Padilla Deposition Next Week In Casey Anthony's Civil Case Postponed Until May

Meanwhile, Padilla said his deposition next week in Casey Anthony's civil case has been postponed until May. Gonzalez's attorney, John Morgan, wants to depose Casey Anthony's parents, George and Cindy Anthony, prior to deposing the bounty hunter, according to Padilla.

Gonzalez, who shares the same name as the woman Casey Anthony said she left Caylee with before they vanished, filed a defamation lawsuit against Casey Anthony, saying she lost her job and her reputation was ruined because she was linked to the case.
Gonzalez is seeking $15,000 in damages.

- New documents released Friday shed light on who Caylee&#8217;s father may be. For the first time we're hearing from this woman named Melina Calbrese. In an interview with Orange County Sheriff&#8217;s Office Captain Yuri Melich on October 9, 2008, she says she's been close friends with Casey since middle school.

Melina says she thought Caylee's father was Jessie Grund, Casey&#8217;s former fiancé, until the couple broke up. By then Caylee was 9 months old. Calabrese says that's when Casey told her Caylee's father is "a really hot guy" named Josh from Georgia who she met at Universal Studios. Calabrese says Casey had a one night stand with josh at a hotel near universal studios and caylee was conceived. Josh had a girlfriend he was planning on marrying and already had a child.

Casey Anthony told Calabrese the same story she told her mother.caylee's father is dead, killed in a car accident around the time of caylee's second birthday.

Casey did have a rest in peace memorial to a guy named Josh on her facebook page. But Josh was not from Georgia. Fox 35 did find an obituary for a "Josh". At this point we're still not sure who Caylee's dad is. In sworn testimony last month Casey&#8217;s brother lee told lawyers he didn't know with 100 percent certainty who Caylee's dad was and neither do investigators.

Six months of searching culminates when skeletal remains found in a heavily wooded area just 15 houses from the Anthonys` home confirmed to be Caylee, manner of death homicide. A utility meter reader stumbles on a tiny human skeleton, including a skull covered in light-colored hair, the killer placing a heart-shaped sticker directly over the mouth, then triple-bagging little Caylee like she`s trash.

Bombshell. Inside the tot mom murder investigation, literally hundreds of secret police files just released. What do we learn? E- mails, text messages, crime scene reports, evidence forms, cell phone records and scores of interviews. We learn friends say tot mom high on pot, changing her story over and over and over as to who Caylee`s biological father was, and stealing, stealing thousands, not just stealing from friends but from close blood relatives, including a grandfather in a nursing home. Why? To support her free-loading party girl lifestyle.

And torpedo to the defense, official court phone records confirming no calls -- no calls -- to or from the so-called nanny who tot mom says kidnapped Caylee in broad daylight in a public park. The files confirm grandmother Cindy distressed, confiding to co-workers about the dead body smell in tot mom`s car. But instead of calling police, she gives tot mom, quote, "a chance to explain."

Tonight: What was the Anthonys` private eye`s explanation to police why he was caught on video digging in that wooded area long before Caylee`s remains discovered in the same spot? Was he tipped off? And if so, by whom? But even though these documents rip the lid off the tot mom`s house of cards, she`s not worried, ordering up even more beauty products, expensive bottled water, roasted chicken, Mexican food, chocolates, all to enjoy in her private jail cell.

So what would a bounty hunter do with a slice of Florida woods wedged into a residential neighborhood?
He wants it to be a memorial for Caylee.
"I'd let the people decide what they want put there," Padilla said.

Already, people have created and placed oversized signs and displays on the side of the road that spills into the woods. One large sign says "IN MEMORY OF CAYLEE." The signs are covered with hand-written notes left by visitors.

Neighbors aren't likely to applaud Padilla's idea to buy the land and turn it into a permanent memorial.
Attorney Karen Wonsetler, who represents the Chickasaw Oaks Phase Three Homeowners Association, said the community is "absolutely against" the bounty hunter's plans.
"If we have a shrine literally in the middle of our association, it's going to encourage unwanted traffic, unwanted attention," she said. "We do not want this."
Orange County officials say they have no plans to remove the memorial, which is on private property.

Casey Anthony case: Her grandmother's words are haunting

The insights from Casey Anthony's maternal grandmother are disturbing.
NBC's "Today" this morning highlighted those words and the Anthony family tensions. Grandmother Shirley Plesea told investigators,"I just wonder if she [Casey] hated her mom more than she loved Caylee."

