Babcock Murder Trial - Weekend Discussion #5

I think clean, sober and off drugs he’s a smart guy. The state he was in at the time of the murders? I’m not as sure.

Laura Babcock Murder Trial 11.23.17 - Day 21

Yes, they were written in jail. IIRC the only point the crown made re: the letters was that the search of the noudga home where they were found was done before charges were laid in LBs disappearance. Thus making the point, why are you coming up with an alabi for/ trying to pin something on MS...

Laura Babcock Murder Trial 11.23.17 - Day 21

I'm shocked there was a direct indictment against MS in this case with such little evidence, unless they couldn't do direct for DM but not MS?

Laura Babcock Murder Trial 11.09.17 - Day 13

Agreed, he needed a reason to push Shane to finish, short of telling him the real reason.

I'm getting the same impression here....

Babcock Murder Trial - Weekend Discussion #1

Here is a question I've been thinking about and maybe someone could answer for me. A person can appeal a conviction if they feel their lawyer made errors when representing the, - would DM have waived his right to appeal based on these grounds when he decided to represent himself? I recall an...

Verdict: GUILTY for both Millard and Smich of 1st degree murder #2

What still bothers me abt MM adding to her testimony is the timing. Why wait til a few days before you testify(not to mention well into the trial)? She had clearly moved on, had no lingering feelings, and said so herself, once he was in jail there was no point staying together. This leads me to...

Verdict: GUILTY for both Millard and Smich of 1st degree murder #2

I took as since he couldn't give those jabs to DM he would give them to his lawyers instead. That said, IIRC the jabs started when DMs lawyer was at the point of asking the same things over and over and over.

Verdict: GUILTY for both Millard and Smich of 1st degree murder #2

The point I was trying to make is that discussion happens when there are differing opinions. If we all agreed on everything there would be nothing to discuss. We just need to do it in a respectful manner that's all.

Verdict: GUILTY for both Millard and Smich of 1st degree murder #2

If we all agreed, these threads would never reach 60+ pages like they do!

Verdict: GUILTY for both Millard and Smich of 1st degree murder #2

https://www.defencelaw.com/appeals.html This was an interesting read regarding appeals. Unders reasons for appeal, it lists judge improperly admits evidence. Question for the legal minds, is this when the evidence itself shouldn't have been entered at all, or that his procedure was incorrect...

Verdict: GUILTY for both Millard and Smich of 1st degree murder #2

Susan Clairmont tweeted that once all sides rested MB would be allowed to attend. I just can't find a link atm to the list of tweets

Verdict: GUILTY for both Millard and Smich of 1st degree murder #2

While I don't think he expected the physical letters themselves to become evidence, he did expect that CN, whom loved him at the time, to relay anything he said in them back to the police should they start asking questions. Also, I think the last thing he would want is to have his gf realize...

Verdict: GUILTY for both Millard and Smich of 1st degree murder #2

I think he will win his appeal TBH. I was thinking last night, and thought back to the seemingly damning infamous sausage photo. When it was first presenting, many here thought it was by far the most incriminating thing we've seen against MS, but it was never mentioned again, likely following a...

Verdict: GUILTY for both Millard and Smich of 1st degree murder

A number of things, but to name a few, MM changing her testimony days before taking the stand to say that MS was happy the next morning, the lack of blood/GSR etc in the Yukon, and I found his series of events more plausible than the other two versions. The crown lost me when they said he was...

Verdict: GUILTY for both Millard and Smich of 1st degree murder

I will be brave with you, and say, I still have some doubt as to MS and first degree. I thought maybe it was because I really only had Twitter to go by, and no in court time, but you were there quite a bit and still have doubts. I do respect the jury's verdict, and hope they got it right. While...

Verdict: GUILTY for both Millard and Smich of 1st degree murder

My assumption about the lies was that they made a pact that the drop the stuff get away from it, and never speak about it to anyone. MH then proceeded to lie multiple times to police, in keeping with the pact. AM however spilled the beans pretty quickly, as one would expect when someone is...
