Verdict: GUILTY for both Millard and Smich of 1st degree murder

I don't think this is a reason that it doesn't support his story - but the main point is - it doesn't matter if that piece of evidence supports his story or not. We'll never know who/where the trigger was actually pulled. It could easily have been where MS said it was. What is important is...

Verdict: GUILTY for both Millard and Smich of 1st degree murder

I don't see how TD got her to change her testimony there. Saying one person was happy doesn't mean the other person wasn't as well. Anyway, I agree that people lie. But you need to take into account the motivations. If a detail that would hurt MS was omitted by MM in her early police...

Verdict: GUILTY for both Millard and Smich of 1st degree murder

You can't assume this at all (and it's almost certainly wrong). The actual deiberarion time was probably around 30-35 hours (accounting for meals, delays, etc). That's not a lot of time to cover all of the evidence in this case and think about two different accused and what that...

    Verdict Watch Discussion Thread

Obviously, whenever they appeal they didn't like the verdict. The point is that they can't appeal JUST because they don't like the verdict.

Canada does actually prevent Double Jeopardy - it's just defined differently than in the US. I actually like the Canadian version better - which is that certain type of errors can be corrected on appeal. I feel like in general (not always) it leads to better results.

    Bosma Murder Trial 06.2.16 - Day 58 - Closing Arguments Day 3

I didn't need any convincing that MS was part of the plan all along, but the one thing that the Crown said today that I hadn't really considered was how TD avoided asking witnesses the questions they needed to ask to prove MS's story. That's not an oversight or being a bad lawyer. It's because...

    Bosma Murder Trial 05.24.16 - Day 54

<modsnip> I don't believe MS needs to have been in the truck to be guilty of murder one. If he does, then sure, I agree he shouldn't be convicted because its certainly plausible he wasn't in the truck and didn't pull the trigger. As for the rest, I'm not going to argue point by point -...

    Bosma Murder Trial 05.24.16 - Day 54

Yeah, I see a lot of people doing this. This and thinking that "beyond a reasonable doubt" means "beyond all doubt" are the two most common misconceptions when viewing something like this trial. MS coming up with a *possible* story, isn't enough. To believe his story you have to look beyond a...
