THE father of Brookfield mother Allison Baden-Clay is seeking to take control of her estate from husband Gerard, who is in custody waiting to face a committal hearing on a murder charge.
The Brisbane Supreme Court will on Wednesday hear an application by Geoffrey James Dickie to take over his late daughter's estate, collect and protect her assets and pay the debts of the estate.

THE father of Brookfield mother Allison Baden-Clay has been given an interim order to take control of her estate from her husband Gerard.
Justice Glenn Martin on Wednesday ordered Allison's father, Geoffrey James Dickie, be appointed as administrator of her estate until such time as Gerard is found either guilty or innocent of his wife's murder.

AN investment property bought for murdered Brookfield mother Allison Baden-Clay and her brother Ashley has been secretly sold by her husband, accused murderer Gerard Baden-Clay.
The Gold Coast home jointly owned by the siblings and their partners was held in the name of World of Top Step Pty Ltd, the company owned by the Baden-Clays.

From his prison cell at Arthur Gorrie Correctional Centre, Baden-Clay wrote to the Australian Securities and Investments Commission advising his wife was no longer alive, making him sole director and secretary of the business, according to documents lodged in the Supreme Court.

UPDATE: The father of murdered mother Allison Baden-Clay has succeeded in his last-minute attempt to stop the man accused of killing his late daughter from selling off assets Allison has a share in.

Supreme Court Justice Glenn Martin appointed Geoffrey James Dickie temporary control of Allison's estate on Wednesday, 10 days before a property partly-owned by Allison was to go under the hammer.

THE secret sale of an investment property bought for Allison Baden-Clay and her brother cannot be stopped by her family despite father Geoff Dickie being appointed administrator of her estate.
The Courier-Mail revealed yesterday that Mrs Baden-Clay's husband, Gerard, who is accused of her murder, secretly sold the Gold Coast nest egg from his prison cell at Arthur Gorrie Correctional Centre.

It's understood he legally did this by writing to the Australian Securities and Investments Commission and advising them that his wife was no longer alive, making him sole director of the company World of Top Step Pty Ltd, which owned the property.

Baden-Clay said in court documents lodged in the Supreme Court earlier this year that: "In essence, Allison and I jointly own the property with her brother and his wife."

Baden-Clay brief of evidence complete.

ALL 466 statements in the murder case against Gerard Baden-Clay have now been finalised, a court has heard.

Lawyers for the accused wife killer appeared before the Brisbane Magistrates Court today where it was revealed the brief of evidence is now complete and five outstanding statements have been handed in.

They were an autopsy report, a forensic computer analysis report, a financial analysis report, a hydrology report and principal investigators' statements.

The matter will return to court on November 5 for a mention and again on November 20 when applications will be made for the cross examining of witnesses.

Battle over Gerard Baden-Clay insurance payout.

GERARD Baden-Clay has been denied access to his late wife's life insurance payout after Suncorp this week moved to have the funds frozen as he awaits trial for her murder.

The Courier-Mail understands the 42-year-old, who was charged in June with wife Allison's murder, was supposed to receive almost $350,000 from her life insurance and superannuation policy, but the insurance giant applied to the Federal Court to determine whether he should get the money under the circumstances.

Federal Court documents state that Suncorp met its obligation to pay out the policy, but rather than give it to Baden-Clay, it requested the money be held by the court "pending determination" of the rightful recipient. Suncorp also asked for "a declaration as to the person or persons entitled to the proceeds of the policy".

Husband's murder trial will determine access to Baden-Clay's payout

TWO weeks before Allison Baden-Clay was allegedly murdered, her life insurer sent a letter to the cash-strapped household warning that her bill had not been paid and her policy was in danger of being cancelled.
Earlier, the company had written to the 43-year-old mother of three checking whether she wanted her prestige real estate agent husband, Gerard Baden-Clay, to remain as the sole beneficiary of the policy, worth $347,287.50.

The details have emerged in affidavits filed to the Federal Court by Suncorp Life and Superannuation Limited, which this week succeeded in stopping Mr Baden-Clay from touching his late wife's insurance payout until after his trial for her murder.

An affidavit sworn by John Kraszula, Suncorp's executive manager of underwriting and claims, said Baden-Clay's life insurance policy was taken out on March 11, 2008, with her husband the sole nominated beneficiary.

Mr Kraszula said Suncorp wrote to her on February 13 asking whether she wanted to change that, but had no reply.

Another letter, sent on April 6, warned Baden-Clay a premium of $1110.95 was overdue. Her policy would be cancelled and cover would cease if the bill was not paid by 4pm on May 19.

In his affidavit, Mr Kraszula does not say whether the bill was paid. However, he described being told by his staff that police were investigating Baden-Clay's disappearance, and that her body was eventually found.

THE case against accused wife-killer Gerard Baden-Clay is set to return to the Brisbane Magistrates Court on Monday.
Baden-Clay, a 42-year-old real estate agent charged with the murder of his wife Alison in April, is not required to attend the hearing.

Prosecutor Danny Boyle asked for the further mention after disclosing lawyers would require some time to discuss which witnesses should be cross-examined because of a "voluminous'' brief of evidence.

Baden-Clay's solicitor Darren Mahony was not available on Sunday to discuss the case. He had earlier said the witness list should be largely resolved by consent prior to the compiling of "quite detailed submissions".

The prosecution says there are 466 statements making up its full brief against Baden-Clay, including five key statements most recently presented to the defence.

More than 450 witnesses in Baden-Clay murder case

There are 473 witnesses involved in the case against accused murderer Gerard Baden-Clay, a court has heard.

But Mr Baden-Clay's defence team is only interested in cross-examining at least 35 witnesses during his committal hearing.

At a brief mention of Mr Baden-Clay's case in the Brisbane Magistrates Court today, his solicitor Darren Mahony said there had been "substantial progress" between both parties in discussions about the cross-examination of 35 witnesses.

"We need to resolve the scope [of questioning] in about 20 of those 35," Mr Mahony said.
He said he expected to receive further correspondence from prosecutors, relating to those witnesses, this afternoon.

Mr Mahony also said he was confident negotiations to cross-examine a further 10 witnesses would be resolved before the matter was mentioned again next week.

Lawyers for Gerard Baden-Clay have lodged a new bail application in the Brisbane Supreme Court

ACCUSED wife killer Gerard Baden-Clay could be home for Christmas after making a fresh bid for bail.

Lawyers for Baden-Clay, who was refused bail in June over his wife Allison's murder, lodged a new bail application in the Brisbane Supreme Court yesterday.

It will be heard on December 14, meaning Baden-Clay could be released from jail if the court rules in his favour.

Prisoners denied bail in the Supreme Court have to show evidence of a change of circumstances in order to make a second bail application.

Baden-Clay's Gold Coast-based lawyer, Darren Mahony, told The Courier-Mail yesterday there were two broad grounds for the new bail application.

"We will contend that the brief of evidence does not substantiate or support all of the claims made by the prosecution during the (first) bail application," he said.

"We will also argue that evidence, not referred to on the initial bail application, exists that is inconsistent with the Crown case and/or relevant to the defence."

Mr Mahony said he could not elaborate but he and the Director of Public Prosecutions are expected to make detailed submissions to the court in the lead-up to the bail hearing.