Casey Anthony is charged with Caylee's murder. Her defense team says it will not respond to this information, released by the state last week, until her trial begins in the fall.

NBC reporter Kerry Sanders looked back at the time when Cindy Anthony, Casey's mom, was giving daily interviews. Plesea proved prophetic. "Cindy's out of control for one reason," Plesea told investigators. "If Cindy doesn't believe Casey, then Caylee's dead. Honest to God, that's my feeling."

How to make Case talk? Put her in the general jail population, Plesea said -- a comment that many readers have suggested.

A defense expert also said Jose Baez, Casey Anthony's attorney, is painting himself and his client in to a corner by saying she is "innocent" rather than "not guilty."
Casey Anthony text messaged and made cell phone calls frequently. That's why a legal expert said it's damaging to her alibi that she had no record of phone calls or text messages to anyone named Zenaida or Zanny.

Criminal defense attorney Richard Hornsby said that fact will make it more difficult to convince a jury that a babysitter named Zenaida Gonzalez or Zanny took Caylee. In addition, no one in Casey Anthony's family recalls seeing this woman.
"How can you have a Nanny that's taking care of your child and you seem to have constant contact with your family and no one's seen her? It just defies logic,"

Hornsby said Baez is creating problems for himself by continually claiming Casey is "innocent" rather than "not guilty."
"When you say my client's innocent, you're assuming a burden that you're going to show a jury why she's innocent," Hornsby said.

With the amount of evidence against Casey Anthony, Hornsby said Baez should concentrate on creating enough reasonable doubt for a "not guilty" verdict.

Meanwhile, a pair of private eyes who at one time worked for George and Cindy Anthony are scheduled to give depositions this week in the Zenaida Gonzalez civil suit.
On Wednesday, James Hoover and Dominic Casey are due to give sworn testimony at the offices of Gonzalez's lawyers.

The bounty hunter who loves to talk will have to wait to be interviewed under oath in Casey Anthony's defamation case.

Leonard Padilla said he'll be questioned under oath for the civil case in May after her parents are interviewed by attorneys.
Padilla was going to be questioned on Wednesday – an interview scheduled months ago by attorneys for Zenaida Gonzalez, the 38-year-old Kissimmee woman suing Anthony.

He said he's not fighting the deposition but attorneys wanted to talk to him after they speak with Anthony's parents, George Anthony and Cindy Anthony. Their depositions are set for next month at the office of Morgan & Morgan law firm.
Later this week, private investigators Dominic Casey and Jim Hoover are scheduled to be questioned at the law office.

Casey Anthony case: WESH asks how she's funding defense team

If she's doing it with stolen money, that would illegal, WESH-Channel 2's Bob Kealing noted in a thoughtful report tonight. Casey Anthony is charged with the first-degree murder of her daughter, Caylee.
WESH reminded viewers of Anthony's dismal financial history: She was unemployed. She is accused of stealing money from a friend. Her grandmother revealed that Anthony could have made $45,000 in unauthorized charges on her parents' credit cards.

Kealing turned to Richard Hornsby, a criminal defense expert, to help explain the issue. "A person can't go steal from a bank and then use that same money to hire the best attorney to represent them," Hornsby said, sounding incredulous.

Kealing asked more questions as he recounted the history. Anthony hired attorney Jose Baez and paid him upfront. But how did she do it?

In a sworn affidavit, Anthony has said Baez has no right to sell her story or that of her daughter. The state has filed a motion to learn if Baez has made any deals that could be a conflict of interest in representing his client.
Baez has said he has no entertainment deals in the works related to the case. Baez also has called the state's action a witch hunt. Prosecutors fear a deal could lead to a verdict being overturned on appeal, Kealing said.

Baez's spokeswoman has acknowledged that Anthony has sold licensing rights to photos and video.

Anthony's affidavit is basically worthless, Hornsby said. "It doesn't address the issues that the state is concerned about," he added. "Who is paying Jose Baez? And is whoever's paying Jose Baez affecting how he's handling her case? There is no doubt all of this needs to be revealed."

A hearing is set for Wednesday morning to determine whether Casey Anthony will have to reveal how she is paying for her defense.

Orange Circuit Court Judge Stan Strickland will hear arguments from prosecutors on why Casey Anthony needs to disclose the information. They contend the 23-year-old could only afford her high-powered legal team by selling photos or videotapes relating to the story of the disappearance and death of her daughter, Caylee Marie.

