We’re in Riverside this morning for opening statements in trial of Robert Pape and Cristin Smith. Stay tuned to KESQ News Channel 3 and CBS Local 2 for the latest updates from inside the courtroom.

Judge Bernard Schwartz has entered the courtroom. Court is now in session.

Courtroom is packed with members of the media, general public and family members of Pape and Smith

Both Pape and Smith are charged with three counts of murder after authorities found the bodies of 18-year-old Becky Friedli, her mother Vicky and her mother's boyfriend, Jon Hayward, at the family's #PinyonPines home in 2006

If convicted, both Pape and Smith face life in prison without parole

Both were originally charged in 2014, but case was temporarily shelved. Pape and Smith were charged again in June 2016 after new evidence emerged following a 16-month long investigation

Prosecutors talking about Pinyon Pines resident who called fire station and went to Friedli home. Called the home several times, got no answer. Saw wheelbarrow on fire with Becky Friedli body. Prosecutors showing picture of Becky's body in wheelbarrow

Prosecutors say jurors will hear from CAL FIRE Captain Williams who arrived at home just after 10 p.m. on September 17, 2006. Williams saw body in wheelbarrow on fire, had firefighters put fire out in wheelbarrow.

Prosecutors: Deputies followed wheelbarrow track around Friedli home, found shoe prints near track. Prints follow wheelbarrow track deep into desert. Straight line away from Friedli home in middle of desert

Jurors will also hear from homicide investigators on wheelbarrow track. Appeared to be a hole resembled in the desert near wheelbarrow track. Found business card near wheelbarrow track. Sent card for testing

Prosecutors show pictures of Becky Friedli. A profile picture and a picture of her body burned in the wheelbarrow. Investigators say she believed to have died from "homicidal violence".

Investigators also found two bodies, Vicki Friedli and Jon Hayward near back of home. Investigators say Vicki Friedli died from one gunshot wound to the head. Believe Hayward was shot twice in chest, one at close range

Prosecutors: Weapons believed to have been used were either .40 caliber or 10 mm handgun on Friedli and 12 gauge shotgun on Hayward, according to investigators

Prosecutors: Jurors will also hear from arson investigators. Investigators believe fire was started with gasoline. Found gas cans inside the home

Prosecutors: Javier Garcia and two friends drove up to scene the next day. Garcia told investigators he and Becky Friedli were best friends. Said he last spoke to Becky at 6:40 p.m. on 9/17/2006. Becky was anticipating on going on hike with Robert Pape, and go into work at night

Detective interviews Robert Pape just after 5 p.m. on Monday, 9/18. Told detective he and Friedli dated for about a year from roughly 2005 to 2006.

Interview with Pape: Left work and drove to home in Rancho Mirage between 6 and 6:30 p.m. Around 7 to 7:30, Cristin Smith met Pape, then drove to Smith's father's home in Cathedral City.

Investigators say Pape said he had not talked to Friedli for "a month or two at least" prior. She called and asked to stop by Smith's house. Said Becky called him Sunday and asked to go hiking. He agreed, then "I talk to her later" and cancelled

Garcia interview: Javier overhead Pape call Becky 1:30 a.m. "about Thursday or so". Pape and Becky discussed going for a hike, Pape did not want her parents to be home, would call her after work around 6 o'clock, then go hiking

Prosecutors say no cell towers in Pinyon Pines in 2006. Used landline phone to call Garcia. She said Pape was "on his way up the hill". Garcia tried calling Becky several time later that night, no answer.

Prosecutors: Detectives have conflicting stories, start going through cell phone records of Garcia, Becky Friedli.

Prosecutors: Two phone calls on Sept. 14. around 1:30 a.m. On Sept. 14-17, 18 phone calls and 18 text messages between Pape and Becky Friedli. Last phone call was Friedli calling Pape around 7:30 p.m. on the 17th. No calls after murders

Cristin Smith interviewed by investigators on 9/28. Said around 6 or 6:30 p.m., he left work at Knotts Soak City, went home to Cathedral City. Drove to Pape's house, returned back to Smith's home. Played video games and watched TV

Smith to investigators: Becky mentioned going hiking, but no specific plan. Never been to Friedli residence. Said Becky called Smith, called her back. Talked, not going hiking. Called her 3 to 4 mins after she called, no one picked up.

