DC - Justina gets standing ovation from Congress

I am speculating, but to me that appears to be Dr Newton's argument. I know that I remember Lou complaining bitterly about Newton "jumping to conclusions" when she had not even seen or examined Justina. It will be interesting to see how the cour prat rules on the motion to dismiss.

DC - Justina gets standing ovation from Congress

Dr Alice Newton's attorneys have appeared before the court. They have filed a motion to dismiss based on the plaintiffs' failure to state a claim upon which relief can be granted. The Pelletiers' are, of course, opposing this. It will be interesting to see how this is handled by the court...

DC - Justina gets standing ovation from Congress

LOL! My husband calls it nosey! I just read an article that discussed Malpractice Tribunals. Although the law says 15 days, apparently the norm is that it takes several months for a tribunal to actually take place. This case is likely to drag out for quite a while knowing the Pelletier...

DC - Justina gets standing ovation from Congress

Justina appears to be participating in therapeutic riding ad Rivendell Farms in Durham CT. (This is based on the horse she is riding - Nanu and the pictures of staff that they have posted.) Rivendell Farms does appear to have a decent therapeutic riding program. They are not listed on the...

DC - Justina gets standing ovation from Congress

The Pelletier's motion for a limited stay of discovery was unopposed and was approved on 4/27/16. I can not find any mention of WHEN the tribunal will happen and if there will be one tribunal of three - of even four as Alice Newton MD has not yet responded to the complaint and does not yet have...

DC - Justina gets standing ovation from Congress

Today the Pelletiers filed a motion for a limited stay of defendants' discovery until after a Medical Malpractice Tribunal is convened. This makes very little sense to me unless this is just a ploy to bog down the legal process and somehow buy themselves more time to prepare for the...

DC - Justina gets standing ovation from Congress

The hospital and Doctors Peters, Ryan, and Bujoreanu filed answers to the (4/11) Second Ammended ComplIaint on 4/19. They also filed second requests for separate Medical Malpractice Tribunals. I wonder if the 15 day clock starts ticking on the receipt of the answers to the first ammended...

DC - Justina gets standing ovation from Congress

I do recall that Linda was at home alone with Justina just before her hospitalization. I think a lot of things will come out that the Pelletiers would prefer to keep confidential. They may find that a lawsuit wasn't really in their best interest.

DC - Justina gets standing ovation from Congress

It is my understanding that in MA, Medical Malpractice Tribunals must be held within 15 days of the defendant filing their answer to the complaint. Children's and the 3 doctors all filed on April 6th. That would mean that the tribunal(s) must be held on or before April 21st. The Pelletiers do...

DC - Justina gets standing ovation from Congress

It appears that Boston's Children's plans to vigorously defend themselves and their doctors in this suit. They had until 6/10/16 to answer the complaint. The hospital, along with Doctors Peters, Ryan, and Bujoreanu answered the amended complaint on 4/6/16. They are all being represented by...

DC - Justina gets standing ovation from Congress

I don't think the pelletiers care who they hurt in this process. They want to be vindicated. And this is just my opinion, but I think they really want $$$

DC - Justina gets standing ovation from Congress

I think it is too early to guess if this case will ever go to trial. Most malpractice suits do not - most are withdrawn or dismissed. A smaller number settle out of court - and out of the public eye. Knowing what I do about BCH and their feelings about this case, I don't believe that BCH will...

DC - Justina gets standing ovation from Congress

The newest motion to amend the complaint, along with the jury demand, was approved on 3/15. Childrens Hospital Integrated Care Organization LLC D/B/A Boston Childrens Hospital has been added as a defendant. ?? Seriously? It doesn't sound like their attorney was particularly well prepared...

DC - Justina gets standing ovation from Congress

"Jesse Katz" - who posted this to the "Miracle" Facebook - tagged several news organizations including the Boston Globe and Fox News. This appears to be the first post to Jesse Katz Facebook account. They do appear to be the same documents that have been discussed here in the past. I am...

I am traveling today so I can't easily copy and save the comments. They are still there though. They are comments (multiple) to their post linking the Boston.com article about the family suing Boston's Children's. I was surprised to see that the comments were posted 8/26 between 8:22 and 8:26...

DC - Justina gets standing ovation from Congress

Per Rev Mahoney The press conference has now been moved to Beacon Street outside the State House building. ETA I wonder if they were informed that using public funds (State House internal conference room and associated costs) to promote a private political issue (not "The People's" business)...

DC - Justina gets standing ovation from Congress

This news conference is not listed as an event on the MA State House events calendar, nor is room 437 listed as a space available for rental. The State House detailed floor plan is not available on line and I could not find a directory that said exactly what room 437 was. However, it is down...
