A trial date was set on Thursday for Misty Croslin. Croslin is facing drug charges in Putnam County. The trial on those charges will start Aug. 23. Her pretrial hearing is scheduled on Aug. 10.

Croslin&#8217;s brother, Hank &#8220;Tommy&#8221; Croslin, was also in court Thursday. He entered a no-contest plea on several charges and will be back in court on July 6. A sentencing date has yet to be set.

Misty Croslin, a central figure in the case of missing HaLeigh Cummings, was told Thursday in Putnam County court that she has until mid-August to make a deal with prosecutors in seven drug-trafficking cases that could send her to prison for decades. Croslin, who called authorities the night the 5-year-old went missing, appeared before Judge Terry LaRue ahead of her brother. Hank "Tommy" Croslin Jr., 23, pleaded no contest to trafficking and possession and will be sentenced this summer.

After four months in jail, the siblings are now closer to prison terms that are governed by minimum mandatory sentences that some say give prosecutors undue control over cases because of a judge's limited discretion to waiver. One of the few ways for judges to deviate from minimum mandatory sentences is when a defendant gives substantial assistance in another case.

The seven trafficking prescription drug charges faced by Misty Croslin, 18, come with minimum sentences of as much as 25 years, depending on the amount of drugs sold, if she is found guilty. She also faces an eighth trafficking charge in St. Johns County. On Thursday, the judge set a trial for Aug. 23 on the Putnam cases. Croslin has a "last chance plea date" of Aug. 16 to work out an agreement with prosecutors, LaRue said.

In a dark blue jail jumpsuit and with her hair braided tightly to her head, she spoke softly to the judge and signed notices for each of the seven counts. Her parents sat in the courtroom and later said it was upsetting to see the two brought into court. "I about went into a panic attack," their father, Hank Croslin Sr., said. He said he doesn't think Misty deserved all that. Her attorney, Robert Fields, said recently that a plea deal was not being considered. "We're not in the business of giving up," he said. Fields has said Croslin has been cooperating with detectives about HaLeigh and said it is reasonable to believe pressure to resolve that case will affect the drug outcomes. The Satsuma kindergartner disappeared while in the care of Croslin, who was dating HaLeigh's father Ronald Cummings.

Minimum mandatory sentences give prosecutors significant clout, said Deborah Fleischaker of Families Against Mandatory Minimums, a national organization working to repeal the measures. Selling pills with a total weight of half a Hershey's bar is enough to mandate a 25-year sentence, she said. "It shifts the balance of power away from the courts to the prosecutor," she said. Prosecutors not only have discretion in picking charges, but also are able to set the terms of the sentence, she said. "The minimum mandatory brings an enormous amount of pressure to bear on the defendant because they have huge sentences looming," she said. Information in one case can be used in a sentencing deal in another, she said.

Croslin's brother was charged with possession of hydrocodone in November when he was found passed out in a van. He was later arrested in the undercover operation with the others. He pleaded no contest to those charges Thursday and, under sentencing guidelines, faces a minimum of three years in prison. The judge could up that to 44 months or sentence him to a maximum of 30 years. By July 6, a date will be set for a sentencing hearing.

James Werter, the attorney for Croslin Jr., said his client has not agreed to testify for the state when Misty Croslin goes to trial. "There's no deals on the table," he said. Werter said prosecutors have been using the possibility of maximum sentences to shake those involved in the case. "They just want to hang everybody and blast everybody," he said. The State Attorney's Office would not comment directly on the cases, but prosecutors do use sentencing guidelines, State Attorney R.J. Larizza said in a statement from his office. "Minimum mandatory sentences are the law, and my office will enforce those laws as necessary to protect the citizens from dangerous, violent and career criminals," the statement said.

The trial on a single drug-trafficking charge against Misty Croslin in St. Johns County has been set for August but will likely be reset before then, her attorney said following a hearing this afternoon.

Today an Aug. 23 trial date was set in the St. Johns County case. The same date was set last week for her trial on seven trafficking charges in Putnam County.

