HOW WAS THIS NOT MURDER?
A WOMAN has admitted she killed her daughter. Instead of murder, her lawyers say she’s guilty of a crime no Victorian has ever been jailed for.

Infanticide law in Victoria: How is this not murder?
March 20, 2017. 1:39pm

... Queensland University of Technology forensic psychologist and lecturer Claire Ferguson explains infanticide killings:
“Often when you have infanticide with post partum psychosis there’s usually a link to the psychosis with viewing the baby as something that isn’t — seeing the baby as evil or viewing the baby as something that it isn’t.”
Dr Ferguson said in cases of infanticide mothers commonly viewed their child as a “devil” or “demon”, and believed they were somehow possessed...

So the priest told Sofina that she and Sanaya were possessed and had negative energy.
I wonder if Sofina held this belief before the priest told her so?

I just feel for little Sanaya with all she had to endure and all she could of gone on to be.

INFANTICIDE vs MURDER?

March 16, 2017. 8:40am
THE mother accused of killing her 14-month old daughter told Victoria Police a priest said her baby was possessed.

"Nikat told police she put her hand across Sanaya’s mouth and nose and hugged her tight until she couldn’t feel her daughter moving. She then walked down to the creek bed and dropped her daughter’s limp body in Darebin Creek near scrubland."...

Magistrate Luisa Bazzani upheld the murder charge, citing that the psychiatrist’s evidence had not been tested.
The case will return to Melbourne Magistrates’ Court for a directions hearing on Friday.

Did the journalist confuse the mother's religion i.e. Muslim/Christian in writing/publishing the article?
Worse, was this 'blurred' religious concept also put before our Courts?
i.e. stating that an IMAM told her that she and her child were possessed ... then referring to that position as a 'priest' told her - most likely 'blurrs the lines' in the minds of decision makers. IMHO investigators/psychologists/psychiatrists/decision makers need to be aware of fundamental cultural/religious differences in the meaning of language here and its implications for context here.
My opinion only.

I was wondering if in Fiji there was a connection with IMAM and PRIEST.
I haven't gone into it much but stumbled across this ...

Lautoka Branch[edit]

The Lautoka Brach Mosque is situated at 72 Vomo St, Drasa /Vitogo, Lautoka. The Branch is managed by a Branch Committee elected every two years. Apart from the Mosque, the branch also owns a priest's quarters, 2 other residential properties and a Madrasa which can accommodate 30 students. The branch has approximately 1200 registered and 2000 unregistered members.

In the interests of Justice for Sanaya Sahib, police investigators/psychologists/psychiatrists/decision makers need to take account that methamphetamine was allegedly found in Sanaya's hair. The source of this should be thoroughly investigated and not just 'glossed over' as it could be been 'deposited there from the water'. Hair samples from Sofina Nikat would need to be forensically examined for drug use and a drug history taken from her and others she was living with. It would be important to examine this factor as a potential contributing factor which could worsen any underlying alleged unresolved psychosis. My opinion only.

Sanaya is the victim not only of her mother but of human trafficking and religious abuse. I am disgusted this happens in Australia.

Here's a resource should you ever come across someone who has been trafficked here via marriage or has been married against their will https://www.mybluesky.org.au/

The mental state of a mother accused of murdering her 14-month-old daughter in Melbourne will be a key issue at trial, her lawyer says.

Defence barrister Christopher Dane QC says expert witnesses will be called to give evidence at her trial.
Senior crown prosecutor Kerri Judd QC expects the trial will span more than two weeks.