Smith and Pape said they were at Smith's home in Cathedral City for phone calls

Prosecutors say business card was for Marie Widmann with Pro-Life Ministries. Widmann knows Kathleen Pape as a volunteer for Pro-Life Ministries. DNA on card of at least two people. In October 2007, Smith included as "potential contributor" to DNA mixture

July 2014 - Smith is "major contributor" on business card

Probability 1 in 28 trillion caucasian male

Search warrant on October 2007. Found shell casings, holder for .40 caliber handgun. Found photo of weapons stash on Pape's phone. Weapons they couldn't find

Sheriff's Department received anonymous call in November 2011. Had information regarding a homicide where there was a fire in the Pinyon Pines a few years back. In May 2016, investigators locate and interview Jeremy Witt. Witt was security guard at Knott's Soak City.

Witt worked with Smith. Told investigators he remembered seeing Smith distracted at work one day, looking at hills towards Pinyon Pines. Smith told Witt, "had gone up there. Something had gone wrong. They burnt the place. We torched the whole (expletive) place."

Prosecutors address Pape's and Smith's cell phone records on 9/17/06

Prosecutors: When looking at phone records and cell tower map, "How could two people who say they're together be miles apart within a few minutes?"

Prosecutors: From 7:27 p.m. to 10:23 p.m. Sunday night, both Pape and Smith's phone are off the grid. No cell towers around crime scene. Either phones were simultaneously turned off or simultaneously in an area where there were no cell towers

Prosecutors: 10:23 p.m. Pape's phone back on, checks voicemail. Received calls from girlfriend, Sara.

Prosecutors: Two fingerprints on card from Pro-Life Ministries. In 2006, determined prints were poor quality, no result. Same as 2007. In 2017, fingerprints were sent to California DOJ for testing. Both fingerprints identified as Cristin Smith's.

Prosecutors: "We will spend the coming days going through this evidence... that awful night in 2006... and the destruction these two men left that awful night on that mountain."

Prosecutors: "I'm going to ask you to come out of that deliberation room and find them guilty. Each of them guilty of senseless brutal murders."

Court is back in session. Smith's attorney, John Patrick Dolan, begins opening statement. "This is serious business."

Dolan: Wants to talk about evidence in this case. "It simply is not here. This is not an exercise in unveiling secrets."

Evidence Dolan wants to address include crime scene, cell phone/cell tower, trace evidence, Jeremy Witt, Smith's statements and character

Dolan: Jeremy Witt is an "interesting person to say the least."

Dolan now going over with jury times related to crime scene evidence, including witness observations, first responders and investigators arriving on scene and law enforcement observations

Dolan: None of the shoe prints had anything to do with Cristin Smith. Shoes taken a year later, no match.

Dolan: You will not see any relationship between the business card and this crime. No one can say how long card had been at place it was found

Dolan: No one will say that Cristin Smith was ever at that residence. Ever.

Dolan goes over cell phone/cell tower evidence from 9/17/06 with jury. Shows cell site coverage footprint and cell movement pattern

Dolan: Cell towers are omnidirectional. Towers broken up into sectors. Slices pointing in different directions. Says prosecutors have three different directions

Dolan: Law enforcement never got cell tower sector information. Not available and can't be used.

Dolan: No one has access to that data. This is a problem, because Cristin Smith had never been to that location. Cell tower doesn't prove it, because it's impossible to find out if his cell phone pinged off that tower

Dolan: RSO Contacts Jeremy Witt on May 16, 2015. Contacts Witt for second statement on May 18, 2015.

Dolan: Going over Cristin Smith's statement on 9/17/06. Schedule of activities is from 10:45 a.m. until 10:30 p.m.

Dolan: Going over Smith's character evidence, including being in ROTC, working as a lifeguard at Knott's Soak City, enlists in U.S. Army, 5 deployments to Iraq and Afghanistan, attends special forces sniper school, worked construction, arrested June 14, 2016

Dolan: Bottom line "Asking isn't enough. They (prosecutors) have to prove the case... Everything presented here is explainable... Nothing is categorical. We're in an exercise of judicial fact finding."

Timothy Summerlee takes the stand for testimony. Was living in Pinyon Pines in 2006. Describes area as mountainous, alpine forest. There are one-acre parcels that people have developed. Defined by county as unincorporated community.

Summerlee identifies photo as wreckage of residence on Alpine Drive. Says his home is diagonally across Alpine Drive from wreckage

Summerlee: Most of the people who live in community are friendly. Knew of Vicki Friedli and Jon Hayward.

Summerlee: Identifies Jon Hayward, Vicki Friedli. Doesn't know Becky Friedli.

