HHJP has had to remind this lady more than once that he is not bound by ABA guidelines.

AF - "obviously need a mitigation psychologist" in para 2 for penalty phase HHJP wants to know pre-trial amounts - trial takes care of itself. AF asks for 2500 and copying costs for school records, medical records, etc.-- HHJP thought mitigation specialist already got those - she asked for addl 1000.

She asked for trial expenses for herself mileage only - HHJP says they haven't been picking up those costs. $125- $150 per trip but she isn't going to quit if she doesn't get it.

She is also asking for travel exp for mitigation expenses or investigator because ICA lived there until age of 3 and to get birth and medical records. HHJP wants to know if there are witnesses still there (AF says there are). HHJP wants to know why it can't be done over phone (AF says it has been met w resistance over phone). HHJP wants to know what makes her think she is going to get answers if they go up there. HHJP says he is not bound by same guidelines because he is spending taxpayer money. AF needs to prove to HHJP that witnesses will talk in person and not over phone to get approval

Judge Perry is really tieing their hands today. I'm so happy to see him showing his authority and letting JB know he is on to him!

KC mainly looks bored and a bit affronted that she has to sit through all this instead of just being released, but pleasingly she seems to have flashes of fear whenever HH (His Handsomeness) JBP throws straight sense at her defense.

Judge:
DO we know why that can not be accomplished by phone instead of talking over the phone? What would lead you to believe that there is any chance that they would be willing to talk to you in person if they won't talk in person.

If they won't talk to you on the phone...


I am not bound by ABA guidelines but I am bound by US COnstitution and the FL. Constitution.

If you can prove to me that they are willing to talk to you but not on the phone. And not make a trip to Ohio hoping to catch someone at home.

Defense has to demonstrate a legitimate reason it requires an in person visit; otherwise he's thinking they are going on a "hope" that they will be able to find someone and talk to them.

The Judge seems to think this is unnecessary me thinks.

Oh he has really had it. Not letting them go on a fishing trip to Ohio either unless he can be sure it is the only way to do it and it will be worthwhile.

HHJP is requiring Finnell to prove to him that a trip to Ohio to interview those who knew the Anthonys when Casey was ages 1-3, will talk to Finnell in person, therefore making the funding appreciable.

Finnell claims that people who knew Casey have refused to speak with them by phone, thus why Finnell wants the funding for a personal trip to visit them.

What I'm getting out of all of this is...they all know she's guilty, they're just trying to find something, anything that will keep her alive and in prison for the rest of her life.

I agree...which is why they should advise their client to let them beg for a plea for her which would include LWOP. So many $ spent and that's the absolute BEST she could hope for when this goes to trial...I know..it ain't gonna happen...
