I noticed he had an arraignment hearing back in 2018 - did he plead not guilty? I don't have anything on that.

TIA if anyone can answer my question! :)

The defendants, Holmes and Belwani, were both charged in two separate complaints including the SECURITIES AND EXCHANGE COMMISSION (SEC) vs RAMESH “SUNNY” BALWANI.

The SEC's case against Balwani is still pending (he entered not guilty plea), whereas Holmes settled her SEC case long ago-- before the criminal fraud trial.

Good morning from San Jose! I’m back waiting outside Judge Ed Davila’s courtroom for a pretrial hearing to start in Sunny Balwani’s criminal fraud case. Balwani is here, as well as a bunch of attorneys. No Elizabeth Holmes obv.

The clerk just opened the courtroom and Balwani, who's wearing a suit and tie, held the door open for his team of attorneys from Orrick. (Notably, he did not hold the door for me and the other Bloomberg reporter who's here.)

It looks like Balwani came with a team of 7-8 Orrick attorneys led by Jeff Coopersmith. The gov't's team are a bunch of familiar faces - prosecutors Robert Leach, John Bostic, Jeff Schenk & Kelly Volkar - also a couple newbies on the team.

Judge Davila is on the bench. Prosecutor John Bostic suggests many pretrial issues can be submitted on the papers (no oral argument). Balwani's counsel appears to disagree, saying he "appreciates" the court went through the other trial, but this is the 1st time for his client.

Jury selection in Balwani's trial begins March 9, openings March 11. Judge Davila says he thinks he'll give each side roughly an hour for voir dire during jury selection.

Judge Davila notes that "the lawyers were so good, in so many ways" throughout the Holmes trial that they didn't have issues in jury selection, which he said was efficient. "We hope to do better, your honor," Coopersmith replies.

Coopersmith notes the govt's witness list has ~175 people even though the DOJ only called ~30 witnesses during Holmes' trial. "It would be very helpful to pair that down sooner than later," he says. Prosecutor John Bostic says pretrial disclosures narrow the pool of witnesses.

Balwani wants a row designated in court for Balwani's family during trial. The gov't also wants a row for federal agents. (They're assuming the media will cover this thing as closely as Holmes' trial, which I think is dead wrong - but maybe that's just me.)

Balwani's counsel Steve Cazares wants the judge to bar the gov't from arguing Theranos ran bogus tests on 3rd party devices. He says he doesn't know why the evidence was allowed in the Holmes trial and "what happened in the Holmes trial shouldn’t be applicable to Balwani’s case."

Cazares says "the fact is the indictment has mistakes" and inaccurately says HIV and gonorrhea tests were done on Theranos devices. Prosecutor Bostic says defense counsel's "hyper-technical" analysis of the indictment is inappropriate. The judge held off on ruling. Moving on...

The parties are arguing over Balwani's bid to exclude evidence that Theranos voided millions of test results in 2016 after CMS' inspection. Balwani's atty says voidint the tests was a "voluntary measure to promote public safety. They didn’t have to do any of that."

Balwani's counsel wants text exchanges b/w Holmes and Balwani in Oct 2015 excluded from trial. The texts were introduced in Holmes' trial and they mention "death," "sex," "murder" and "filfth." The atty says the text exchange is irrelevant and "just confusing."

Prosecutor Jeff Schenk says the texts are relevant and proves "knowledge and intent" by Balwani that there was scheme to defraud, and Holmes testified they were about John Carreyrou's WSJ article and Rupert Murdoch.

This pretrial hearing wrapped with Judge Davila asking the attorneys not to drink out of water bottles during trial. "Drinking water bottles in the court, it’s a little informal. The image of knocking back the bottle is something that’s a little disrespectful for the jury."

Theranos Round 2: Trial Of Sunny Balwani Set To Begin Next Week

“The trial of Ramesh ‘Sunny’ Balwani related to the infamous blood testing company Theranos will get underway next week, with jury selection set to begin next Wednesday.

Balwani, the former business partner and ex-lover of convicted Theranos founder and CEO Elizabeth Holmes, is charged with the same counts of criminal wire fraud and conspiracy against investors, doctors and patients brought against Holmes.

Holmes’s sentencing has been put off until Sept. 26. She remains free on bond.

