At Clear the Court, he seems to think there wasn't enough evidence for the 2nd degree murder for Ramos.

In my opinion, the evidence does not support a Second Degree Murder conviction against Ramos.

Barnett told the jury that Fullerton Police Department Cpl. Steven Rubio testified what the officers did during the altercation with Thomas was "consistent with their training." Rubio testified he provided use-of-force and tactical training to Ramos and Cicinelli.

Rubio, the training officer for the Fullerton Police Department, testified in December that he saw nothing contrary to department policy when he watched the video of the encounter between officers and Thomas.

"Their actions were consistent with their training and nobody disputes that," Barnett told the jury.

During his testimony, Rubio said while it is preferable not to use profanity, "sometimes it is necessary to avoid a physical fight." He also said Ramos' threat "see my fists" was intended to get Thomas to comply with Ramos' orders and were preferable to a physical confrontation.

I don't understand this. The jury is going to be or has been instructed to not consider Rubio's testimony. Why is this defense attorney allowed to refer to it in his closing? This is not right.

I agree. This is getting bizarre. And how can Barnett say nobody disputes that Ramos and Cicinelli acted properly when Fullerton fired them because they didn't act within policy? Looks like the defense can claim just about anything to spin their story!
 
I hope the jury is aware that they are both not working as cops any longer. I don't think the DA was allowed to say, or even know, why. But, couldn't they still get in somehow that they aren't? Hope so.

I cannot imagine anyone seeing and hearing that tape and not realizing that murder was comitted. Period.

However, I also could not imagine anyone finding Casey Anthony, the cops that beat beat the daylights out of Rodney King or OJ not guilty either, so I am not expecting much. Especially here behind the Orange Curtain.

That is so true chlban. I guess I just hope that some people will receive the justice they deserve.

Oh good grief! I hope not mister happy. It would surprise me to learn it was a defendant insider. That's how much I trust LE.
Anyway, hopefully not. It isn't being televised so hopefully that will account for something. I'll have to go check out Leo Terrell's site.

This makes me mad. This is where the prosecution should have popped off an objection and given the reason to embarrass the defense for using it.
Oh gosh I hope just seeing and listening to that tape will be the only focus of this jury cuz imo it screams murder. No words have to be spoken.

Because my friends this is Orange County California. I have said all along that those murderers would get off and they will get off because they have a badge. The exact reason they figured they would get away with this. This is right wing, wing nut territory.

I know I have lived here since 1983.

No stupidity at all. t's just a local description that Southern Californians use to refer to Orange County. Sort of like the old Iron Curtain. Orange County, politically, is unlike the rest of the State. Although CA. is considered a liberal state, and overall it is, not so in Orange County. This county historically votes with the most conservative of the conservatives. I consider myself a political and social moderate but I am sure most of the people I know from here think I'm a communist.

As such there is a tendency here for people to worship the police. Although I will say that among my friends and associates, there was much more of a tendency to hold these cops responsible than I have ever seen before in any other case. I think the poor man calling for his dad even managed to melt a few ultra conservative, law and order types.

However I think when it comes right down to it the odds of 12 people from this county actually voting to send cops to jail, it just won't happen.

Yes, the jury is still out. They started deliberating Thursday afternoon and had Friday off. They will be back at it on Monday.
 
Hopefully, Kelly, his family and friends will see justice served today in a verdict of guilty on all charges beings that they weren't charged with 1st degree murder.
