Four additional subpoena requests filed by the defense:

Cody Evans (OPD)
Keith Cauthen (prior OPD)
Kelly Parker (Manager Alabama Power)
Monica Thomas. (Executive Assistant OPD Since (1992)

Although irrelevant, I raised an eyebrow when I looked at one of the address of service. But then discretion, much like anonymity can be like a warm blanket I suppose.

One additional Subpoena request popped up today

Larry Bell

I am not familiar with this person or his possible connection with the case.
my research only produces two Larry Bell subjects locally.
one is deceased (this year). There is another Larry Bell in Dothan. Possibly retired. On local query the same person may also be a local political candidate.

But to be clear, I am not sure who this is or the connection (for now).

Justice on Friends

It is not showing on Alacourt yet, but there is a subpoena request submitted for Kathy Richart.
I have no knowledge of who this is or connection with the case or upcoming hearing.

Mystery to me folks.

**** Addendum: this person may or may not be employed by the Alabama Department of Forensic sciences. Not completely positive on this. Information harvested from public database. ****

Good Saturday evening my friends and supporters of justice.
a couple of last minute court filings yesterday. I will upload/attach copies to save a lot of typing. But here is the overview:

1. Defense subpoena requests for four individuals. None of them come to mind and I am not familiar with them. One of them is apparently from the State Attorney General’s office.

2. A motion from Jon B. Carroll requesting that his previous motion to quash (cancel) the defense subpoena has active for him in the case trial. If Judge Filmore approves the motion that will make the hearing on 7/21/22 a moot point and most likely will be cancelled.

Have a great weekend friends and thank you for supporting true justice in this case.

quite possibly. It looks like there are maybe pre-trial issues that are on the table that I am not seeing. Probably subpoenas requested, but not approved at this time.
i will look into this a bit further this week

Found this posted this morning

ADMIN NOTE:

Without spending hours trying to find out who "Carroll" is, posts discussing them have been removed as off topic (and, from what I can gather, likely /possibly sleuthing and trashing a witness).

Subsequent rants and bickering have also been removed and if this crops again, Time Outs will be issued.

ETA: Don't post on the thread that a post will be Reported .. just Report it and move on without mentioning it.

That moment when you're catching up on a case and see a relative's name listed on the subpoena. Doubtful that the individual knows specifics about the case. But that's the first time I've ever seen someone I know listed. Praying for truth and justice as always

HEARING RESCHEDULE
The hearing scheduled for tomorrow (7/21/22) has been rescheduled for for July 28, 2022.

Additionally there were four (4) additional subpoena requests filed yesterday by the defense.
Memoranda from Alacourt attached.

From what I can see and gather directly, this pre-trial conference/ hearing might be a quite pivotal action just short of the actual trial. It will be a full day

Have a great week folks. Justice on! Remember, nobody can keep you from uncovering the truth unless you let them.

Good evening everyone. As you know we have a pre-trial hearing tomorrow. MSM will pick it up and someone will post a link before I get back home I am pretty sure.

Meanwhile….. there was a flurry of filing action yesterday. First subpoenas. I have pasted the list below. Most are repeats of prior subpoenas, but some are completely new. Out of the new ones, I found two provocative, but I understand the strategy by defense counsel very well. The rest we will just have to look into ourselves.

I have also attached three defense demands for specific production. Two of these are repeat demands are for individuals (case file information) that the State has prior answered as having no information on. I have looked at both of these individuals and cannot find a clear case connection of either on any reliable public media. In fact, one of the individuals listed is involved in public MSM and may have reported on the case as a professional journalist. The third request for production is in regard to an alleged incomplete firearms examination report from the Alabama Department of Forensic Science.

Here is the subpoena list:

Trial was set to begin on 5/2/22 continued to 8/15/22. Jury selection begins on 8/8/22.

3/7/22: Subpoenas for Jeanette D. McCraney & Dan Driver to appear on 5/2/22 @ 9am. 3/9/22: Doc #266: Response to Motion for specific production (9/10/19). State has not been able to discovery a connection between Victor Glass & the above-styled cases. Doc #268: Defendant's Motion in Limine. Doc #270: Defendant's Order to set motion for in Limine hearing on 3/17/22. 3/11/22: Subpoenas issued - see post #510 here:

3/15/22: 10 Subpoenas issued.