Given the length of the Holmes trial, U.S. District Judge Edward Davila and the lawyers took steps in pre-trial proceedings on Tuesday to anticipate issues that came up before. Six alternate jurors, in addition to the 12 that will initially sit on the jury, will be selected — one more than in the Holmes case.

This time around, the trial will also start out with slightly longer hours — 9 a.m. to 3 p.m. on Tuesdays, Wednesdays and Fridays — with the idea that the jury may be asked to come in on some Mondays and Thursdays as well.

The Balwani defense is also trying to change substantive aspects of the trial by fighting evidence that came in against Holmes, including testimony and exhibits showing that Theranos also conducted blood tests on commercially available analyzers rather than on its own devices.

In a lengthy written order issued earlier this week, Davila denied Balwani’s motion to exclude this evidence, ruling that the indictment “puts Balwani on notice that the scheme to defraud patients includes Theranos’ use of unmodified conventional analyzers.”

The judge deferred ruling on a defense request to keep out damning evidence that, after problems with Theranos’ results came to light, a new lab director ordered that all of the results from tests performed on Theranos devices be voided.

Balwani was not present in the courtroom on Tuesday.

The court has reserved Monday and Tuesday of next week to discuss jury questionnaires. Jury selection will begin on Wednesday and continue on Thursday as needed.”

Opening statements are scheduled for March 15, with the trial expected to last up to 13 weeks.

Good morning from San Jose! I'm waiting outside Judge Ed Davila's courtroom for a pretrial hearing in Sunny Balwani's trial, which is set to begin w/ jury selection next week. A few more media folks showed up today, but unlike like Holmes' pretrial hearings there are no cameras.

Judge Davila is on the bench. He begins by discussing jury alternates. Balwani's counsel says 5 is enough, but prosecutor Robert Leach asks for 6 & notes they went through many alternates during Holmes' trial. "I anticipate a similar length, although we hope it will be shorter."

Balwani's counsel Jeff Coopersmith says he'll likely want to individually question jurors during voir dire about their media exposure to the Holmes trial and "potentially prejudicial pretrial publicity." The judge says they'll address the issue as it comes up.

Judge Davila asks if he should plan an overflow room for observers. The attys say they don't know if people will show up for this trial. Judge Davila says he may stream proceedings to an overflow courtroom in SF, where there are more rooms. He adds "most of the press is in SF."

Balwani's counsel wants to know how long the gov't's case-in-chief will be. Prosecutor Robert Leach replies "it's similar to the Holmes' trial" - 13 weeks.

This pretrial hearing wrapped with Judge Davila asking the attorneys not to drink out of water bottles during trial. "Drinking water bottles in the court, it’s a little informal. The image of knocking back the bottle is something that’s a little disrespectful for the jury."

In other news, Judge Davila just signed an order modifying Elizabeth Holmes' bond so that it's secured by $500,000 worth of property. The court document w/ the address of the property is under seal.

I haven't yet found a decent article to post on it, but I read that Holmes is being required to post $500,000 bail in the form of property to guarantee that she won't flee before sentencing in September.

Elizabeth Holmes case: Bail tightened for Theranos fraudster

The federal court judge set to sentence convicted fraudster Elizabeth Holmes in September ordered Tuesday that she put up property worth $500,000 to help ensure she will not flee to avoid an expected multi-year prison sentence.

After Holmes’ conviction, prosecutors told Davila they planned to ask him to convert her $500,000 bail — secured only by her signature, as is common in federal cases — to cash or property of equivalent value.

Davila’s order Tuesday noted that Holmes’ defense team had agreed with the change.

Former Santa Clara County prosecutor SC said Holmes’ notoriety means there was probably little need for tightened bail. “There’s really no place for her to go that she wouldn’t be found,” SC said. Fleeing would significantly compromise Holmes’ expected appeal, he added. Still, with legal experts predicting that Davila will send Holmes to prison for several years, “there’s a theoretical increased motive to not show up to court,” Clark said.

Court filings including a deed that show what property Holmes will put up have been sealed by the court, likely for privacy reasons, SC said. The collateral could belong to Holmes, her family, or her partner BE, a hotel heir and father of her son, SC noted. Holmes’ personal holdings are unclear — while she was a multi-billionaire on paper when Theranos was valued at $9 billion and she owned half its stock, jurors heard at her trial that she never sold any of her shares.