Casey Anthony is charged with first-degree murder.
Her attorney, Jose Baez, is managing her assets, prosecutors wrote in their motion, and he could have a conflict of interest.

In court papers, Baez fired back with objections to the prosecutors' assumption. He wrote the state wants to "harass and embarrass" the defense team. He has no conflict of interest and no rights to his client's story, according to the paperwork.

Circuit Court Judge Stan Strickland will hear a motion from the state at 10:30 a.m. Wednesday in courtroom 23 in the county courthouse in Orlando. WESH.com is planning to stream the hearing live.
The hearing is on a motion to determine whether Anthony has a conflict of interest. Prosecutors want to know if her main defense attorney, Jose Baez, has been selling the story of Casey and Caylee Anthony.

Also on Tuesday, the state released a list of about 250 names of potential witnesses in the case. The list is an updated version of one that was released earlier by prosecutors.

Cindy Anthony remained silent as her husband weighed in on the controversy surrounding what to do with the land along Suburban Drive. It's home to the Caylee memorial and currently up for sale.
"This is the kind of tribute I would rather see, not down at the end of the street. I think that's great, don't get me wrong," George Anthony said
The Anthonys also said they would like to see a park where children can play as the permanent memorial to Caylee.

Racy party photos of Casey Anthony surface

Racy photos of a scantily-clad Casey Anthony surfaced online today -- and she appears to be kissing a woman at a costume party.

RadarOnline.com states the exclusive photos are from a Halloween party in 2006. Anthony is dressed as a "sexy casino waitress" in about a dozen pics.
RadarOnline is a joint venture between two companies, including American Media Inc., which owns the National Enquirer and Star magazine.

A Sentinel reporter e-mailed the company to see if it paid for the Anthony photos, but has not received a response.

Casey Anthony's family says questions over how she's paying for her defense have been a distraction to her case, WESH-Channel 2 reported this afternoon.

"The defense needs to get on with defending their client," said Brad Conway, attorney for Anthony's parents. The money issue "takes away from everything that really needs to be done in order to defend her," he told WESH's Bob Kealing.

A hearing at 10:30 a.m. Wednesday will examine the funding controversy. Casey Anthony is charged with the first-degree murder of her daughter, Caylee. Prosecutors fear that if Jose Baez, Casey Anthony's attorney, has a conflict of interest on the money issue, that problem could pave the way for an appeal.

In another legal victory for Casey Anthony's defense team, Judge Stan Strickland ruled Wednesday there is no conflict of interest in Jose Baez serving as Casey's attorney.
Casey was in court wearing a long-sleeve purple shirt and blue pants. George and Cindy Anthony were also present at the 10:30am hearing, along with their attorney, Brad Conway.

"It's come up, so I have to deal with it," Judge Stan Strickland said Wednesday in court. "I'm going to make a couple of inquiries ... part of this is just to protect your client."
Attorney Jose Baez argued that any inquiries be made "in camera," a legal term for in private.
"I have to determine whether a conflict or not exists," the judge said. "She can either waive the conflict or say she wants a new lawyer."
The judge then asked Baez to assert that it's true that nothing is be sold.
Baez asserted his statements to the judge and denied any literary rights exist.

Judge Stickland then swore in Casey Anthony to discuss the affidavit that was filed. She said all the items in her sworn affidavit are true.

Then, after a brief recession while the judge and attorneys met in private to discuss matter, the judge made his ruling.
"As far as I'm concerned, the matter has been resolved," Judge Strickland said. "I'm convinced, as we sit here today, that no conflict exists. I think we've covered the bases. The court is not going to issue an order per se. this was just a motion to determine if a conflict existed."

Also Wednesday, lawyers for Zenaida Gonzalez will question the Anthony family's two private investigators in the civil case against Casey Anthony.

Judge Stan Strickland made his decision after a short hearing in open court and a brief private meeting to discuss details of Anthony's retainer agreements with her attorneys.
Anthony's attorney Jose Baez asked for the meeting in chambers, and Strickland agreed. They departed the courtroom about 11 a.m., after a half hour in open court and returned after about 5 minutes.

Strickland said "no conflict exists."

During a brief exchange with Strickland, Casey Anthony confirmed details from an affidavit she signed earlier that said she has no agreement to sell her or her daughter Caylee's story.
In a written statement, Jose Baez, who is Casey Anthony's attorney, said the state is trying to harass and embarrass the defense team.
According to Baez, he has no conflict of interest and no rights to his client's story.
