Harvey Weinstein is staying in prison in New York – for now.

The Los Angeles district attorney's office acknowledged Tuesday that convicted sex offender Weinstein will not be extradited anytime soon to face more sex-crime charges in California due to the coronavirus pandemic.

"The virus has delayed the processing of the extradition paperwork," said Greg Risling, spokesman for District Attorney Jackie Lacey, in an email to USA TODAY. "There is no time estimate on when he will appear in a Los Angeles courtroom."

Convicted rapist Harvey Weinstein was hit with a new lawsuit Thursday from four anonymous women who say he sexually abused them over the last four decades — including a victim who says she was just 17 at the time.

A 43-year-old Tennessee woman says that she was just 17 when Weinstein lured her to his New York hotel room for a business meeting, in 1994, and told her she’d have to “sexually gratify him” if she wanted an acting gig. He allegedly forced her to perform oral sex on him then raped her, according to court papers.
He allegedly said if she told anyone, he’d “physically harm her and her family,” the suit alleges

The settlement, which would create a victims' fund for women who say they were abused by Weinstein, still needs approval in U.S. District Court in New York City, according to a statement from the law firms FeganScott LLP and Hagens Berman Sobol Shapiro LLP...
 
A US judge rejected a proposed $18.9m (£15.3m) settlement of misconduct cases against abusive Hollywood producer Harvey Weinstein on Tuesday.

The fund would have been distributed between dozens of female claimants.

However various other accusers had called it unfair, saying it "absolved" Weinstein, his producer brother and the company board of liability.

LOS ANGELES (AP) — A federal appeals court on Wednesday restored a major part of Ashley Judd’s lawsuit against Harvey Weinstein, finding that the producer had power over the actor which should make her able to sue under a California sexual harassment law.

A three-judge panel of the 9th U.S. Circuit Court of Appeals found that Judd should be allowed to pursue both parts of her lawsuit against Weinstein. A lower court judge dismissed her sexual harassment allegations but left intact her claim of defamation.

Judd filed the lawsuit in 2018, alleging that in a meeting at a Beverly Hills hotel in late 1996 or early 1997, the producer tried to coerce her to watch him shower and give him a massage, then smeared her in Hollywood as a “nightmare” to work with after she rejected him.

Judd's attorneys had sued Weinstein under a California law that prohibits sexual harassment by people, other than employers, with professional power, including teachers and landlords.
The court agreed that the law could apply to situations like the one Judd faced, when she was dealing with Weinstein but not working for him.

"Weinstein was uniquely situated to exercise coercive power or leverage over Judd, who was a young actor at the beginning of her career at the time of the alleged harassment,” U.S. District Judge Mary Murguia wrote in the opinion. “Moreover, given Weinstein’s highly influential and ‘unavoidable’ presence in the film industry, the relationship was one that would have been difficult to terminate ‘without tangible hardship’ to Judd, whose livelihood as an actor depended on being cast for roles.”

Judd's lawyers made it explicit when she filed the lawsuit that she was suing in part to broaden the use of the law to protect against predatory relationships in Hollywood, and praised the 9th Circuit decision Wednesday.

“This is an important victory not only for Ms. Judd but for all victims of sexual harassment in professional relationships," Judd's attorney Theodore Boutrous Jr. said in a statement. "The court correctly holds that California law forbids sexual harassment and retaliation by film producers and others in powerful positions, even outside the employment context, and we look forward to pursuing this claim against Mr Weinstein at trial.”

Convicted rapist Harvey Weinstein appeared by video in an upstate courtroom Friday after Los Angeles authorities filed paperwork to bring him to California to face sex-crime charges there.
Weinstein, who appeared virtually from the Wende Correctional Facility in Erie County, had already struck an agreement with the Los Angeles District Attorney’s Office to delay the hearing until Dec. 11, and the proceeding was promptly adjourned until then, according to Erie County DA John Flynn.


(ETA: Harvey does not appear all frail & feeble ..like he faked it during the trial IMO)

The disgraced movie mogul received an honorary CBE in 2004 for his contribution to the British movie industry.

Weinstein, 68, was charged with three additional forcible rape felonies and three forcible oral copulation charges stemming from alleged attacks between 2004 and 2010 in Beverly Hills. The new criminal complaint expands the LA case to a total of five victims, authorities said.

It is unclear when an LA trial could move forward. California prosecutors are pursuing temporary custody of Weinstein from New York and have scheduled an extradition hearing for December in Buffalo, where he is currently incarcerated. He tested positive for Covid in March.

The spokesman said they could not “confirm nor deny” the 68-year-old had tested positive for Covid-19 inside Wende Correctional Facility in New York.

Weinstein, who is serving a 23-year sentence for rape, has a fever, his representative confirmed to the PA news agency.

No matter what he goes through in prison, it will NEVER compare to the suffering, disgrace and shame he put his victims through who were just trying to get work in a typically misogynistic business. My opinion, yes.

According to his spokesman, Juda Engelmayer, Weinstein's legal team is working on "the final touches" of his appeal brief and expects to file it within 20 or 30 days. Meanwhile, the fallen mogul is doing "all right" in prison.
He's "not enjoying the prospect of a longer term there, so he occupies his time with his legal strategy while reading history books about various luminaries and academics," Engelmayer said in an email ....

Why hasn't Weinstein been extradited to California?

The extradition process has been delayed twice and is now set for early April, as a result of the pandemic still raging in Los Angeles County.
Also, a new district attorney, George Gascón, has just been elected in the county; he was not involved in the investigation and filing of charges against Weinstein in LA.
"There is no new information on the Los Angeles action, and we are watching the developments there very closely," Engelmayer said.

Oh lord...I found out today that my mom gave Harvey Weinstein a tour while she worked at Disneyland. He was wearing a white t-shirt with holes in them. My mom said she was very weird, not towards her though. I'm glad he's spending the rest of his life in jail.