3/17/22 Update: McCraney’s attorneys on Thursday publicly named a retired Ozark police officer as the murderer of two teens, claiming eyewitnesses will implicate him during McCraney’s trial. Prosecutors, though, dismissed those allegations as a dog & pony show. News 4 will identify the officer only if he is named during the trial. Defense attorneys also accuse the Ozark Police Dept. of systemically covering up evidence related to the 1999 shootings of coeds J.B. Beasley & Tracie Hawlett, another claim rejected by prosecutors. Attorneys David Harrison & Andrew Scarbrough told a judge that one witness will testify that she heard the officer they accuse, in a drunken stupor, confess to those crimes. However, they claim not until this year did police interview that woman & then using an investigator who is family related to the retired officer. Dale County prosecutors David Emery & Emmett Massey IV accuse McCraney’s attorneys of grandstanding. Dale County Circuit Judge William Filmore will rule later what evidence & allegations will be permitted during that trial.
3/17/22 Update: Orders on motions of defendant before the court:
Doc. #59: Demand for copy of scientific reports-Motion moot.
Doc. #63: Motion concerning seeking the death penalty. Motion moot.
Doc. #124: Motion for specific production-Coroner's report. Motion denied.
Doc. #89: Motion for specific production re Ozark PD. Motion denied.
Doc. #152: Motion for specific production-Forensic report. Motion granted.
Doc. #160: Motion for specific production-Ballistic report. Motion granted.
Doc. #165: Motion to compel investigating officers to turn over info related to the investigation of this case to prosecutors. Re Dan Driver. Motion denied. Prosecutors say there is no record that the interview occurred.
Doc. #232: Motion for specific production-Gun. Motion denied. Those records apparently don’t exist because officers at that time used personal weapons instead of department issued firearms.
Doc. #278: Motion in Limine. Motion denied.
Doc. #276: Motion in Limine re Daubert hearing. Motion granted.
Doc. #116: Motion for specific production re Officer Butch Jones. Motion denied.

3/22/22: Defendant's request for production-Ozark PD on duty. Requests OPD to produce & permit defense counsel to analyze, inspect & copy or photograph any & all documents, to include run reports & recordings of all OPD personnel on duty during 1st & 2nd shift on or about 3/21/22. (Claims of witness harassment by OPD).

3/23/22 Update: Motion for discovery/production filed by defense hearing set on 4/7/22 @ 1:30pm.