Summerlee says most times they retire around 8 p.m., read a little bit, make sure windows are open and doors locked around September

Summerlee: His home has window in bedroom. Window looks directly in direction of Friedli home. Happened to look out the window and describes it looking like a "flickery flame." In a forest, it represents danger

Summerlee: Sees flame through trees. Concerned it could be a fire. First thing that came to mind is to notify fire department.

Summerlee: Quite sure he made a 911 call. Roughly recalls being interviewed by an RSO investigator about the fire.

Summerlee: confirms he tried to call Pinyon fire station twice. Never got through to the Pinyon fire station.

Summerlee: "I don't remember talking to anyone that night with the fire department over the phone". He and wife were quite concerned, re-dressed and drove in the direction where they saw the light. Turned out it was at the Friedli home

Summerlee: Confirms photo is burned home. Shows court where he, wife and another neighbor came up Alpine Drive, and parked near the driveway.

Summerlee: Confirms another photo of Friedli home. Showing peak of rook with cutout and vent. Believes that's where flames were coming from

Summerlee: Ran up driveway by himself, stopping just outside where a couple of vehicles were parked according to photo

Summerlee: Did not see any other persons, vehicles on Alpine Drive. He, wife and neighbor are the only people at that time. Didn't see or speak to anyone at home when getting closer up the driveway. Shouted, "Is there anyone home?"

Summerlee: Looked like garage door was up. Looks at garage door, appears to be closed. Says it also appears someone had cut through the garage.

Summerlee: Saw light on, appeared like he was looking at opening or entry way into home. Never had been this close to the home before 9/17/06

Summerlee: thought a light may have been on, not a fire.

Summerlee: turned right and saw a wheelbarrow, which had something "inappropriate" and "out of place". Looked like a mannequin, but too human to be a mannequin

Summerlee: confirms he did see a body in a wheelbarrow. Didn't know if it was a real person at the time

Summerlee, a neighbor, is recalling during testimony what he saw the night of the murders

Summerlee tells Moore he recalls going on morning walk the following day, being approached by reporter, believed to be from the Desert Sun. Told reporter he saw wheelbarrow, recalls seeing what appeared to be a mannequin or corpse

Prosecutors showing Summerlee an aerial view of general area of home and neighborhood. Identifies points on map of his home and where Friedli home was. Directions to Friedli residence included turning right, going straight and turning left before arriving at the home.

Summerlee identifies two direct routes from Highway 74 to Friedli home

Dolan shows Summerlee pictures of wheelbarrow with Becky Friedli's body inside.

Pictures are front and back views showing Becky Friedli's partially burned body inside wheelbarrow.

Summerlee says he remembers seeing, from the front of the wheelbarrow, that the body appeared to be "propped up" against the wheelbarrow with arms up.

Moore cross examining Summerlee. Summerlee says he works in library, clients sometime bring in clippings from newspapers on occasion. Did not personally pursue looking to find his name in news coverage.

CAL FIRE Captain Jeff Williams takes the stand next for testimony. Has worked at CAL FIRE since 1991. Currently works at command center. In 2006, worked at the Pinyon Station 30

Williams Recalls phones ringing around 9:40 p.m. the night of the fire at the Friedli home, 9/17/06. Phone rang 3 times. At first, reports of fire from an unknown distance. Then, reported as in broad community.

Williams points out location on Highway 74 to get to Friedli home. Dark that night. "Could barely see the illumination."

Williams recalls firefighters could see a glow in the direction towards the Friedli home. Working of off map books. Engine computers don't work up there because of poor cell coverage.

Williams and his crew arrived at the scene at 10:12 p.m. Sunday night. Notified command center through radio

Williams recalls encountering a pickup truck on a road while on the way to the fire. Pickup truck sped up towards them after firefighters turned down road. "He wanted to play chicken."

"He squeezed by. Airhorns, sirens, he would not give up the right of way." Williams didn't know where he was coming from or heading to. One man inside small pickup truck, "size of a Toyota." Vehicle was red, bed was white.

Vehicle continued on after the encounter. "He was fairly quick.

Williams recalls seeing a man with long, silver hair when coming to the scene. Identifies the the man as Summerlee. They were still on Alpine Drive, facing east towards the driveway. Talked with Summerlee before pulling into driveway of Friedli home.

After pulling into driveway, Williams describes conditions "one fully-involved structure fire with fire coming out of every door and window."

Williams identifies picture of garage. "Majority of fire was coming from livable space, what would be beyond garage pictures... Coming from all sides."

