I don't think, Judge Perry will do anything more then scold Baez.

Oh how I would enjoy seeing JB lose face in HHJP's courtroom. He has earned a public dressing down on so many occasions that I've lost count. But I have to remind myself that the real focus is doing right by Caylee and that means presenting an unimpeachable trial. So for me, the disciplinary action is not as important as what HHJP chooses to do to get JB to present an adequate defense.

Don't give Baez any more time to do his song and dance act.

I agree with some of you others, that Judge Perry has been much to lenient in alot of things concerning Baez. I know that he is giving more leeway than others would recieve, IMO, because he is doing his upmost to keep things on track, on time, and, to avoid excuses for appeals in the future.
The excuse that "death is differant", is getting old.
You bet it is differant.
Just ask Caylee ~ oh, that's right, we can't.

Whatever the reasons are that Baez is acting the way he does, and, doing the things that he does; it's time to put a screaming halt to it, now.
It's time to get down to business, put the color coded charts away, and wise up, instead of wise cracking all the time at the court and the people of Florida's expense.
Oh, and yes, the tv cameras also.

Enough with the grand-standing.

I so want to see this resolved this week, so that next week when these new motions are heard, they all are on the same page.
No excuses, no pen clicking or smirks.
 
Since Jan. 3 is my birthday, I want HHJP to give me the BEST birthday present: A big slap-down to JB with money sanctions. Hit him where it hurts.

I don't think so, but HHJP is out this week, so I'm thinking nothing is going to happen at least until Jan 3.

Yeah, I want to see him hit in the wallet also, but, he is just either dumb enough, or arragant enough to think that he could turn it in to the JAC for reimbursement.
 
I see in the article for WESH that date & time are for the 6 motions. Did it also say the state's motion would be heard at this time too?
 
I have faith that HHJP is doing what he has to do rather than what we would all like to see. I think JB deserves a but to do so in open court exposes the defense for what it is, this may affect how it's competence and honesty is perceived by the potential jury pool . As bad as she is the defense have made her look worse (if that is possible) by not following the

I agree,the sanctions will be given in camera.HHJBP can't risk this case going offtrack.I imagine he his royally pizzed off,but wiil try to keep things running smoothly.

QB, I couldn't swear to it, but I am pretty sure it will be heard at the same motions hearing. Ashton filed it on the Wed., 12/22. Many courts, clerks, etc are "dark" (ghost crew at work) that close to Christmas and I don't think Judge Perry set a new hearing time. He seems to like to take care of business asap and since he had already set a motions hearing for the defense's motions in limine, I think he will hear JA's motion for sanctions at the same time.

There is a status hearing set for Jan. 14th. I seriously doubt that HHJP will try to fit in another motions hearing before then.


*attn nums* - btw, I moved the status hearing set for Mon. Jan 10th to Fri. Jan. 14th. While you were unavailable, HHJP needed to reset it because of a conflict on his schedule.
 
If I had to predict how Honorable Perry will handle this motion I would say that, if the evidence shows JB withheld something (I'm inclined to believe he did and that JA can prove it), he will give JB and company the scolding of their life. And will THEN give him another deadline with the caveat that if he doesn't adequately fulfill his previous order then he will already have a set monetary sanction that he will have to pay, in addition to the possible elimination of that expert to testify at trial. Although, if I had it my way I want to see him hand out some huge sanctions because I'm getting sick of tired of JB's games.

I just think that Honorable Perry tends to give counsel enough rope to hang themselves. And although I'm a little frustrated with the rest of you I believe this is the only way to handle the caliber of counsel that JB and company seem to be. It keeps the record squeaky clean and allows JB to make a fool of himself (and in front of his client).

If I have time today I'm going to do a little research on Honorable Perry and how he handles sanctions and if he does grant sanctions what type he gives. Although I can't make any promises since I have a filing today and it's in a crazy jurisdiction. So I'm up to my eyeballs in cite checks.
 
IMO, there is lenient, then there is Judge Ito.

Please please please HHJP, don't allow another O.J trial.

See, as much as it may sound like I want this to he heard in the courtroom for my own selfish reasons, I really think it is important for Casey to witness what is going on here. Having sanctions filed against your defense is a pretty big deal... she doesn't need JB sugar coating it for her telling her it's no big deal. Because it is a big deal.

Judge Perry is on vacation this week... and I really don't think he has any intentions of being in that courtroom... so, we have to at least wait until next week!

Correct, it IS a big deal. Judges typically only order sanctions in very serious matters. I've only had sanctions granted in one of my cases, it wasn't against us, and the plaintiff had to pay ALL of our attorney fees because we had to work on responding to a RIDICULOUS motion. The plaintiff wasn't happy my firm isn't cheap.

The "week" of December 27th. Not until the 27th.

ETA: That doesn't look right when I read it again... it sounded kinda snippy and that was not my intention. I'm so used to writing fragment sentences (screenplays). What I meant was that Judge Perry told the State and Defense that he would be on vacation the "week" of the 27th and that he had no plans to be in that courtroom that week.

I stand by my earlier assessment. HHJP will do something more severe than a simple scolding. He will send a clear message that this behavior will not be tolerated in his courtroom. You do not play games with his orders. Ever!

BUT!

Everyone seems to think that this will be targeted at JB. It probably will not. JB will get off relatively lightly in the courtroom itself (or will continue to be so completely clueless that he will not realize he is being dressed down). Remember the sanctions motion is not targeted at JB specifically. EVERY MEMBER OF THE DEFENSE TEAM IS RESPONSIBLE FOR THE FILINGS, AND EVERY ONE SHARES IN ANY SANCTIONS. HHJP is not looking to go after JB. Honestly JB is all but beneath his direct intervention. What HHJP will do is insure that JB and his questionable filings of doom, quickly become somebody elses problem. HHJP will not directly call into question any single member of the defense team. Doing so would call into question his impartiality before the defendant. He will come down on all of them. With the emphasis on the senior experienced DP qualified attorneys. For the purposes of insuring that the defendant is being appropriately served by her defense team. CM and AF will bear the brunt of this. it's probably all but impossible to shame JB into doing things properly. It is however possible to shame, embarrass and dress down the more experienced attorneys into putting JB on a leash. Basically, "These filings are being made in your name and your behalf. If you can't be bothered to read them, correct them or insure that they are done properly, then you will pay the price".
