If more charges are added, the charges themselves and on whom the charges are laid, [but not the facts or evidence surrounding them] will be made public record at the time of charges laid. The crown has plenty of discretion in when, or if, to lay additional charges. IMHO, more charges are...

If this is indeed a US site, I think the administration of this board has made a choice to respect the publication ban as it exists, regardless of whether Canada or not, since I believe in their instructional thread nothing that isn't reported in MSM should be posted here. IIRC However, I'm...

Yes, and he fought it all the way to the SCC: He was convicted by a B.C. court but the province’s superior court overturned his ruling two years later. In 2005, the B.C. Court of Appeal upheld the original decision and the Supreme Court, in a 5-4 decision, agreed, ruling the section of the...

A plea is also reported but the terms of the statement of fact and evidence related to the plea is usually subject to publication bans until trial is underway for whomever is left as co-accused in the case as that evidence is still evidence.

New updates on the case will have to follow the terms of the publication ban. For example, if new/additional charges are laid, the charges will be able to be reported, but nothing except the charges themselves. For court appearances, only the court appearance can be reported (and whether...

Bravo you are correct in that it is not enforceable outside of Canada. Well, outside of Ontario for that matter, though generally other provinces will respect a ban. You are also correct regarding violations of the publication ban in the Bernardo case. Not the least of which was an author...

And an interesting article related to a Facebook group posting information/rumor/comments during a publication ban in 2010: http://www.thestar.com/news/ontario/oshawa/article/748973--does-facebook-page-break-the-law Again, just adding to the conversation

Although I'm sure the court (victim and family also) would appreciate other countries respecting the ban, it can be enforced only in Canada. Here is a government link outlining publication bans (and their general contents) in Ontario...

I have a previous post yesterday explaining in general terms the court process for the first short while and generally that can help provide information. Though the timelines I used were London based, I'd think they could apply to Sarnia as I doubt Superior Court is much quicker here. (IMHO)...

The case is not listed on the London dockets FYI, and I've just heard that it was on radio etc that the court appearance is Sarnia. If this has already been posted, apologies, no time for morning reading:)

I think perhaps people are getting idea that premeditation is required to lay a first degree charge. But, there are two reasons for first degree murder charges to be laid under the Canadian Criminal Code: 1) premeditated or 2) a homicide occurring in the commission of another crime as noted in...

okay, trying this again. New to the board, and reading comments so thought I would add my comments: 1. Tomorrow's court appearance will be strictly remand. If in London, as reported, it will occur either by videoconference in courtroom 12 at 9:00 am [the public will not likely get in as the...