Williams: Recalls fire in attic above the garage

Williams: Doesn't recall if garage door was closed. Fire was throughout the house. Gave report on conditions and direction to crews. Makes a "hot lap" (360 degree walk around site) to get perspective of conditions

Williams: Identifies picture of side of house as part of "hot lap." Walked right to left. Describes picture of house still standing, doors and windows on left side in residence portion behind the house. "There were no doors and windows left. There was fire blowing out of them".

Williams: When looking inside, couldn't see any furniture. Saw "glowing walls". When looking at roofline at living structure, asphalt shingles were "breathing" (smoke and fire coming out and closing). Similar to grass fire.

Williams: Identifies aerial picture of where he responded to the scene. His crew parked towards the top of the driveway, behind the dark vehicle facing the home.

Williams: Directed crews to pull hoses up to house. "It's completely involved with fire." Was looking for a body burning in a wheelbarrow after talking with Summerlee.

Williams: Saw body burning in wheelbarrow. "Charred. Partially charred." Remembers seeing fire burning around Becky Friedli's hip area. Identifies picture of body in wheelbarrow. Body was in exact position when Williams first saw it.

Williams: No water had been put on the body. Told crew to grab a hose to cool off the body in wheelbarrow.

Williams: Walked up and was within "a foot" of the wheelbarrow. Stopped for five seconds, "seems like a minute in time." Walks back to truck.

Williams: "Do all your best to keep it standing." Wanted evidence. Structure ended up collapsing sometime in the night.

Court is in recess. Will resume at 11:20 a.m.

Court is back in session

Williams: "Hot lap" lasted for about one minute. Water was put on the body in the wheelbarrow 5 minutes after crew arrived.

Williams: House (structure of roof) collapsed 15 minutes after crew arrived on scene.

Dolan begins cross examination of Williams.

Williams: Doesn't recall being dispatched at 9:53 p.m. nor being en route at 9:57 p.m. Does recall arriving on scene at 10:12 p.m.

Williams retraces route towards the Friedli home, points out where he and his crew encountered the pickup truck.

Dolan brings up Williams mentioned pickup truck was coming at them at a high rate of speed. Williams confirms he saw the face of the person inside the pickup truck. Person grabbed steering wheel, pulled himself up and looked at the fire crew passing by.

Nothing was said between Williams and man inside pickup truck.

Dolan brings up picture of garage door. Williams says it looks like someone cut garage door. Williams doesn't recall cutting it. Doesn't remember if door was open or closed.

After viewing report, Williams confirms there was no fire activity in the attached garage.

Williams: Didn't see any gas cans in the area.

Moore begins to cross examine Williams

RSO Deputy Jerry Osterloh takes the witness stand. In September 2006, was working as a deputy out of the Hemet Patrol Station, which also serves the Pinyon Pines area

Osterloh: Arrived at burning Friedli home at 10:57 p.m. His attention turned to a burnt body inside a wheelbarrow. Noticed tracks from wheelbarrow tires that led from another location. Led up into the hills

Osterloh: Identifies pictures of wheelbarrow, including one with Becky Friedli's burnt body inside

Osterloh: Followed wheelbarrow track into hills. Also noticed two sets of footprints with the tracks. Footprints pointing towards the house.

Osterloh: Identifies picture of shoe print on top of wheelbarrow track.

Osterloh: Believes when looking at shoe prints, they were two different shoe prints. Says prints were facing north away from the house

Dolan begins to cross examine Osterloh.

Dolan asking Osterloh about shoe prints, how the wheelbarrow got out into the desert. Osterloh says he doesn't know how it got out there. Can't say if the prints and track were made exactly on the night of 9/17/06.

Moore begins to cross examine Osterloh

Ramirez: Found expended shell casings in garage in one container (specifically close to door leading into home). Hundreds were in container. Didn't find any other casings outside container

Ramirez: Found several cartridge cases with top portions appeared to have "exploded". Deformed in way that's not found when a case is fired from a weapon.

Ramirez: After raking up remains, went through "sifting" process with debris to separate rocks from cartridge cases to collect evidence

Ramirez: Identifies photo of two gas canisters removed from garage. A 5-gallon gas can removed from top of garage or second floor. Another can found on the east side of garage on first floor near door. No gas in either can found

Ramirez: Couldn't see wheelbarrow from Alpine Drive. When looking at diagram, wheelbarrow was roughly 70 feet from house. Wheelbarrow would be close to 100 yards from Alpine Drive

Ramirez: After sifting through debris from home, formed grid search consisting of about 7 people, 5 yards in between each other. Search team walked about 200 yards in desert, did not walk past where wheelbarrow track and business card was found
