Plead not guilty. Held without bond. DA will seek DP.

3/15/22: 10 Subpoenas issued.
3/17/22 Update: McCraney’s attorneys on Thursday publicly named a retired Ozark police officer as the murderer of two teens, claiming eyewitnesses will implicate him during McCraney’s trial. Prosecutors, though, dismissed those allegations as a dog & pony show. News 4 will identify the officer only if he is named during the trial. Defense attorneys also accuse the Ozark Police Dept. of systemically covering up evidence related to the 1999 shootings of coeds J.B. Beasley & Tracie Hawlett, another claim rejected by prosecutors. Attorneys David Harrison & Andrew Scarbrough told a judge that one witness will testify that she heard the officer they accuse, in a drunken stupor, confess to those crimes. However, they claim not until this year did police interview that woman & then using an investigator who is family related to the retired officer. Dale County prosecutors David Emery & Emmett Massey IV accuse McCraney’s attorneys of grandstanding. Dale County Circuit Judge William Filmore will rule later what evidence & allegations will be permitted during that trial.

Doc. #232: Motion for specific production-Gun. Motion denied. Those records apparently don’t exist because officers at that time used personal weapons instead of department issued firearms.

3/22/22: Defendant's request for production-Ozark PD on duty. Requests OPD to produce & permit defense counsel to analyze, inspect & copy or photograph any & all documents, to include run reports & recordings of all OPD personnel on duty during 1st & 2nd shift on or about 3/21/22. (Claims of witness harassment by OPD).

3/23/22 Update: Motion for discovery/production filed by defense hearing set on 4/7/22 @ 1:30pm.
4/5/22 Update: Defense attorneys don’t want a jury to see the interrogation of McCraney that took place after Ozark police arrested him, but before they formally charged him in the cold case shootings of two Dothan coeds. They claim investigators repeatedly denied McCraney his constitutional right to an attorney & questioned him for 27 hours, while holding him in a small room at the police dept. “In a three-minute period, the Defendant requested an attorney on eight different occasions & on the eighth time even asked for a specific attorney,” according to a suppression motion filed in Dale County Circuit Court. That motion filed Monday does not specify what McCraney told investigators, though sources say he denied knowing J.B. Beasley & Tracie Hawlett. The police interrogation is likely a key cog in the prosecution’s case & the Dale County Assistant District Attorney David Emery will almost certainly oppose the motion. Dale County Circuit Judge William Filmore will consider their suppression motion in May, when McCraney’s trial is scheduled. Other motions filed: 1. Request for production for all documentation regarding the Mazda 929 that was J.B.’s & they were eventually discovered in. 2. A motion for a delay of time to allow for a jury list investigation. The jury list will not be available for review until next week. This motion was handled today & denied by the Judge. 3. Motion for individual & sequestered Voir Dire. Basically the defense wants to interview the potential jurors individually instead of being questioned as a group. 4. Motion for production of information, data, photos, etc. for all unmarked cars used by the Ozark Police between July 24, 1999 & August 7, 1999. 5. Motion for production of a police interview of Rena Crumb by a then Lt. Tommy Merrit & (ofc?) Sam Pickett. 6. In addition there is a subpoena request by the defense for John (Jon) Carroll. As a refresher, Carroll was the publisher of the Henry County Reporter, an online blog which originally brought public the allegations by Rena Crumb of a police connection, involvement or direct culpability in the murders of Tracy Hawlett & J.B. Beasley.
4/7/22 Update: There has been a last-minute delay in the hearing for McCraney. “The State of Alabama & the defendant notifies the court that these cases will not be ready for trial on 5/2/22,” Dale County Assistant District Attorney David Emery & Defense Attorney David Harrison said in a joint court motion. They don’t specify reasons for the delay. His trial scheduled for 5/2/22 has been pushed until 8/15/22, with jury selection beginning a week earlier, 8/8/22.
4/7/22 Update: Judge denied dismal of charges. A hearing on 7/21/22 regarding a motion to quash (suppress/cancel) a subpoena for John Carroll. This is a subpoena request by the Defense. The motion to quash was filed by John Carroll. 7/8/22 Update: Subpoenas filed for 5 people (see post #558 for more info). And other last minute motions will be addressed.
