Two immigration bills have passed the House, mostly along party lines. Two dozen Democrats voted with the GOP on “Kate’s Law” to impose tougher sentences on illegal re-entry into the US, while another vote on “sanctuary cities” was even more partisan.

Gonzalez’s defense is that the shooting was accidental, at least partially caused by the nature of the pistol, which had been stolen four days earlier from a federal Bureau of Land Management agent’s car.

In this week’s opinion piece, Gonzalez wrote that “the Sig Sauer .40-caliber automatic pistol, known for having a hair trigger, is documented in hundreds of accidental discharges.”

“If you had your finger on the trigger, sure, it could go off. But accidentally? Give me a break,” said Scott Jackson, owner of Bay Area Firearms Training in Burlingame. “The first pull on that gun is a long, long, long pull. ... It’s as obvious as sunlight that it can’t go off accidentally.”

There is one possible wrinkle to the fail-safe nature of the pistol which the defense presented in a 2015 preliminary hearing.

If the gun was left cocked and ready to fire — something no responsible gun user would do — it would be in the second-round position, forensics expert Jim Norris told the court. And if that were the case, jostling could set it off.

Lopez-Sanchez, who has pleaded not guilty, is set to make his first appearance in his trial proceedings on Friday before Judge Garrett Wong in Department 22 of San Francisco Superior Court.

While the trial’s start date has been officially set for Friday, the hearing may be held over or assigned to another judge. Jury selection can take days or weeks, so the opening statements may be far off, said Tamara Aparton, a spokesperson for the Public Defender’s Office.

The defendant, Juan Francisco Lopez-Sanchez, asserted his right to a speedy trial, meaning that the trial must begin within 60 days. He hasn’t asserted that right before, as he waited for his defense team to collect evidence and prepare a strategy.

The trial can’t begin right away, however, because the prosecutor is preparing for another case. It could be several more weeks.

Lopez-Sanchez will be back in court next Friday to continue the scheduling drama.

The Bureau of Land Management ranger whose stolen gun was used in the killing of Kate Steinle on San Francisco’s Pier 14 — a shooting that sparked a national debate over immigration policies — will testify in the upcoming murder trial of the alleged shooter, authorities said Friday.

The man largely known as Juan Francisco Lopez-Sanchez, who was arrested on a murder charge shortly after Steinle’s fatal shooting and will be going to trial soon, is now being referred to by the court as Jose Inez Garcia-Zarate.

Matt Gonzalez, chief attorney for the public defender’s office, said the name, which was previously listed as one of a number of Lopez-Sanchez aliases, is the one listed on the 54-year-old’s birth certificate and has been used in some prior federal cases.

Jury selection in Garcia-Zarate’s trial is currently expected to begin the week of Aug. 21.

The weapon fired on San Francisco's Pier 14 in July 2015, killing 32-year-old Steinle, may prove to be the focal point of the criminal trial of the shooter.

But any comments made by defendant Jose Ines Garcia-Zarate about that weapon during police interrogation could come off the record, according to defense attorneys.

The defense is arguing Garcia-Zarate wasn’t properly informed of his constitutional right to remain silent or seek counsel. An exchange with the San Francisco police officer who translated the Miranda warning was shown in court Wednesday.

Court records show that lawyers began summoning the first of 1,000 potential jurors Monday to the San Francisco courthouse to fill out questionnaires. Possible jurors are being asked if they can sit through a lengthy trial or have moral qualms about the case.

Monday’s questionnaire is only the first step, and the process is expected to take about two weeks, after which lawyers will then start questioning potential jurors about their views on immigration and other issues in an effort to seat an impartial jury. That portion is also expected to last about two weeks.

“We are very pleased with the jury,” said Matt Gonzalez, the lead defense lawyer in the case and the chief attorney of the San Francisco Public Defender’s Office. “We have such great diversity built in in San Francisco and I think we have a jury that understands a lot of the concerns about the defendant receiving a fair trial.”

The jury will not be sequestered.

Opening statements in the trial will take place Monday at 10 a.m. at San Francisco’s Hall of Justice.

"Help me, Dad": Father recounts Kate Steinle's last moments on San Francisco pier

"SAN FRANCISCO -- With his lower lip quivering with emotion and a packed courtroom hanging on every word, a father recounted the final moments of a daughter's life as they walked on a summer evening stroll on a San Francisco pier more than two years ago.

Jim Steinle told the court that he and a family friend were visiting his daughter Kate Steinle in San Francisco on July 1, 2015. After a late lunch at her favorite restaurant, the trio went for a walk on the pier on San Francisco's popular waterfront.

The elder Steinle said he heard a loud "bang," and his daughter collapsed in his arms, saying "help me, Dad."

Jim Steinle said when she fell to the ground, her eyes were closed and she had difficulty breathing.

"I couldn't figure out what was wrong," He said, choking back tears. "She didn't have any health problems."..."
