HHJP - now Simms is giving her interpretation of stipulation
 
JA: I don't even know how to respond to the rewriting of history. I don't even know how to deal with this. I have an experience of lawyers saying something and meaning what they say.
 
JA: saying in good faith...CM, JB...they would not do what they are doing. JA said, look just write it down...and they did but now they want to say that's not what we meant.

We prepared for this but again we are told...JA just apologized for getting emotional...

he has had it with the "nothingness" of the defense's tactics. All they do is avoid. The judge says the two sides cannot agree if it is day or night.
 
Judge - It is clear that both sides can't agree if it is day or night. Even though reasonable people can.
 
JA is letting it all out now. He does not like it if he can't rely on the word of Attorneys as to the content of the hearing. Asks HHJP to hold JB to the statement he wrote ( which Sims scribbled to get JB out of contempt charge) which they are now trying to slither out of......
 
The judge will let each side present what they need to present. HH says he was not back there, concerned about "appelate ..."...how will an appelate court read this?

So, he will let the state call additional witness if they need to rebut.

JA feels he did not get a chance to prepare because of the way the defense is withholding...
 
It is quite evident that both sides couldn't agree if it is day or night . . .
I will permit the state an opportunity, if they need to, to recall the additional witnesses if they need to rebut.
 
does oak ridge lab follow their own protocols? Jose asks witness. Witness says "no" and alludes to the idea the equipment is "old".
 
Jose is bringing out a 2008 study. HHJP asks for the title of the paper.
 
Jose is asking about the section in the report about chloroform. Asking about the 'double cross symbol' being a footnote.

Chloroform is not detected during surface sources versus buried remains...jose asks if there is a difference between the decop from being buried versus on the surface.

Asking about someone being a co author of the study...
 
I know it's aggravating right now, but HHJP is not failing Caylee. He is making sure that needle sticks hard in Casey's arm and there is no chance of her getting out of it. As much I hate what he's doing, it really is in Caylee's best interest that her murderous mother has nothing to appeal down the road.
I agree.

The instant gratification of seeing JB slapped down is nice, but HHJP's job is to make sure KC gets a fair trial. And KC getting a fair trial means that Caylee is getting justice.

HHJP has not failed Caylee; he is making sure her accused killer gets a fair trial so that if KC is convicted, she can't level the claim that she was treated unfairly.

My opinions only.
 
Does anyone think that when JA does his cross, that he will hang this so called scientist, Furton, out to dry?
 
I'm lost...why does HHJP keep over-ruling JA?

I think because he already said he is going to allow the prosecution to depo him again. So, I think the judge thinks his objections are moot. JMO...
 
OT but have they had a break yet? I need a potty break and going to try to grab a bagel from Au BonPain

lunch break starts at 12:00 pm est.....so just a little bt more...I had to leave --- I couldn't wait anymore....
 
This may be a Frye hearing but does anyone actually think that HHJP has not already conducted MASSIVE research on his own????

Don't fret over the DT being allowed this seemingly undeserved leeway.

IMO, HHJP already knows that he is going to allow all of this in at trial. He's just giving the DT their "turn".
 
jb you are aware that air samples taken from the trunk of the car, do you find on this where the air samples were taken - do you see them there?
KF no it talks about the interior of the car but not the trunk itself
 
If the SA was not allowed to re-depose this witness - then I would be fretting about this. But the SA will have the opportunity to both do a rebuttal and re-depose this witness, bring him back and perhaps even bring Dr. Vass back if they need to. Way too early to be concerned about how this is going...

kf solvent - used to detect flurocarbons - which have been banned

jb is this chemical unique to human decomp?
kf no - in reserach we have done we haven't seen that in human decomp that is why we were curious why dr vass saw it and we didn't
