Hearing rescheduled /Baez Motion regarding the release of the Infirmary Video

ORLANDO, Fla. (WOFL FOX 35) - A May 7 motion hearing in the Anthony case has been rescheduled.

Circuit Court Judge Stan Strickland was set to hear an emergency motion for protective order on that date. Casey Anthony’s defense attorney, Jose Baez, originally filed the motion on March 11.

The hearing has been rescheduled for May 28 at 10 a.m.

In an exclusive interview with Early Show co-anchor Maggie Rodriguez Wednesday, Cindi and George Anthony said they don't think Casey should accept a plea deal, even though prosecutors just announced they're going to seek the death penalty in the case.

Why, Rodriguez wanted to know, did Cindy tell authorities Casey's car smelled like a dead body had been in it?

To that Cindy and George's lawyer replied, "Maggie, those are issues that are going to come up at trial. And they're anxiously awaiting that. And there's been so much pretrial publicity that's going to affect the ultimate outcome and her ability to get a fair trial. So the questions that have to do with the statements that they gave, they want to wait and tell the truth in front of a jury and let a jury decide."

Casey's mother, Cindy Anthony, left the message for Sgt. John Allen, one of the lead detectives in the case, in July 2008. In the message, Cindy Anthony tried to emphasize that she was trying to help the investigation (listen to message).

"I'm very sorry, because I've been more bent over backwards than anybody else in this investigation," Cindy Anthony said. "Casey had to have help, no matter what the scenario might be, so there are people who know that information."

George and Cindy Anthony stayed calm during the live network interview, but dodged key questions about Casey.

"We're gonna have to wait and see what plays out," said George.

The Anthonys were told it doesn't look good for Casey. With all the evidence, including the duct tape over Caylee's mouth and topped with a heart sticker.

They were asked whether they would want punishment for Caylee's killer, even if it's Casey.

"Again, we want the truth, but again, we have to wait for everything to come out at trial," replied Cindy.

Cindy Anthony said that her daughter didn't tell authorities when the child disappeared in June because she was "afraid."

"I think the truth will come out at trial," said Cindy Anthony.

George Anthony also talked Wednesday about his emotional difficulties since Caylee's body was found.

George and Cindy will be the keynote speakers at the Melanie Ilene Rieger's memorial conference next month in Connecticut.

"To me, this whole thing with the Anthonys, it's like a big circus and George and Cindy are the ringmasters," said Fielding.

Rieger was a college student who was murdered by her boyfriend in 1994. The conference is meant to help the families of murder victims.

George says wants to be a victim's advocate, helping the families of missing or murdered loved ones in Caylee's memory.

However, some advocates are offended by his actions because someone is already under arrest for Caylee's murder. Many of those victim advocates said they don't want his help.

They say the Anthonys have damaged the progress made for victims' rights and for missing person's cases.

Claire fielding's daughter Debra was kidnapped, raped and murdered in April of 2000 in downtown Orlando. She and others believe what brought Caylee here is very different and that George and Cindy Anthony knew that from the beginning.

ORANGE COUNTY, Fla. -- Another person involved in the case against Casey is fighting a request filed by Casey Anthony's attorney.

Jose Baez filed a motion (read Baez motion) weeks ago asking a judge to order several people including Amy Huizenga, Casey's former best friend, to turn over all of their cell phone and internet records.

However, Huizenga's lawyer filed paperwork (read objection motion) to fight the request.

Baez and other attorneys interviewed by WESH 2 said the woods where Caylee's remains were discovered are a central place in which much of the case could revolve.

Caylee was missing almost six months before her body was found. And, Baez said, "They don't know how Caylee passed away. They don't know when Caylee passed away,"

Baez and other defense attorneys say prosecutors have not definitively tied Casey Anthony to Caylee's remains along Suburban Drive. They have to prove that Casey dumped the body there before entering state custody and that they remained there for almost six months.

"That's going to become one of the major battlegrounds in the case," said defense attorney Richard Hornsby.
 
BAEZ CAN ASK THE STATE TO PAY FOR HER DEFENSE

Baez has the right to argue w/the State to pay for some of the Defense. It wouldn't cover the attny fees, but would cover the 'experts' who will have to accept the State's guideline fees, if approved by the State.

Cindy tells WKMG she canceled on Oprah Winfrey because of integrity -- yes, you read that right

The law firm representing Zenaida Gonzalez in a defamation lawsuit against Casey wants a judge to force Cindy Anthony to answer more questions and to pay for their costs.

Friday, the law firm filed a motion to compel Cindy Anthony to answer whether Casey ever used Cindy's credit cards without her permission.

On May 5, Casey's lawyer is scheduled to question a jail guard who was with Casey the day she learned her daughter's remains had been found.

There is a videotape of that moment, but it hasn't been released.

Casey will go to court with her attorney, on May 28. They're asking the court to make sure the public never sees the tape.

The State Attorney's Office is expected to release hundreds of pages of documents Friday in the case against Casey Anthony.

The investigative documents will include law enforcement interviews with witnesses and lab reports.
 
Wooded lot that held Caylee Anthony's remains still for sale

The property, on Suburban Drive in east Orange County, is not under contract, Realtor Tina Martin stated in an e-mail.

Martin said the property may possibly be marketed on eBay in the near future.

She requests only interested potential buyers contact their office. Martin also said the memorial that has been created on the land may be addressed as the potential buyer desires.
