Jurors find Bay Area man guilty of killing missing girlfriend

The panel of nine women and three men declared its unanimous finding against Mark Anthony Randle Jr. shortly before 2 p.m. in Department 23 in the Justice Building in Vallejo.

He was charged with killing his girlfriend, Erica Brown, on Aug. 20 at the Sunrise Drive home they shared in Fairfield. Her body has not been found.

Nguyen, the lead prosecutor, built her case largely on the eyewitness testimony of Jan E. Agacinski, a former sexual partner with Randle.

In exchange for her testimony, the Solano County District Attorney’s Office dropped an accessory-after-the-fact charge against her.

im thinking there was evidence in the home that she was not alive :(

Agacinski spent two long days on the witness stand, providing information about the date and time of the killing, seeing the physical condition of Brown, whom she saw lying naked on a bed but covered with a blanket some time just before midnight, her face severely battered and bloodied. She checked Brown’s pulse and found it to be “faint.”

Agacinski also testified that, after visiting the Sunrise Drive home for a second time in the early hours of Aug. 21, Randle told her Brown was dead. He later loaded her body, wrapped in a blanket, into a black Mercedes parked in the driveway.

Agacinski’s statement, coming on Day 3 of the trial and her second on the witness stand, followed cross-examination by Latka, who also made a reference to the body being loaded into a car and “blood in the driveway” of the Fairfield home.

Fingerprint and cellphone data also figured in the trial.

July 30
The Fairfield Police Department announced that a jury convicted Mark Randle on July 25 of the first-degree murder of Erica Brown. Officers initially arrested him in the Sacramento area on Sept. 14, 2023.

Randle’s trial began July 10. According to police, the Solano County District Attorney’s Office "presented irrefutable evidence of Randle’s guilt, including witness testimony, officer/detective testimony, cellular phone date, video surveillance footage, DNA evidence, and FLOCK data."

Brown's remains have not yet been found, but police said, "Still, it’s our hope this verdict brings some peace to the family and friends of Ms. Brown."

Key testimony during the trial came from Randle's mistress, Jan Agacinski, who was charged with accessory to murder after the fact.

She made a deal with prosecutors that her case would be dismissed if she testified truthfully against Randle.

Loved ones have held a candlelight vigil to honor Brown but their wish is to give her the dignity in a funeral and final goodbye that she deserves.

"To be able to speak over her and send her away with those well wishes. To look at her and know she was receiving that would be the most closure anybody could get, I think," said Armstrong.

[...]

Randle will be back in court Aug. 23 when a judge is expected to set a date for his sentencing hearing.

The prosecution is pursuing 25 years to life in prison.

Details of Disappearance

Brown was last seen at her home in Fairfield, California on August 20, 2023. She lived on Sunrise Drive with her boyfriend, Mark Anthony Randle Jr., at the time of her disappearance. She was reported missing on August 25, and on August 31 authorities announced they'd issued a warrant for Randle's arrest for her murder.

A photo of Randle is posted with this case summary. He was at large for a further two weeks before he was located in the Sacramento, California area on September 15 and arrested.

Authorities stated they found two vehicles linked to Randle, both of which were reported stolen, which had incriminating evidence: a Chevrolet Malibu was found abandoned and burned in Richmond, California, with bloodstains matching Brown's DNA on the door. Randle's fingerprints were found on a black Mercedes which was found abandoned in Vallejo, California. In the trunk of the Mercedes were three gas cans, which were empty but which had been used.

Randle's mistress, Jan Agacinski, was charged with being an accessory to murder after the fact, but the case was dismissed on her promise to testify against him. She did testify at the trial, stating that she came over and found Brown lying nude in a bed, covered with a blanket, her face battered and blooded and her pulse faint. Randle told her there had been an argument and he had had hurt Brown. Agacinski left, and then when she returned a second time in the early hours of August 21, Brown was dead.

Agacinski said there was a blue tote inside Randle's Chevrolet Malibu, and she moved it so he would have room to load Brown's body into it. A neighbor's security camera showed Agacinski moving the tote. The tote was subsequently found in Rio Vista, California, and Randle's cellular phone records indicate he was in Rio Vista after Brown's disappearance.

Randle's attorney tried to argue that Brown had died of an accidental drug overdose, not murder, and that he had panicked and tried to hide her body. The jury convicted him of first-degree murder after just five hours of deliberation, however.

Brown's remains have never been located, but foul play is suspected in her case due to the circumstances involved.
