Circumstances:
The decedent was found by four high school students who were walking home from school when they spotted a partially buried container under some bushes. They began digging and uncovered the container which had within it a plastic bag which contained the decedent wrapped in fabric. (per NamUs).

Notes:
A funeral service was held for the infant at Lima Family Milpitas-Fremont on September 5, 2003 and he was buried in what is now named Cedar Lawn Memorial Park in Fremont, California. His headstone, which bears the name “Baby Dale” and the date of June 3, 2003, features a small angel and the following epitaph: “In God’s Loving Arms.” The services were paid for using private funds from the Police Officers Association.

As of October 10, 2024, there are no public exclusions on NamUs.

Two newspaper clippings attached to the NamUs profile (dated 06/16/2003 and 09/03/2003) have additional information that includes:

• He was found near a “sound wall” at Diel Drive which is also near Interstate 680 and within walking distance of four different schools.
• An autopsy indicated Baby Dale was likely stillborn; the umbilical cord and placenta were still attached.
• The robe that swaddled Baby Dale was specified as being a bathrobe.
• In addition to the adult bathrobe, Baby Dale was also swaddled in a white baby blanket with the date “6-03-03” and name “Dale” written in Sharpie on it and “white plastic wrapping.” This plastic wrapping is not listed on NamUs as of (10/09/2024).
• Authorities were not investigating this as a homicide and stated the manner of burial indicated a level of compassion towards Baby Dale.

The June 14 article has the following additional information:

  • Baby Dale was found on a “trail leading from a Milpitas School District maintenance yard west between the Interstate 680 sound wall and a chain-link fence behind a row of houses” and under a pepper tree.
  • Baby Dale was found around 4:30 P.M and June 11, 2003 was a Wednesday.
  • The plastic container was blue and buried “just a few inches into the ground.”
  • The plastic container had a “sales sticker” and a Scooby-Doo sticker on it.
  • The article also describes the container as being “designed for picnics or a day at the beach.”
  • The white plastic material that wrapped Baby Dale was a shopping bag from a Charlotte Russe store.
  • Police visited local hospitals, contacted “officials” at Milpitas High School, and went door-to-door to speak with locals.
  • The autopsy was “inconclusive.” Decomposition also made it difficult to study Baby Dale and something like suffocation (after birth) would be difficult to determine.
  • The medical examiner Gregory Schmunk believed that Baby Dale was born within two days to a week prior to being found.
  • Cmdr. Jim Berg also said authorities were treating it as a homicide but not proceeding with a criminal investigation at the time as they primarily wanted to locate Baby Dale’s mother to make sure she was safe.
