigators said.

“They definitely wanted me to say it was mine, and I couldn’t say that,” he said.

Wright’s mother-in-law, Kathy Moran, isn’t so sure about Wright’s innocence.

In a sworn statement, Wright’s wife, Angela, told investigators he said that he was going to Florida the weekend Teresa Sievers was killed.

Wright’s first lawyer, Darris Almond of Hillsboro, Mo., said there are signed witness statements that put Wright in Missouri the weekend Teresa Sievers was killed. He declined to show those statements to a reporter.

Moran remembers the moment she met Rodgers.
“He seemed too, how do I say this? Too good,” she said. “You know how somebody puts on that real, real front.”
Moran, whose granddaughter stayed with Rodgers at one point, described him as violent.
“She did say…he wasn’t nice,” she said. “I was glad she got away from him.”
Rodgers’ girlfriend, Taylor Shomaker, described him as a perfect, non-violent person who worked 16-hour days to provide for her and her children.
“I thought I completely knew him, was about to marry him,” she said.
As for Rodgers’ nickname, “The Hammer,” Shomaker said his father gave him that name as a child.
