Packer was back in court last week to be arraigned on the sexual assault charges. Last Sunday was the third anniversary of the slayings.

...Today Packer walked into court with a shaved head and without glasses.

The 22-year-old appeared to mumble when he answered the judge's questions and then he stumbled on his way out of the courtroom.

Packer's arraignment was postponed until next Friday to give his attorney more time to read the sealed Grand Jury Indictment transcript.

There could me more delays.

Packer's attorney Benjamin Meserang filed a motion to disqualify Ventura County Superior Court Judge Patricia Murphy from presiding over the case.

Meanwhile prosecutors seeking the death penalty are trying to combine the charges.

They say an August 6th trial date has been set.
 
The trial has been postponed until January, 2013. The defense wants more time to prepare its case, and the judge agreed, though she warned that the new trial date is a firm one and there will be no more delays.

Court documents reveal that the prosecutor rejected a defense offer to have Packer plead guilty and receive life without possibility of parole. The D.A. is pursuing the death penalty.

It has been two-and-a-half years now since Packer was arrested.

What that poor woman had to go through...awful.
 
I'm continually frustrated by the length of time it takes to get these cases to trial. The families of the loved ones who are murdered, are victimized for years during this awful process.

I was just discussing this with a sophomore in HS today, who is reading about the Salem Witch trials. She was alarmed at how one could whisper and point at someone, and off they went to the gallows. Which then led to an interesting discussion about the American justice system today. The pendulum has swung too far in the opposite direction.

My thoughts are with Brock and Davina's families tonight~

Ok, I'll ask. Did you feel he was a bad person when you were around him in school? Sometimes we have vibes about people. 'Oh I always knew he would go postal...'

Lawyers Ask For More Time To Prep For Trial

"Frawlwy told the judge that this is another in a series of defense requests for more time. He accused Maserang of using legal tactics where criminal attorneys never say they are ready for trial. Doing so takes away the appeal argument by a defendant that he had an incompetent lawyers".

"The Husteds' children are being raised by their grandmother, who has stress-induced health problems, Frawley said. He noted that a couple of witnesses have died and some have moved out of state."

Judge might consider delaying Joshua Packer trial

A judge on Friday denied a defense request to continue Joshua Packer’s capital murder trial but left the door open to another possible delay if she is convinced that information she just received warrants it.

Judge Patricia Murphy gave Packer’s lawyers until March 4 to show good cause as to why another delay should be granted, saying that reasons listed in a sealed declaration warrant further consideration to the request for a continuance.

His next court hearing is set for January 31st. Four-and-a-half years since his arrest, and not even close to trial. An outrage.
 
Yes, it is an outrage!! Our system is hopelessly broken. The pendulum has swung so far to the left, I don't know it will ever be plumb again. Sad ...

I hope their children are being loved through this whole mess. Do we know who is raising them?
 
Wow, I hadnt followed this case for a long time. It is outrageous that this is taking so long. But this is becoming the norm in California for murder cases.

I searched for any news on the 1-31 hearing, but found nothing?
 
His defense attorneys have asked for more time, and requested the trial be delayed until May.

One of his lawyers suffered some kind of injury and they argue that it's not feasible to find another attorney at this late date. There are 8,800 pages of discovery and some 300 CD's and DVD's already prepared in the case.

Delay, delay, delay...that's the usual story anymore in California.
