The following was in one of the letters that ICA wrote to RA. I wonder if ICA is still feeling the same way now?

I have pens! It's oddly funny to keep saying it, but like a 5-year old, I'm rightfully proud. The scoop, in case you are still unaware... the day I was indicted, definitely not one of my better days, the "jury" or better stated - Grand Jury, pushed for the death penalty. Well... a couple of days ago, the prosecutor decides that they "don't have enough evidence to proceed". Although the entire basis of the case is unwarranted, and saying that I am "falsely accused", is BEYOND an understatement, but at least they're starting to back off, and maybe realize that innocence is a big factor here.

Who is RA?

IMo that's a strange way to put it. If she was innocent she could say, "realize that I didn't do it" or "realize that I'm innocent".
Instead, "innocence is a big factor here"???

Isn't innocence a big factor in any trial, as it's what the jury must presume and the prosecution must rule out by evidence, and the defense attempts to prove?

morning all, I have tried to skim teh sibebar and the thread but have no patience for it. was there any mention by HHJP of the photo debacle when court began this morn? tia

None whatsoever...but HisHonor ain't so happy today.

Totally OT: Does it bug anyone else that KC gets to wear normal clothes?? I think she should have to sit there in her orange jumpsuit or whatever else she has to wear in jail. I suppose that's not really fair, but it bugs me.

I also think it goes along with innocent until proven guilty.

I personally would like to see her in porison garb myself but understand the reasoning.
 
Backing up here to earlier in Dr. H's testimony - does anyone remember when he said he estimates the body was in the trunk for 3 to 5 days?????

Two things from the mock juror this morning:

1). The mock juror took the time this morning to review Florida law regarding First Degree murder. The mock juror is now assured that she does not have to know whether or not ICA intended to kill Caylee. Legally, aggravated child abuse (see legal definition) that results in the death of a child falls under First Degree Murder.

2). After listening to Dr. Haskell's testimony today, the mock juror has had many lingering questions answered.

To make a long story short - his testimony was superb!!!! Another nail in the coffin so to speak.

As far as Jose's possible ineffective counsel - how could there be effective counsel with ANY ATTORNEY, when you have so much evidence (circumstantial or not), against your client!

2 plus 2 has always been 4 as long as I can recall.

I agree with you to a certain extent. I think his bumbling works in his favor SOMETIMES but he also should show strength in what he believes is true fact. That's where he loses me and I tend to believe his inexperience is going to help hang ICA (besides her dastardly deeds). He needs to ask far less questions and stick to his opening statement as the framework for ALL of his questions....who cares what went on with this and that if the state can't prove ICA was the one who deposited the body in the woods. It should be a no-brainer two second cross each time. "Did any of your research reveal evidence that proves Casey carried the baby in those woods?" Hard to argue that point from the SA's perspective.

Who in their mind attacks someone on the stand about fiscal matters when they have not paid a bill to that witness? I feel off my chair lolling, seriously :)
