Monday, Sept. 20th:
*Preliminary Hearing for both (@ 9am PT) - CA - Kristin Denise Smart (19) (missing May 25, 1996 while walking back to her dorm from a off campus frat party at Cal Poly, reported missing on May 26, 1996, San Luis Obispo, still missing) – *Paul Ruben Flores (19 @ time of crime/44) arrested & charged (4/13/21) & arraigned (4/15/21) with 1st degree murder. Plead not guilty. No bond.
*Ruben Ricardo Flores (55 @ time of crime/80) arrested & charged (4/13/21) & arraigned (4/15/21) with accessory to murder after the fact. Plead not guilty. $250K bond. Bond was lower to $50K. Has posted bond (4/22/21), out of jail.

9/8/21 Update: Preliminary hearing. The court heard arguments over the defense's subpoena for testimony and records of Chris Lambert, podcaster whose #YourOwnBackyard investigated the case. Judge van Rooyen granted the motion to quash to Chris Lambert.
State witnesses: Detective Clint Cole took the stand barely to discuss the transportation of evidence to SERI labs and what soil samples were taken. Forensic Serologist, Angela Butler. Motions hearing for both re return of property on 9/9/21.

9/9/21 Update: Preliminary hearing. State witness: San Luis Obispo County Sheriff's Office Forensic Specialist Shelby Liddell resumed her testimony from last week re soil samples. Court will be dark tomorrow & next week. Proceedings for Paul & Ruben Flores' preliminary hearing are expected to resume again on 9/20/21 due to various vacations. The prosecution is supposedly wrapping up their witnesses early that week & the defense is to call its few witnesses. No word now on when the whole thing is expected to wrap & Judge van Rooyen issues his final ruling. At the end of the day, ran through the defense's proposed witnesses & Judge van Rooyen ruled to exclude testimony about convicted murderer Scott Peterson & some other people the defense claims should've been suspects, one being her ex-boyfriend at the time.
State witnesses: Angela Butler, Forensic Serologist. Human blood was found in soil. SLO Police Patrol Lieutenant Robert Cudworth was working with Cal Poly police in 1996. JT Camp, an investigator with the SLO County District Attorney’s Office, was also back on the stand. He talked about some of the items found in Kristin’s dorm room, including a credit card, Social Security card 7 checkbook with a Stockton address on it all belonging to her.

9/17/21 Update: Ruben: Case scheduling hearing on 9/22/21 & motions hearing on 9/24/21. Paul: Motions hearing on 9/24/21.

The last witness of the day was Jamilyn Holman, a neighbor of Ruben Flores. She said she saw a camper trailer attached to a white van outside Flores’ home and also a red SUV with a cargo trailer parked on the side of the home a few days after the search warrant on Feb. 9, 2020

9/20/21 Update: Motions hearings on 9/24/21 have been cancelled. Testimony wrapped up Monday in the preliminary hearing for Paul and Ruben Flores. On Wednesday, the judge in the case is expected to rule whether there is enough evidence to move the case forward to trial.
State witnesses: Jennifer Hudson on cross exam. Det. Cole. Jamilyn Holman, a neighbor of Ruben Flores in Arroyo Grande.
The defense declined to call any of its own witnesses.
During closing arguments Monday afternoon, San Luis Obispo County Deputy District Attorney Chris Peuvrelle said Paul Flores lies to cover up the murder of Kristin. Defense attorney Robert Sanger said there is no case against Paul Flores & there is certainly no case against Ruben Flores. He said there was nothing found in this case that is real evidence. Defense attorney Harold Mesick echoed the same thoughts & said the prosecution has tried to paint "lipstick on a pig."
Judge Craig van Rooyen's ruling is expected at 8:30 a.m. on 9/22/21. And case management hearing for Ruben on 9/22/21.

Testimony wrapped up Monday in the preliminary hearing for Paul and Ruben Flores, the two men charged in connection with the 1996 disappearance of Cal Poly student Kristin Smart.

SAN LUIS OBISPO, Calif. – The marathon preliminary hearing in the Kristin Smart case that started back on August 2 is finally beginning to wind down.


On Monday, the prosecution rested its case as the defense team opted not to present any new evidence or call a single witness.


The focus now shifts to judge Craig van Rooyen who will decide if there is enough evidence for the case to go to trial. Van Rooyen is expected to announce whether the case will proceed to a jury trial on Wednesday.
