If the jury never sees the partying pics, the state is screwed! Seeing is believing! I don't get it, I thought the judge already ruled on the pics!
Just my opinion, but I believe the party pictures were borderline evidence to begin with. I expect the basic issue is whether the pictures were more prejudicial than probative of the crimes with which she is charged. HHJP is tasked with protecting the record and making it as bullet proof as possible on appeal while still allowing both sides a fair trial. NOW that HHJP has heard JB's opening argument, he is being more conservative in deciding whether or not to let borderline evidence come in to the trial that could be a hook to reverse on appeal. The State can present all kinds of oral testimony on her party girl behavior. They just don't get the pictures because they might be a hook for an appeal. This is actually a good sign, that HHJP thinks the State's case is so strong it doesn't need the photos and JB's case is looking mighty weak. SA knows that. JB might know that and might now. However, JB will have to tread very carefully now so he doesn't open the door to allowing the State to use the photos in rebuttal to something the defense has raised.If the jury never sees the partying pics, the state is screwed! Agreed when I was in college I was juggling so many things all my classes, working full time and being the VP of my sorority. I can't imagine having this horrendous drama thrust upon me while in college. I hope all of these poor kids can put this behind them. Truly.