4/5/22 Update: Defense attorneys don’t want a jury to see the interrogation of McCraney that took place after Ozark police arrested him, but before they formally charged him in the cold case shootings of two Dothan coeds. They claim investigators repeatedly denied McCraney his constitutional right to an attorney & questioned him for 27 hours, while holding him in a small room at the police dept. “In a three-minute period, the Defendant requested an attorney on eight different occasions & on the eighth time even asked for a specific attorney,” according to a suppression motion filed in Dale County Circuit Court. That motion filed Monday does not specify what McCraney told investigators, though sources say he denied knowing J.B. Beasley & Tracie Hawlett. The police interrogation is likely a key cog in the prosecution’s case & the Dale County Assistant District Attorney David Emery will almost certainly oppose the motion. Dale County Circuit Judge William Filmore will consider their suppression motion in May, when McCraney’s trial is scheduled. Other motions filed: 1. Request for production for all documentation regarding the Mazda 929 that was J.B.’s & they were eventually discovered in. 2. A motion for a delay of time to allow for a jury list investigation. The jury list will not be available for review until next week. This motion was handled today & denied by the Judge. 3. Motion for individual & sequestered Voir Dire. Basically the defense wants to interview the potential jurors individually instead of being questioned as a group. 4. Motion for production of information, data, photos, etc. for all unmarked cars used by the Ozark Police between July 24, 1999 & August 7, 1999. 5. Motion for production of a police interview of Rena Crumb by a then Lt. Tommy Merrit & (ofc?) Sam Pickett. 6. In addition there is a subpoena request by the defense for John (Jon) Carroll. As a refresher, Carroll was the publisher of the Henry County Reporter, an online blog which originally brought public the allegations by Rena Crumb of a police connection, involvement or direct culpability in the murders of Tracy Hawlett & J.B. Beasley.
4/7/22 Update: There has been a last-minute delay in the hearing for McCraney. “The State of Alabama & the defendant notifies the court that these cases will not be ready for trial on 5/2/22,” Dale County Assistant District Attorney David Emery & Defense Attorney David Harrison said in a joint court motion. They don’t specify reasons for the delay. His trial scheduled for 5/2/22 has been pushed until 8/15/22, with jury selection beginning a week earlier, 8/8/22.
4/7/22 Update: Judge denied dismal of charges. A hearing on 7/21/22 regarding a motion to quash (suppress/cancel) a subpoena for John Carroll. This is a subpoena request by the Defense. The motion to quash was filed by John Carroll. 7/8/22 Update: Subpoenas filed for 5 people (see post #558 for more info). And other last minute motions will be addressed.
7/12/22 Update: Four additional subpoenas filed by defense: Cody Evans (OPD), Keith Cauthen (prior OPD), Kelly Parker (Manager Alabama Power) & Monica Thomas (Executive Assistant OPD Since 1992). 7/12/22 Update: Subpoena filed: Larry Bell. 7/13/22 Update: Subpoena filed: Kathy Richert. 7/14/22 Update: Subpoenas filed for: Henry Danzey, Doug Hoffman, Charles Bravaia & Jay Eric Colher. 7/15/22 Update: Motion to withdraw previous motion to quash the subpoena directed to him from defendant by John B. Carroll.
7/19/22 Update: Due to conflict of the Court, motion hearing is continued to 7/28/22 @ 9am. Subpoenas for Jodi Enfinger/Medical records, Barry Tucker, Janna Hare McClung & Ray Owens. 7/26/22: Subpoenas served: Mike Roberts, Wade Williams, Jeffrey Scarbraugh, Cecil Condrey, Marilyn Lee, Mariel Clark, Mary Campbell, Carol Roberts, Dr. Gregory Wagmer, Chief Marlos Walker, Larry Minton, Joe Sexton. Witness subpoenas served: Stephen Crumb, Eddie Henderson, Keith Cauthen, Rex Tipton, Larry Minton, Stephen Crumb, Butch Whittington. Subpoenas served by Sheriff: David Collier, Daniel Collier, Herman Jackson, Alice Jackson, Hannah Adams, PA, Chris Harper, Tracy Gilland Shillabeer. Subpoenas served: Dr. Tamara Marsh. Subpoenas served by Sheriff: Olivia Stacy, Boyd Fuller, Debbie Fuller Clark, Jerry Gissendanner & Lorine Gissendanner.

Todays pretrial hearing did not hold a lot of surprises. The defense suppression motion to exclude Mcraney’s police statement denying he knew the girls/victims was denied.
There was a discussion regarding the now destroyed Mazda car that both girls were found in. It did not seem to influence the Judge as he took it under consideration but no action.

There was discussion regarding the number of alternative jurors as a Covid precaution. That has yet to be worked out prior to trial.

Jury selection is set for August 8, however there will be an additional pre-trial hearing on August 4th to finalize any last details.

It was mostly uneventful. No surprises from what I saw. There were a few new subpoena filings late yesterday that showed on Alacourt. If I notice anything that seems significant I will post again by the weekend.

Justice on my friends!!! Remember, nobody can keep you from uncovering the truth unless you let them.

Here is the local television link to today’s proceeding. A little more colorful than my version.

Have a great weekend my friends

Good Saturday my Friends

Without surprise the defense counsel filed a motion late yesterday requesting evidence and testimony to be admitted that person(s) other the defendant committed the murders. It was followed by a Judical order for this motion to be heard on the pre-scheduled hearing August the 4th.
This may seem like a “ a no brainer” to many of those watching this case, but it very much a necessity. Both the State and Defense counsel are fighting hard to include their evidence while excluding that of the opposing counsel. This is to be expected. After all, the judge has ordered that he will scrutinize all evidence and testimony presented by both sides in the case before allowing to be presented during actual trial. Neither side wants surprise shots by the other side.

I have attached both Motion and order for your review. I have also attached a copy Alabama Criminal Rule 18.4 regarding jury selection that you may find of particular interest. There is a portion regarding Ala.Code 1975, § 12-16-152 that I have circled that has a strong bearing on jury selection which is not to the advantage of the defendant.

Enjoy your weekend my friends

Well friends, tonight is the 23rd anniversary of this heinous crime.

Always praying for justice. Sooner rather than later.

Thank you all for sticking with this. More thanks that one can put into just words.
