Oscar Pistorius - Discussion Thread #66~ the appeal~

BIB According to his testimony, he didn't realize it was Reeva in the toilet until after he broke down the door so it would be impossible for him to "fetch the bat and try breaking the door down" after calling the ambulance.

France - Explosions and shooting in Paris, 13 November 2015 #1

I haven't gone through all of the posts here but I have certainly seen a lot of racial discrimination. You cannot condemn 1 billion plus Muslims based upon the actions of a small minority. It would be like labelling all Christians based upon the actions of the KKK or the Aryan brotherhood...

What is the difference between PPD and PD?

Oscar Pistorius - Discussion Thread #65~ the appeal~

BIB, I guess it is all speculation, but could it mean that maybe the judges are split, some think it is murder and some think CH. Perhaps they need more time to review the case and see if they can bring in a unanimous verdict, one way or the other. The only other thing is maybe they are...

Oscar Pistorius - Discussion Thread #65~ the appeal~

When the defence doesn't really have a good case, their job should be to muddy the waters to try and create doubt. Throw s**t at the wall and see what sticks.

Oscar Pistorius - Discussion Thread #65~ the appeal~

It's all about intention. You can't just look at a gun, see it loaded with deadly ammunition and say yup, he was going to kill someone with this. How do you know he wasn't going to shoot watermelons tomorrow? I don't recall any arguments on this but I suspect OP probably loaded his gun...

Oscar Pistorius - Discussion Thread #65~ the appeal~

BIB, to add to this, I believe Roux recognized that Masipa didn't accept PPD. However, the next step was intent and since there was no intent, Masipa went for CH. What the PT did was they adjusted their complaint and said that there was error in objecto and the fact that it wasn't Reva in the...

Oscar Pistorius - Discussion Thread #65~ the appeal~

Cottonweaver, when I said people were upset, I wasn't referring to you specifically. I was speaking much more generally as in the general public. In terms of why I joined the forum, yes it is late in the game but I needed some of my own questions about this case answered and having an open...

Oscar Pistorius - Discussion Thread #65~ the appeal~

This isn't a popularity vote but there are many in the legal community that said Masipa's ruling was correct and that this was CH. Commissioner Mathole Motshekga went on to say may people in the public are just ignorant of the law: “Given the unfair criticism against you, due to the ignorance...

Oscar Pistorius - Discussion Thread #65~ the appeal~

In terms of only happening in movies, that's not true, movies imitate life. I hear noises in our house from time to time. I don't go running around waking the family up for no reason. I'll go check what the noise is first.

Oscar Pistorius - Discussion Thread #65~ the appeal~

I think many people on this board are upset with Masipa and calling her incompetent because the board members didn't get the verdict that they wanted....murder. Masipa had a tough job in front of her. This was probably one of the toughest cases in S. African history. It was a dream team of...

Oscar Pistorius - Discussion Thread #65~ the appeal~

I agree in that if the bullets are legal, then there is no issue in him keeping them. But, they are irrelevant to DE because they do more damage. That's like saying a drunk driver is more guilty of killing someone because he was driving a truck instead of a sub-compact car. The type of car...

Oscar Pistorius - Discussion Thread #65~ the appeal~

True but it is irrelevant to the night of question as it would be speculation to say he was an insomniac so he was up on the night Reeva was killed.

Oscar Pistorius - Discussion Thread #65~ the appeal~

I think that is the whole crux of this case, were they asleep or awake. The PT did have strong evidence to suggest that they were awake and arguing, but the DT did their best to argue it away. If there is enough reasonable doubt, the benefit has to go to Pistorius.

Oscar Pistorius - Discussion Thread #65~ the appeal~

"If the state succeeds in this argument, it has asked that Pistorius’s culpable homicide conviction be substituted with one of murder, and his case referred back to Judge Thokozile Masipa for sentencing. Prosecutors are likely to ask that Pistorius be imprisoned while this process takes...

Oscar Pistorius - Discussion Thread #65~ the appeal~

I agree with this. I can see why Masipa went with CH. 1. It's 3 AM in the morning, people aren't thinking correctly at this time, especially if they are just woken up (on OP's version). 2. The fact that he used Zombie stoppers is irrelevant because he didn't load his gun. This was the...

Oscar Pistorius - Discussion Thread #65~ the appeal~

I heard that the judgement should come before the end of the month as the judges are going on recess. Anyone heard anything as to how this occurs. Do the judges come to a decision and then tell Nel and Roux that we'll meet next week to give our verdict? Does Pistorius have to be at the...

Oscar Pistorius - Discussion Thread #65~ the appeal~

It was 3AM in the morning, pitch dark and I heard a noise. I grabbed my gun, went to the bathroom. At this point, I heard a noise, got scared and started firing my gun in an absolute panic. After 4 shots, I realized what had happened and stopped firing. It was an accident and I never meant...