Croslin's attorney, Robert Fields, said he is waiting on evidence analysis from the Florida Department of Law Enforcement and said he expects to ask later for a change in the St. Johns date.

Lawyers moved closer on Tuesday to negotiating a plea deal for the father of missing 5-year-old Haleigh Cummings.
The deal would have Cummings plead guilty to three lesser charges.
The two more serious charges would be dropped.

Even with the plea deal, Cummings would face 15 years in jail.

Haleigh Cummings' grandmother says she doesn't believe what Misty Croslin has told investigators about the night the Putnam County girl vanished in February 2009, news4jax.com is reporting.

Haleigh's grandmother, Teresa Neves, said Croslin's allegation that her cousin, Joe Overstreet, put the screaming girl in a bag and took her away, sounds like a lie.

"How could a 5-year-old scream like that and neighbors not hear? It just doesn't add up."

Donna Brock, a friend of Misty Croslin, told the judge that she only participated in selling the drugs so that she could get Misty to open up to her about the disappearance of 5 year-old Haleigh.

The judge asked her why she didn't just tell police what she was doing and she said she didn't know.

Brock was sentenced to 15 years in jail and $100,000 fine.

PUTNAM COUNTY, Fla. -- In hours, Ronald Cummings, the father of Haleigh Cummings goes before a judge in Putnam County.

Ronald pleaded guilty to three counts of drug trafficking Hydrocodone in July and will be sentenced Friday. Two of the three counts carry a minimum sentence of 15 years.

Ronald's attorney hopes he can serve three sentences- concurrently- for a total of 15 year in prison.

Ronald Cummings, the father of missing North Florida child Haleigh Cummings, was sentenced to 15 years in prison and ordered to pay $250,000 in fines today in connection with his drug- trafficking case, prosecutors said.

Two trafficking counts were dropped as part of Cummings' plea agreement and he has agreed to "provide truthful testimony" in future cases, including the one involving his daughter's disappearance, said Christopher Kelly, assistant state attorney and spokesman with the 7th Circuit State Attorney's Office.



*Misty Croslin has 2 tentative sentencing dates: Oct. 4 and Oct. 8
for six counts of trafficking in hydrocodone and two counts of trafficking in oxycodone.

On Friday, Misty will be sentenced on one count of trafficking in oxycodone in St. Johns County, facing a maximum penalty of 25 years in prison.

She still faces sentencing on seven counts of drug trafficking in Putnam County, where she could face up to 200 years. That hearing is set for Oct. 19.

Prosecutors said she could qualify for a reduced sentence as a youthful offender, since she was 17 at the time of the crime, which could reduce her sentence to between six and 25 years.

Misty Croslin Cummings, the 18-year-old who was the last person to see Haleigh Cummings before the girl disappeared in February 2009, was sentenced Friday afternoon to 25 years in prison on a drug trafficking charge in St. Johns County.

Prosecutors said she could qualify for a reduced sentence as a youthful offender, since she was 17 at the time of the crime, which could reduce her sentence to between six and 25 years.

Misty was in tears as she heard she received the maximum penalty for the charge.

PALATKA, Fla. -- Misty Croslin, the teenager who was the last person to see 5-year-old Haleigh Cummings before the girl disappeared in February 2009, has been sentenced to 25 years on drug charges from Putnam County.

The time will be served concurrently with the 25-year sentence she is already serving on a St. Johns County conviction of trafficking in oxycodone.

In addition to the prison time, Croslin will receive five years of probation, a $1.25 million fine and mandatory drug rehabilitation.

PUTNAM COUNTY, Fla. -- Misty Croslin has received another 25-year prison sentence for the seven drug charges to which she entered a guilty plea.

In October, Croslin received a 25-year sentence on similar charges in St. Johns County, and today's sentence in Putnam County will run concurrently.

She entered a no-contest plea to the seven drug-related charges stemming from her arrest.

A "landslide of information" against her led her attorney, Robert Fields, to a plea rather than face a trial.
