In a brief response to the appeal filed Monday, that state Attorney General's Office wrote that the conditions of probation can be served only after someone is released from jail.
"Legally, it is clear that a defendant cannot serve probation while incarcerated," the response said.
The appellate court has given the defense has until noon Tuesday to respond to state, if desired.

In an interview this morning in USA Today, Reichs opens up about why she became involved in the case. She was infuriated by what she considered biased media coverage, especially on some cable channels.

"The State of Florida has taken the position that Ms. Anthony has not served a term of probation," the latest filing says. "However, to reach this conclusion there must be a legal ruling that either wholly ignores the findings of the Department of Corrections or divests the Department of its authority to determine what suffices as a term of probation."

The defense throws blame back at the court, saying, "That the order itself was erroneous was a matter for the lower court to address during the proper judicial timeframe. Any second sentence of probation would most certainly result in 'multiple punishments for the same offense' in violation of Double Jeopardy."

Jaren Hare and Charles Darnell were convicted of third-degree murder, manslaughter and child neglect. They were each sentenced to 12 years in prison and five years of probation.
