2011.01.06 Baez Slapped with Formal Sanction

Was the defense team due to turn over 2 of the expert witness statements today? Or, am I mistaken?
IIRC, 2 were due within 10 days and the rest in 20 days?

because today is a holiday, they have until tomorrow according to what Jeff Ashton said in court the other day.

I was thinking just one was due (Dr. Furton, IIRC) by Jan 18, and then the other all due by Jan 26. Here is the order.

He meant 5pm the previous day. He was stuck in traffic for 24 hours.

Good question there? Hopefully one of the lawyerly types can answer it. Would another option for the defense simply be to strike the witness from the defense expert list? if the witness is absolutely not going to testify there is no reason for reports?

I think they have to turn it over no matter what. If the report hurts the defenses case they can't just bury it, IIRC.

They have the option of striking him from their expert list. He wouldn't be testifying so they would not be required to produce a report and there would be no need for the state to depose him. (considering the recent sanctions, I would be sure to file something or at least call the SA and HHJP to make sure they knew I wasn't just ignoring the order. :angel

Bottom line - the defense now has to make definitive decisions about which experts they may want to call and produce their reports (and all the rest that HHJP ordered) so that the state can prep for depos.

Everyone had a good laugh at Cheney throwing little brother under the bus, shook their shoulders and asked what's next.
The judge knows he is on solid ground when he rules, the fact that Cheney doesn't agree is of no concern to him, whatsoever, it is not a demoracy...or a joint attorney/judge decision. The judge rules. Suck it up. Accept it, learn from it, be mindful to never let it happen again. Get back to work. Grow up. If little brother is misguided, well then Mr. Mason....step up and lead!!! WTH?!
Stop that ever lasting whining before Judge Perry gives you something to cry about, to the tune of five hundred dollars a day. Yes, American dollars!!
