Thanks for posting that ~ Ashleigh has it right on! I especially liked this part:

"It wasn’t good enough that Spector’s immigrant driver offered no embellishment when recounting seeing Spector with blood on his hand, holding a gun, and saying “I think I just killed somebody.” Instead, Adriano De Souza offered only the facts, and no more, even though he was so afraid for his own life he sped out of the driveway while dialing police. Spector’s reaction? This military veteran who excelled in advanced English classes had his reputation reduced to that of a dumb fool who doesn’t know guns, and doesn’t speak English well enough to be believed."

I feel sorry for Adriano having to go through this again at the 2nd trial.

I wonder if at the hearing on the 22nd to set a new trial date they will have a new delay tactic,

I do hope they will set the trial date. It is just amazing to me that this has not yet gone to retrial ...

I'm not too surprised the way things seem to go in CA. I remember it took quite a while for the 2nd Menendez trial ~ but the outcome was worth waiting for! :)

any news on the hearing for today??? I believe it starts at 9am this morning!

just in case anyone else can't get to the link that joe jones provided - here's a snip of what the article said:

LOS ANGELES—A judge who is awaiting a California Supreme Court decision on whether he will preside over Phil Spector's second murder trial has gone ahead and set a new trial date of Sept. 29.
Los Angeles Superior Court Judge Larry Paul Fidler said Thursday that whether he presides or another judge takes the helm a trial date is needed.

Lawyers for the music producer are challenging Fidler on grounds that he is biased against Spector.

Spector's first trial ended in a jury deadlock last September. Spector, famed for his "Wall of Sound" recording technique, is accused of killing actress Lana Clarkson at his Alhambra mansion on Feb. 3, 2003.

Fidler also set a hearing on motions for July 29.

edited to add: THANKS! Joe!

I'm still not understanding what his gripe is against Judge Fidler. How many days in court were missed because his attorneys wanted time off? I remember the judge being very patient with Spector and his lawyers, and very fair in his rulings. I really hope they aren't successful in having him removed. Who knows they might get that judge who presided over Menendez, excluded testimony from trial #1 and took the cameras out of the courtroom.

California Supreme Court refuses to take Spector case

LOS ANGELES (AP) — The California Supreme Court refused Wednesday to take up Phil Spector's claim that the judge who presided over his deadlocked murder trial was biased against him and should be disqualified from handling his second trial.

The notice on the Supreme Court Web site said: "Petition for review denied." It noted that Chief Justice Ronald George was absent and did not participate in the decision.

The action clears the way for Spector's second trial to proceed. It is scheduled for Sept. 29 with a pretrial hearing on July 29.

Superior Court Judge Larry Paul Fidler, who presided at the first trial, rejected the defense claims months ago and signed a declaration that he was not biased or prejudiced against any party in the case.

Appeals Court: Phil Spector's Retrial Can Proceed

LOS ANGELES — An appeals court panel has rejected a request to halt the retrial of Phil Spector, the music producer accused of killing an actress in 2003.

The decision from the 2nd District Court of Appeal came Friday. Defense attorneys had requested a stay on the trial so they could appeal the case on double jeopardy grounds. They also wanted an assurance that prosecutors would not ask jurors to convict Spector on lesser offenses of manslaughter.

Spector's first trial resulted in a jury deadlock on a second-degree murder charge.

Gee I am not surprised that they did not ask for a few million dollars and a ticker tape parade for his creep.

Can't wait till the next trial, hopefully the DA learned the techniques of lawyers trying to get this creep off the street.

wonder if Dr Baden will have another revelation the night before his testimony and come up with a new theory, I see good old Henry Lee is still keeping his head down after the reputation bashing he took when trying to sell his snake oil to this court
