1/18/19 Update: DA asks for gag order on case. Judge grants gag order. Arguments for a “trombetta” motion, which alleges that the prosecution mishandled evidence in the case, with the ultimate goal of getting it dismissed. Both defense teams allege that evidence such as burned debris was lost or destroyed intentionally. Since a cause of the fire was never determined, the defense argued that some of that material could have at least been tested for fire accelerant. Judge Thompson agreed to have an evidentiary hearing, in which the defense will present evidence to support their motion. Since the defense filed the motion, the burden of proof is on them. The hearing will be held on Feb. 22. On Feb. 11, another motion to compel a citizen’s arrest of 14 other people filed by the defense, is also expected to be heard. Judge Thompson indicated that after February, there will be no more motions heard until the start of the trial on April 2.
2/11/19 Update: Judge Trina Thompson denies defense motion to arrest 14 more people for the Ghost Ship fire case. She pointed out that Judicial branch did not have the power to bring charges against anyone. Next Evidentiary Motions hearing on 2/22. Motions hearings set for 3/1, 3/15, 3/22, trial starts 4/2.

The judge in the case of Ghost Ship master tenant Derick Almena and creative director Max Harris for the 2016 Oakland warehouse fire that killed 26 people said on Friday that she has concerns about allowing cameras in her courtroom during their trial.

Alameda County Superior Court Judge Trina Thompson said cameras that a documentary filmmaker wants permission to use during the trial might pick up confidential discussions between Almena and Harris and their attorneys and with witnesses in the case.

However, Thompson didn't rule on the camera issue on Friday, partly because Harris' lead attorney Curtis Briggs wasn't present since he had to be in another courtroom for another case. She said she will rule on the camera request in the near future, possibly as early as March 1.

The judge in the case of Ghost Ship master tenant Derick Almena and creative director Max Harris for the fire at the warehouse in Oakland in 2016 that killed 26 people said on Friday that she won't allow cameras in her courtroom during their trial.

Alameda County Superior Court Judge Trina Thompson said that before she held a hearing on the matter Friday morning she had prepared a tentative order that would have allowed a single unmounted pool video camera to film opening statements, closing arguments and the jury's verdict in the trial, which is scheduled to begin on April 2 with hearings on various motions.

But Thompson said she changed her mind and decided not to allow cameras at any time when she learned that all the attorneys in the case now oppose having cameras in the courtroom.

The parties in the case will return to court on March 15 to deal with various procedural matters and on March 22 Thompson will hold a full day of arguments on the defense's request to dismiss the charges against Almena and Harris on the grounds that potentially exonerating evidence was destroyed, lost or altered under the watch of prosecutors.

Thompson indicated on Friday that the trial is expected to be lengthy, as she talked to the attorneys in the case about their availability the last week of August.

OAKLAND — One of the lead Ghost Ship warehouse fire prosecutors, David Lim, is leaving the Alameda County District Attorney’s Office, just as the trial is set to start.

Deputy District Attorney Lim turned in his resignation this week and is leaving April 5 to start his own practice focused primarily on real estate law. His sudden departure could mean another delay in the high-profile Ghost Ship case; jury selection is set to begin April 2.

Just checking as the DA resigned (as of 4/5)... you would think that they would have a back up to this case, eh?

Ghost Ship warehouse fire jury selection set for April

OAKLAND — Jury selection is still set to start in April in the case against the two men accused in the fatal Ghost Ship warehouse fire, despite a leading prosecutor leaving to go into private practice.

On Friday, Deputy District Attorney Autrey James told Judge Trina Thompson that prosecutors were ready to go forward and that they aimed to wrap up presenting their evidence at the end of May.

Other matters touched on included taking steps toward getting Harris and Almena civilian clothes, if they want them, to wear during the trial, and handling potential disruptions from the public.

The judge said people have contacted the court, asking to reserve specific seats in the gallery. She denied the requests.

“This is not an orchestrated theater,” Thompson said. “This is a courtroom.”

Both men are due back in court March 22 for hearings on motions by their defense teams.

The trial was originally set to begin last summer, but a plea deal was reached for the two defendants. However, the deal fell through after a judge rejected it following an emotional two-day sentencing hearing, restarting the trial process.

Ghost Ship Trial Defense Attorney Asks For 6-Month Delay

OAKLAND (CBS SF) — The lawyer for Ghost Ship warehouse creative director Max Harris filed a motion this week asking to delay the trial of Harris and warehouse master tenant Derick Almena by six months because of newly discovered evidence.

Although the attorneys in the case were told to keep their calendars clear for the trial of Almena and Harris, Briggs said another reason he wants the trial to be delayed is that he’s scheduled to begin a trial on what he said is a “life case” in San Mateo County next Monday, a misdemeanor trial in San Joaquin County on April 19 and a death penalty trial in Fresno County on April 29.

Briggs said he’s also scheduled to begin the retrial of another life case in Mendocino County on April 29.

On Friday, Thompson will hold a hearing on Briggs’ motion to delay the trial as well as a defense motion to dismiss the charges against Almena and Harris on the grounds that potentially exonerating evidence was destroyed, lost or altered under the watch of prosecutors.

Almena’s lawyer Tony Serra filed a motion last week asking that prosecutors be prohibited from making references to negative information about Almena, such as his use of drugs, including methamphetamines, that his children were temporarily placed with Alameda County Child Protective Services and that he has a misdemeanor conviction for receiving stolen property.

Yes, it is! It does say "Jury Trial" for April 2nd, but that will be a "Motions Hearing" on that date. And the article does say - after ALL motions are heard, then jury selection will begin.
