Lawyers for Paul and Ruben Flores filed a 500-page change-of-venue motion late Wednesday, asking the court to move the Kristin Smart murder trial outside of San Luis Obispo County. The team claims it is not possible for the two to receive a fair trial in San Luis Obispo.

Plead not guilty. No bond.
*Ruben Ricardo Flores (55 @ time of crime/80) arrested (4/13/21), charged (4/14/21) & arraigned (10/20/21) with accessory to murder after the fact. Plead not guilty. $250K bond. Bond was lower to $50K. Has posted bond (4/22/21), out of jail.

1/21/22 Update: Judge Jacquelyn Duffy in the court room today, they are going through many pages of evidence, reading out the timeline of the night Kristin disappeared & going through testimonies & reports in detail. Defense attorney Sanger calls the dog handlers a "small group of volunteers" that are appreciated for what they do, but are not sufficient for testimony. The foundation for the dog handlers is also being addressed again for the court to consider. In the Flores' motion to dismiss in the Smart case: Sanger starts the meeting by raising the issue of the Prosecution "minimizing" wearing purple, calling it "pretty egregious". The Judge denies the Flores’ attorneys motion to dismiss Judge Van Rooyen’s ruling. Next pretrial hearing on 2/2/22 & then trial readiness conference hearing on 4/6/22.
2/2/22 Update: Defense requests change of venue. They plan to file a motion to do so on 3/9/22. The defense’s argument to move the trial out of San Luis Obispo County will be heard on 3/30/22. A pretrial conference is scheduled for 3/16/22 via Zoom, pretrial conference hearing on 4/6/22 & trial set to begin on 4/25/22. Earlier this month, a motion filed by the defense to disqualify the San Luis Obispo County District Attorney's Office from prosecuting the case was denied. 3/9/22: Paul Flores’ attorney Robert Sanger said he will be filing a motion by March 9 requesting for the trial to be moved out of San Luis Obispo County. Sanger did not say during Wednesday’s conference why a change of venue will be requested. Change of venue hearing will be heard on 3/30/22.

3/16/22 Update: No info on what happened at hearing. The change of venue motion points to the extensive media coverage of the case & the prominence of Smart's likeness in the community on billboards & at memorials as well as the podcast dedicated to her disappearance. It claims Paul Flores has been "disparaged & demonized" while being portrayed as the only suspect in the case. It also points to the small population of San Luis Obispo County compared to other counties in California & the gravity of the charge of murder. In a brief filed in opposition to the change of venue request, the District Attorney's Office says the defense's arguments do not demonstrate that the two men will be unable to get a fair & impartial trial in SLO County.
