We have a right to a fair and 'prompt' trial.
I guess that fairly generous bail laws, and the fact that any time already served in pre-trial remand is time off your sentence, are supposed to compensate for delays.


All people have the right to a fair and prompt trial, on the basis that all citizens are considered equal before the law.

Thanks I guess it's similar. In the US they're pushed to waive the right so the public defender has more time to prepare for the trial. Otherwise they're required to try in 6 months.
 
Wow reports due next year, it's kind of hard to understand why it would take that long.
IMO, a very poor reflection on our Services - all of which has a spiralling effect
There’s been lots of criticism over the years re the operations of & delayed results from the John Tonge Centre.
Hopefully the new Gov might do something about this issue too
 
Especially the delay with pathology. Queensland Pathology have had a long time to get their act together!

December 2022 the Commission of Inquiry into DNA Testing in Queensland made 123 recommendations which were accepted by the Queensland Government. Surely nearly 2 years down the track you would think the situation would have improved!




Queensland lab at the centre of DNA testing failures allegedly beset by workplace conflicts​

Guardian Australia can reveal the state government engaged consulting companies, psychologists, mediators and lawyers in an attempt to fix long-running cultural problems at the Queensland Health forensic and scientific services facility.

Whistleblowers claim these issues existed about the same time that the lab implemented DNA testing practices that have now cast doubt over potentially thousands of criminal cases.
A commission of inquiry into forensic DNA testing in Queensland will begin public hearings this week. A preliminary report by the commissioner, the former court of appeal president Walter Sofronoff QC, concluded serious shortfalls at the state’s DNA lab, including a failure to test samples under a certain DNA threshold from 2018.

The Queensland police service has established a taskforce to re-examine thousands of major crime cases and two senior staff members have been stood down. There is no suggestion either was responsible for cultural problems or the subject of an internal complaint.”

Spartans fly back to Charleville​

“In partnership with Defence Force Recruiting (DFR), No. 35 Squadron hosted C-27J Spartan flights to regional Queensland communities throughout February, including Kingaroy, Roma and most recently Charleville.

Departing from RAAF Base Amberley, the squadron provided static displays at local airports to engage local communities and generate public awareness about ADF careers.

Squadron Leader Robert Crawford said the missions were part of an ongoing program to visit regional communities across the state.

“Charleville was one of the townships visited during Exercise Christmas Hop in December and our squadron had been looking forward to a return visit,” Squadron Leader Crawford said.

“The turnout from the community is always great and we welcome the opportunity to give people of all ages a tour around the C-27J Spartan.

“My parents lived and worked as teachers here in Charleville many years ago, so I feel a personal connection with the town. I also appreciate the rich military history that Charleville has to offer.”

Keeping in mind, QLD is not on daylight saving time.. ( for those outside AU, daylight saving time is not only lateral but horizontal in Australia, don't ask me why or how, it just is, one reason being , the sun would fade the curtains up in QLD and also, it upsets the cattle in some way , who knew steers wore watches? ).. also, he might have run out of money to launch a bail application, AND, is not eligible for legal aid, .. often legal aid is knocked back for bail apps, especially for a charge of murder, but ... anything can happen! some benefactor may rock up with a chequebook.

So QLD is an hour behind the rest of the east coast, that's NSW, VIC and TAS..
 
I emailed one of the journalists covering the story, and they have just replied. His bail application has been adjourned and no future date set at this time.
Run out of money, then. It was hopeless, anyway, even though he is entitled to apply. Still, it would have made a dent in his bank account, and added a whack to his legal bill, and all just to make a point.
