As always, I find Sanger despicable. But this week, some of the things he's said make me feel like asking, " Are you ok? Is there someone we can call to come pick you up?"
Thursday, Sept. 22nd: *Trial continues (Day 29) (@ 10:30am PT) - CA - Kristin Denise Smart (19) (missing May 25, 1996 while walking back to her dorm from a off campus frat party at Cal Poly, reported missing on May 26, 1996, San Luis Obispo, still missing; legally declared dead on May 25, 2002) – *Paul Ruben Flores (19 @ time of crime/44/now 45) arrested (4/13/21), charged (4/14/21) & arraigned (10/20/21) with 1st degree murder. Plead not guilty. No bond. *Ruben Ricardo Flores (55 @ time of crime/80/now 81) arrested (4/13/21), charged (4/14/21) & arraigned (10/20/21) with accessory to murder after the fact. Plead not guilty. $250K bond. Bond was lower to $50K. Has posted bond (4/22/21), out of jail. Trial began on 7/18/22 with opening statements for Paul in am & Ruben in pm (which was continued on 7/21/22). State rested their case on 9/20/22. Defense started presenting their case on 9/21/22.
Paul’s attorney Robert Sanger & Ruben’s is Harold V. Mesick. Prosecutor is Christopher Peuvrelle. Judge Jennifer O’Keefe presiding.
Judge O’Keefe has blocked defense attorney Sanger from suggesting someone else killed Smart unless he can provide evidence of direct involvement.
Trial has been moved from San Luis Obispo County to Monterey County in Salinas. For 2 juries each: 12 jurors & 8 alternates; Paul’s: 8 men & 12 women & Ruben’s: 9 men & 10 women (still waiting for correction). 8/4/22: Another juror from Ruben's jury is out this morning & an alternate was sworn in to replace them. So now the count is correct at 19. 8/10/22: Sick juror did not return, alternate sworn in. Paul’s: 7 men & 12 women & Ruben’s: 9 men & 10 women. State witnesses continued: Detective Clint Cole. Sanger asked for a motion for mistrial for prosecutorial misconduct. Judge denies motion (#123). DA Investigator James JT Camp back on stand. Christopher Fitzpatrick, a computer forensics specialist with the SLO County Sheriff's Office. People rested their case (#132).

After jury is excused, Sanger asks to put on the record his objection to the final exhibit. Defense attorney Sanger makes a motion for judgment of acquittal. Defense attorney Mesick agrees. Judge O'Keefe denies the Defense's motion for acquittal.

9/21/22 Wednesday, Trial Day 28: Defense witness: Dr. David Carter, Professor of Forensics at Chaminade University in Honolyly & holds a PhD in Microbiology.

During the lunch break, someone reported that one of Paul Flores' jurors was engaged in a friendly conversation with the witness, Dr. David Carter. Jurors are admonished daily to not speak to any party or any witness in the case. A bailiff brings the juror into the courtroom. Dr. Carter called in by Judge to hear about conversation with juror. They will discuss this after trial today. Judge admonishes the jurors when they come by in.
Defense witness: Dr. Elizabeth Johnson, a Forensic DNA consultant for public defenders & defense attorney who do not have access to a forensics lab. Her testimony continues tomorrow on the podcast link.
The jurors were excused at 4:17pm. Two of them were asked to stay behind. A female juror sent a note to the Judge expressing her concerns about the conduct of a male juror. Both of them are on Paul Flores' jury. The woman juror doesn't like the laughing at testimony from another juror (no # given).
Judge O'Keefe: "How long has this been occurring?" Female Juror: "The snickering or quiet laughing, for about a month now. The commentary just started today, I think." Judge O'Keefe asks the Female Juror to return to the hallway. A bailiff brings in the Male Juror.
Judge O'Keefe: "I've received some information that during testimony, you may have been laughing at certain points & making comments. If you could refrain from doing that, it would be greatly appreciated." Male Juror: "Okay, sure." Asked if he has formed an opinion, juror says no. Asked to step in the hallway.
Sanger wants juror removed, Peuvrelle disagrees. Judges denies defense motion.
The testimony of Defense witness, Dr. Elizabeth Johnson, is scheduled to resume tomorrow, 9/22/22 at 10:30am.
