Jantzen denied a defense motion filed in April to preclude overly emotional testimony, noting in his ruling that “The court will not anticipate whether any testimony and/or victim impact evidence will cause any victims or other spectators to display emotion during trial. The defendant’s anticipatory objection to an event that has not yet occurred is premature. If an objection is made at the appropriate time, the court will rule on it.”

Parks crews recently installed irrigation, plants and a decorative border around the original heart-shaped rock garden called Bella’s Garden, in honor of Isabella Grogan-Cannella, an 8-year-old Bullhead City girl who was murdered in September.

Sue Winchester, Bella’s grandmother, is the guardian of Bella’s sisters, her two brothers and one of her cousins. She built a home in Valle to house them and help other foster children as well.

“I’m getting my foster care license and it’s a place where we can make sure the kids have positive experiences,” Winchester said. “It’s also going to be a family home.”

The prosecutor in the Bullhead City murder case argued Monday to deny two defense motions.

Deputy Mohave County Attorney Greg McPhillips argued against one defense motion to allow Rector to have access to a laptop computer in his cell. The jail already provides a defendant with “reasonable computer access” to view electronic media, the prosecutor said.

McPhillips also argued against another defense motion that would allow the defense investigator to have access to interview the victims without permission from the prosecutors. Arizona law states that a defendant or his attorney can initiate contact with the victim only through the prosecutor’s office.

The victims in the murder case are Grogan-Cannella’s mother, Tania Grogan and stepfather, Ralph Folster. Another victim may possibly be Grogan-Cannella’s older sister, who was also present at the time of the alleged kidnapping.

The attorneys representing a death penalty defendant who allegedly killed a child want their client to have "unfettered" access to a laptop computer while he awaits trial in the Mohave County jail.

He would not have access to the Internet, they said.

Examples of what would be downloaded should Jantzen grant the request are crime scene photographs, medical documentation and recorded interviews, they said, as well as any mitigation evidence the defense team discovers.

They also asked that Rector be provided with earbuds or headphones to ensure privacy and even an extension cord to access power, if necessary.

Schoppmann acknowledged inmates have certain rights, particularly when it comes to pending cases, but he also said no court has ruled prisoners have a right to a personal computer. The system in place at the jail passes constitutional muster, he said.

And then there are security concerns. The laptop, its power cord and the extension cord could be used as weapons and their presence would have an unnecessary impact on the sheriff's authority to manage the jail.

Gavin had not yet filed his response to McPhillips' request by mid-afternoon Tuesday, but he acknowledged he hasn't provided Rector with the state's evidence precisely because the man can't safely review the material.

"If the state's so concerned about my client, they can drop the death penalty," said Gavin from his Mesa law office.

Gavin also acknowledged he has not had an in-person interview with Rector at the jail after being named as his new attorney in March, six months after Rector allegedly strangled to death 8-year-old Bella Grogan-Cannella and buried her body in a shallow grave in a wash about a mile from her Bullhead City home.

He said he has had telephonic interviews with the 27-year-old defendant, and he's working with jail Commander Don Bischoff to arrange a jail conference with Rector.

Thanks, skibaboo! Ralphy got 20 years in May. Freddie got probation. Tania's sentencing isn't until Sept. 24 but yeah, it looks like she's out in 5. :mad: On the bright side it's 5 years where she won't be birthin' no babies and with a little luck her ovaries will shrivel up in the meantime.

Grogan’s attorney, Brad Rideout, asked for a guaranteed five-year prison sentence, citing his client’s lack of criminal history, the fact that the amount of drugs was less than one gram of methamphetamine, and that she was involved in only one of the drug buys. Rideout said Grogan would agree to that plea agreement.

Deputy Yavapai County Attorney Kevin Schiff said his county does not normally agree to a stipulated prison sentence but agreed to the plea agreement and had no problem with the five-year sentence. He wanted a pre-sentence report in case Grogan committed other crimes under another name.

Sipe agreed that he would likely sentence Grogan to five years in prison. The judge will sentence her Sept. 24.

In other news:

Rector’s attorney, Gerald Gavin, is asking Superior Court Judge Lee Jantzen to move Rector’s trial to another county because the media coverage has and will saturate the Bullhead City area. This would make the task of seating a jury that has not been tainted by details of the case nearly impossible, Gavin argued.

Gavin also filed a motion in response to the state’s argument to hold a hearing on allowing Rector to have access to a laptop computer at the county jail in order to review evidence and assist with his case.

The defense attorney also filed a motion to ask that personal information of prospective jurors such as phone numbers not be made public. He also seeks to have court staff not to mention Rector’s name or the nature of the crime to potential jurors. Gavin also wants to interview individual prospective members of the jury outside of the presence of other jury members.

Slain girl, 8, remembered with rock garden in Bullhead City

It has been one year since police discovered the body of an 8-year-old girl who was strangled near her home in Bullhead City, Arizona.

The story of Bella Grogan-Cannella made headlines around the world, including in Las Vegas. Her accused killer, Justin Rector, was a family friend who’s now behind bars facing the death penalty. He told police he was high on drugs on the day of her murder.

A year later, “Bella’s Rock Garden” has become a place of healing for the people who knew and loved her and also for complete strangers, even those who live halfway around the world.
